I got that last night & i insisted i speak with a supervisor....i argued my point for about 10 mins, the one that finally won my get out of contract free of penalty was: you are an O2 rep, therefore you are O2, so you should be able to handle this & not only a department which works in hours unavailable to me & therefore you are preventing me from exacting me rights as set out in regulation 17 (blah blah blah), & that i cannot ring at the hours of 9-6 which that team work in....so basically you are in breach of this regulation.

She got annoyed & said fine i'll take you out of contract, so they can do it!!

Anyone can take you out of contract, the reason they are trying to channel everyone into the special team is because they are trained retention specialists who have a list of things they can give you as temptation to stay in contract. I found that out last night, left my name they called me today, and I got a fair few extras ! I was on 16 months left to run, but now have a new contract for 12 months with lots of free extras. But only that special team can do that for you..doesn't matter how much you shout at the supervisor, she hasn't got access or authority, so its worth speaking to the special team. Fair enough having a grumble at the evening staff if all you want is to get of your contract on principle. But if you want to play clever, you can get more out of them... I weighed up the options of moving to Voda with my 2nd phone and it was worth my while to stay ;)

Not sure if this has been asked, but is there any way of emailing you request to o2 or doing it through 'my 02'.

I am rarely available to call during business hours, but do want to get out of my contract.

I called them at 6.40pm yesterday and got taken off of contract. Calling is better!

my contract has already expired so I was just ringing to make it had otherwise I was envoking article 17.

He was one of the better cs guys - so I was just shooting the breeze telling him i'd seen this thread etc.. Apparently they've had a crazy day in there today with tons and tons of people exiting contracts. He couldn't believe someone f**ked up so royally in O2.

You can be guaranteed this will never happen again!

Person I spoke to there , seems to think it's part of a master plan to do with the new iPhone coming out and not a f*** up at all ... take lots of people out of contract lure a few high spenders ( like me :o) to stay with freebies and then let everyone else go to Voda to get new iPhone for free.. which costs Voda big in subsidies. O2 only want the big spenders on iPhone cause they subsidise it so heavily.. so everyone else wallking off to other operators is actually helping them to increase profit... can't see it myself but also would be surprised if such a glaring loophole was truly accidental so close to the launch of the 4G. ;)

If i took the freebies I'd have to wait...PS, i never shouted at the supervisor ;) i just argued my point fairly as i know it wasnt her fault, she's just doing her job.

fair dinkums.. and I was just being poetic for effect.. different packs to suit different peeps:D

Well i've called twice.. once @ 7.30 and then at 7.50
I was told someone would have to ring me back on both calls, on the 2nd one I said I work underground and wouldnt be able to answer the calls until after 7.30pm, whcih she said she would log my call and get someone to call me late in the evening, she could not help me really at all she said, I dind't get angry or shout - as I feel there is no need to be treated like that by someone over the phone

    I love this theory.

The only problem is that O2 paid through nose to get those customers and only recently surpassed vodafone as having the largest postpay base in the country. This would have been an absolute massive deal in O2. Don't think they would give up that accolade so easily.

I have been on the advance 350 now for 6 months, I am going to cancel my contract tomarrow and continue bill pay as normal. Am I still entitled to get an upgrade when the iphone 4 comes out even if cancelling my contract now? I am going to give my 3gs to my sister but I am concerned that if I am not entitled to an upgrade, 02 will not allow me to sign a new contract for 3 months if I cancel my current contract tomarrow....

Reading conflicting posts all over the place about this, don't know whats what..

    Thanks

9 months into the contract and you're expecting an upgrade to an iPhone 4? Have O2 become Santa overnight?

i've got a iPhone 3G since July 2008. about 4 months ago I got a call to renew my contract. I asked would my upgrade still be intact and they said yep of course. I figured a gold upgrade would get me about 50euro off the prices advertised for new iPhone customers, no??

Am I better off getting out of my contract and re-joining as a new customer?

How much would I have to spend on gold upgrade to get the new iPhone 4 32gb assuming its abut 299euro on the cheapest bill brand new?

    any advice much appreciated.

