Stepping on my property constitutes trespass:mad:

  • Closed Accounts Posts: 308 ✭✭nicola09

Back to the OP's original query, I think it is the fact that these people are entering his property to deliver the "newspaper" is causing more distress than the paper itself, like many have said it is easy to dump the offending paper into the recycing bin (or put it to use as toilet paper as some of the more imaginative posters have suggested!) Entering someones property without their permission is trespass, for which you can be prosecuted so perhaps a "No Trespassing" sign might be of more success than the no junk mail one? People are more aware of the illegality of trespass than they are of the illegality of religious advertising after all! ;)

On a seperate note, I was reading the list of people who donated to Alive! in the June edition on the website linked earlier in the thread, and someone donated €10000 so unfortunately Alive! may remain in print for the forseeable future..!

Put up a "delivering alive! to my house is a mortal sin" sign and they won't even look in its direction ever again.

Legally it doesnt unless you have indicated that you dont want them there.

Legally would ignoring no junk mail signs (or requests to desist) constitute trespass ?

It would, as they are entering the OP's property to distribute the junk mail. Ignoring the request to desist strengthens the plaintiffs claim, as even if the Alive! people had permission to be on the property, the sign puts them on notice that their permission has terminated and they have become trespassers. It's the same as with a Garda search warrant, they can only remain on your property subject to the conditions in their warrant, or if you give someone permission to remain on your land until 6pm, after 6pm they are a trespasser. Same applies for recreational users i.e. people who exercise in a GAA pitch for example but aren't members of the club, the club will normally overlook people like this, but if they are told they no longer have permission then the change category of entrant and become trespassers!

Then a "do not deliver alive! here sign" would work?

The main problem I have with religious propaganda is it doesn't even make good roach material for spliffs. You can say what you like about the politicians but their flyers on the lamented card was perfect for roaches. Especially FFails.

The OP contacted Alive so s/he has satisfied this. It isn't the OPs fault that they wont tell his the exact person who is entering his property.

Yes since that would be indication that you dont want them there.

Actually in this instance the "No junk mail" sign should have been sufficient but by contacting them directly any ambiguity over what constituted junk mail was resolved

"and forgive us our trespasses as we forgive those who trespass against us..." (or something) That springs to mind from my Catholic education hahaha, looks like this is going to be problematic!

The problem with silently binning shite like this is that your copy is a number in their circulation.

On a similiar note did anyone who finds offense in Alive phone Sky TV to complain about the religous tv channels available in your home? EWTN must have you foaming at the mouth :pac:.

Why would you want it stopped, it's pure comedy gold.

I'm not seeing the similarity between a few religious channels that you have the choice to watch or not & having religious literature posted through the letter box, sometimes despite requests to the contrary....

In a way you are forced to read it, it's a waste of paper in that it's going to be destroyed straight away if it's given to people that have asked not to see it already.

Forced to pick it up and deal with it in some-way...I don't have to "deal with" sky channels I choose not to watch.

I haven't actually seen a copy of Alive in yonks.

I think I saw them around the house as a kid, but my parents must have stopped getting it. If my parents are turned off by it, it really does say something about it. Trust me.

I went on to their site though, and I can understand why looking at their archives. The front page headlines read like parody, the type of thing you'd see scrolling across the newsticker in Sim City or something.

On a side note, one paper my parents still do get fairly regularly is the Irish Catholic. While I don't think they have quite reached the levels of Alive, I have noticed that their editorial and blogs has veered heavily into a pungent mix of self-persecution, self-entitlement, paranoia and hypocrisy. I really don't think this kind of messaging is the sort of representation the Church needs at the moment here, it's very unappealing/unattractive.

Leaving aside that not all TV channels on the 28 degree East satellites are provided by $ky (The religious ones are all Free to Air)

If I dont want religious TV channels I dont watch them. (If Im really bothered I can set up my satbox to block them)

If I dont want this stuff posted through my door (It makes a mess of my hall, it takes up space in my bin, in areas with pay by weight bin collection it actually costs me money and is generally hasstle not to mention being downright offensive) I shouldnt be subjected to it. Especially when Ive indicated I dont want it.

If you cant see this PM me your address and Ill post you some *Gay Porn/Atheist literature/Communist newspapers/This weeks edition of the Orange standard randomly at my discretion.

    * Offer not open to Gay porn enthusiasts/Atheists/Communists/Orangemen

That extra press on the arrow button past the religion menu is dealing with it too. Phone sky now:pac:!

Still can't believe this is a big deal to some.

So an eight page monthly newspapaper adds how much to your refuse bill. Times must be tough.

Mike 1972: Yes, but Sky give them a slot on the EPG, a privilege which not all FTA stations have.

Why should I pay a red fcuking cent ? (Oh and Im still waiting on that PM with your postal address)

Besides Its hardly the only item of junk mail the average person receives (Every raindrop denies responsibility for the flood)

Heres an Idea. OP send the publishers an invoice charging them for paper disposal.

400 quid per issue sounds like a fair tarriff

I think youll find they pay for it.

$ky EPG slots dont come cheap

Quite aside from poking fun at Alive, the original point I think was that it's just simply the absence of respect for a clear sign not to have any spam delivered.

TV stations are hardly comparable. You have to solicit them by switching your TV to them. They leave no physical trace in your house one way or the other either. Spam requires 'dealing with' and you shouldn't have to do so.

I didn't say it was a big deal, I was refuting your similarities between voluntarily watching a religious sky channel and being forced to bin and pay to get rid of religious literature that's posted through the letterbox, in some cases despite being asked not to...do you have sky? The religious channels are at the @rse end of the menu, never have to go near them, again, bad comparison. :p

Contrary to popular misconception one can have satellite TV without involving $ky in any way shape or form BTW

I think were wasting our time trying to get this point across to Alive-reading types TBH. How many times have you heard them foaming at the mouth about this filth being beamed into our homes (TM) FFS

I believe there is currently an entire thread dedicated to foaming at the mouth about shows/comedians people force themselves to watch and get offended at... :pac:

I find this thread hilarious. No foaming at the mouth here..........

Guys as someone who has delivered stuff for years(charity stuff mostly) if one places the "NO junk mail" on a pillar at the end of the drive you will get much less "junk mail". Makes it handier for everyone.
