There might have been a 'no foal, no fee' arrangement, but for me the big thing is that the bad publicity that she has earned for Madigan's law firm will take a long time to go away.

Assuming that the hotel's insurers were defending the case, they could go after her for their costs, but (i) it might be seen as vindictive and (ii) she has saved them money by pulling out!

Supposing it went to court and the judge found there was no substance in the claim and ruled in the hotel’s favour, then she could be liable for defendant’s costs, the court fees, the expert witness medical consultants’ fees, and her own lawyer’s time. It may be that the hotel made an undisclosed settlement or that her lawyer, upon seeing an expert witness report that wasn’t in her favour, advised against proceeding further.

By not answering key questions on SOR you have to assume the worst, which is that she sued a business, not because of their negligence but because she was in a position of such fantastic power (political family, money and influence all behind her, on the up as an elected councilor and friends in extremely high places in the legal and political professions) that she knew she could get away with it. “I felt mortified” listen to the inflection she uses on that word, she says it twice and it’s key, so somebody must pay both in terms of face and in terms of money. It’s an astounding abuse of power

Before the incident at the hotel she acted as if she needed to be dragged there by friends. Then she changes her tune completely when talking about being at the festival.the manner in which she lies is fascinatingly easy to her.

Not only that she said that she went to Longitude after the accident and that she sat down on the grass, listened to one band and then went home. Sounds like even more bullsh1t to me, as another poster said she seems to be a pathological liar, it just comes so easy to her.

Id say Joespha Madigan is furious with her for this getting out and the car crash of this mornings radio interview. All of Dun Laoighire/Blackrock/Mount Merrion will be chin wagging about Madigans legal firm suing the Dean Hotel over Bailey falling off a swing, this will not bode well for future business in those areas.

It's almost impressive how she manages to apportion blame to practically everyone else involved in this situation apart from the person who is actually responsible, herself.

It takes a massive sense of entitlement along with a neck like a jockey's bollocks to pull that off.

I'm not sure if she would have won her case given some of her contradictory statements, but I saw a clip of the swings on VM news and it's a crazy place to put them. Plus, even if it is a crazy place to put them, you shouldn't be falling off one.

Ms Madigan declined to clarify if she "did or didn't" advise her Fine Gael colleague on the case, which Ms Madigan's family law firm lodged on their client's behalf in 2015 - two years before Ms Madigan left the firm.

Josepha is inextricably involved now either way, it is inconceivable that she wasn't fully aware of this case.

Bailey has said she was informed by Madigans that the case was open and shut.

Granted, she (Bailey) could be lying about her legal advise, or equally plausible is that Madigans informed her that it was an open and cut cafe on the back of lies being told to them, but either way, Josepha and her family's law firm have become entangled in this chancers web of greed and deceit.

It will all come out in the end though, that's for sure.

The SO'R interview was dire. I was laughing hysterically it was so awful. She just kept on digging...

"I was hurt"..... yes, but why is that someone's fault (the Dean in this case)???? Her interview said everything about the compo culture.

If I walk down the street on the path as I should, there is a reasonable expectation that it is safe and maintained by the country council etc. If I fall into a huge pothole and injure myself, then I've a case. If I just fall because I just did (it happens) then why is anyone to blame?

She wanted to make a few bob- let's get real. Shame on her. Oh, sorry, I'm a keyboard warrior now.

Ha I did the same, brought my 18 month old niece to the playground and she used the swing without any issue too!! Take note Maria!

I had listened to the Sean O'Rourke interview prior to leaving and was thinking it would be a travesty if public playgrounds are ever closed due to excessive insurance costs as a result of questionable personal injury actions.

I don't think Deputy Bailey will walk without a fight, what are Leo's options here or will the negative attention from swing-gate die down and be merely "smoke and daggers" as Bertie would say?

if she had put the hands up and said, yeah look i made a mistake, she'd still get slagged but it would have taken the wind out of the story. but she didnt. she doubled down and made a holy show of herself leaving the other people who followed her on the show, including a party colleague, utterly gobsmacked. i dont like to see anyone kicked while theyre down but she has no one to blame but herself here.

Bailey is throwing Madigan under the bus. More or less she would never have brought the court case only legal advice told her to go ahead with it