  • Registered Users Posts: 28,127 ✭✭✭✭drunkmonkey

Stuart nobody knows until it's released here, the safest thing would be to go onto a 30 day contract and ask them will they keep your gold upgrade available, you can then see when all the operators release there prices who's got the best deal. You've a chance to get out of contract, take it and see what happens when the iphone is released, you've nothing to loose but you have if you don't get out of contract, don't just take a reps word for it, get it in writing because after the 12th o2 can say the conversation was never noted and your still in contract.

thanks drunkmonkey, I think someone else said earlier that a silver upgrade would get you about 20euro off the PREPAY iPhone price. I think, like you said, getting out of contract is covering my bets (I want to stay with O2 though!)

exactly, cover your bets, silver upgrade is worth nothing, gold might get you a bit more off but it's still not the best you can get. If your out of contract you'l have a lot of power to strike a great deal when it's finally released..

just trying to get ios4 on my 3GS right now, hope it's all it's cranked up to be..:)

are we sure I can re-sign a iPhone4 contract when it comes out having exied my contract now?

I bought a HTC desire 2 weeks ago on an 18 month contract. And now its gone. It's just too good to be true. I don't think its a oversight by o2, its intentional. A business decision, although baffling to figure out. An extra cent on a phone call couldn't lead to huge earnings could it, particularly when all contracts have inclusive minute before you are even charged. I think they want people out of contracts because of the lure of iPhone 4.

People will buy it and all be tied into another contract anyway, but it will all be more lucrative for o2. And remember voda have done almost the very same thing. It's and industry ploy, I'm convinced. The UK o2 plans are now more expensive in preparation for the new iPhone. Other smartphones just don't have the market share Apple does or the loyalty, the phone companies know it. They are rubbing their hands reading this forum with everyone thinking about upgrading to iPhone 4. You are playing straight into their hands. Let the price fixing begin.

    (prepares for backlash)

You got a subsidised HTC, which would have taken O2 most of the 18 months of the contract to make their money back on the subsidy.

You then think they did it deliberately so you would buy a subsidised Iphone 4as well and to lure you into a new 18 month contract, because you think it will be more 'lucrative' for them.

Is that correct? Where exactly do they make more money, rather than lose money?

On reflection, its a heavily flawed argument.

I think it's just the power of the internet. Without the OPs thread very few people would have known about the clause and even fewer would have known the contracts where changing enabling the clause. Even if you did you would have rang up and O2 would have told you don't be silly and fobbed you off.

The OPs thread has let a massive amount of people know their rights, and the ongoing experiences of people supporting each other in dealing with customer care is preventing anyone being denied their rights by O2.

Basically O2 thought they could get away with it and the OP has prevented them doing so. They'll be slow to change contracts in the future.

The only people it's bad for (besides O2) are ones like me who avoided the 3GS so to be out of contract in time for the Iphone 4. I needn't have bothered and now there are more piranhas in the iphone 4 tank when it becomes available!

No, if you rejoin O2 within the next 6 months, they will not offer you a new phone, they will just reactivate your old account.

This was confirmed by O2 today.

Well they make money by not losing a client to vodafone who can offer them an iphone 4g at discount price.

10 times more expensive to get them back and vodafone has better 3g coverage.

so to get it straight once and for all, if your on a O2 plan now, and plan to upgrade to iPhone 4 on O2, it would make more financial sense to stay and use your upgrade rather than disconnect your contract and have to pay full whack in a month or so for the new iPhone.

Hard to say because your basing that theory on 2 assumptions, a. That 02 will have the iPhone at launch & b. They will be selling the iPhone at a good price to existing customers, a silver or gold upgrade mighten get you much off the price of the phone.

Get them to move you onto a 30 day rolling contract if you've a few months left on an 18mt contract, if your already out of contract you don't need to do anything just wait and see what offers are available when an if o2 start offering it.

Just rang in there now. Dealt with a very helpful guy who happily joked about the chaos they were under and about having his box of paracetamol ready at his side for the day lol! Have my dads and my phones contracts cancelled and both unlock codes have been requested and will be sent out within a week or two. Best of luck to everyone else getting out of their contract :D
