Me too. I said for tenants in common he only has to communicate with one of them to be bound when it's actually both he needs to communicate with.

Also..."joint owners", does that mean tenants in common or joint tenants?
I just gave an answer for both.but it could be a joint tenacy because by default the four unities are there when the title passes

Just realised I fluffed the secret trust question by going on about half secret trusts. That and I had to make up half of another question so I think I’m screwed.

QUIA TIMET INJUNCTION WHERE WERE YOU?!?

Anyone know if equity is marked handy enough? :(

Honestly lads don’t worry! I hadn’t done secret trusts and talked about the three certainties and the admission of extrinsic evidence LMAO! Other four were okay! that paper was SHOCKING but seems it was shocking for everyone!

Even Undue influence lacked the bank thing so you couldn't bring in all the new cases.

That question broken my heart. I know those cases well having studied them for both contract and equity. I ended up ramming a few of them in their anyway. My reasoning was that in light of the increased importance being placed on legal advice, it would have made for a strong rebuttal if Derek was the one that suggested Barry seek advice. Desperate and embarrassing.

I couldn't decide if it was fully secret or half-secret. I ended up going for half-secret because it appeared on the face of the will that they were both holding the propety for another 'purpose', which I interpreted to mean another person.

Did anyone answer 1(A)? Pretty sure I wandered off the reservation for that one.Enjoy getting your lives back folks.

Never been one to let fe1s get to me but I didn't get 3 passes in March so I studied hard for 3 this time. Balanced work, personal life and study. Just like we all do. Coasted the two I sat and seemed like I covered everything for equity. How can it feel like I covered everything but so little came up?

Shows how off trend this exam was because I think the only thing my course provider (won't name) was the Hastings bass part question. I know you don't put too much weight on predictions but I covered as much as was possible.

    Absolutely gutted.

I said it was half secret trust too and I'm *pretty* sure that I at least had that much right!

I gave either or advice in any case. Here's hoping I did enough to pass the question before coming to the advice part!

Yeah but the course providers can only say what is due to come up based on the past papers...
It's not the course providers fault. The examiner repeated topics from the past paper seemingly to catch people out.

But you are graded against everyone else who focused on similar predictions so don't worry! Everyone was caught off guard. :)

I suppose the argument is from them that you're meant to know all the material, not cherry-pick and try play the system. Though we all do, including myself.
The examiner gets paid per script. The more they fail.... the more resit.... the more they make.
    I'd fail everyone lol

Absolutely, we can never argue "hey you didn't follow the pattern" because we're meant to know it all, but in reality they know that's not true so they know full well what they're doing when they do topics sittings in a row, spin things oddly and focus on niche areas. Think of it this way, to know everything their syllabus is effectively "read the book" so if you say company, equity and contract imagine trying to know Courtney, Clark and biehler cover to cover, so they have to expect some guesswork!

Also, I nearly lost my life when I opened the paper, knew I would though when the person beside me opened it before me and gasped haha

I'm with you there. I have 7 done and Equity continues to screw me. I covered a lot and was well prepared but I ended up scribbling basic answers. Ironically thats the best prepared I have ever been for an FE1. I've done the all nighters 3 nights in a row in the Red Cow and came out the other side with passes.

It was entirely reasonable that people would have not seen Mareva, Estoppel and Undue Influence ALL coming up again as the "big topics" ....I was the same. I put a pile of work into the other big topics and thankfully covered Undue Influence. Still feel terrible. Joint Deposits and Secret Trustees were pure back ups and my answers were scrawled garbage.

Like it just feels that exam was intended to shaft people rather than challenge them. That's what sucks.

Sure the EU/ Tort/ Constitution courses are huge. I know as I've sat all 8 and EU is a nightmare in terms of content. The Tort negligence section is almost 100 pages! Senior barristers who specialise in negligence prob wouldnt know it all.
If I spent as much time on my NUI LAW exams I'd have gotten a record breaking 1.1

I can’t bemoan the paper because I had four good questions done and threw it all away with scribbling what I could remember from a nutshell book on secret trusts. I checked and everything I wrote was wrong for it lol.

    Oh well such is life

This was my first time sitting and pretty sure equity screwed me out of getting the three (unless 3 and a half decent questions is enough to pass!), how does anyone face sitting these again?!?

The idea of doing this all again in March is soul destroying.

Whatever you do.... sit 4. Sitting 3 is a dangerous game to play.
When I was convinced I passed Equity, I failed. When convinced I failed, I passed (on 3rd time). You never know.

I agree, I sat four this week, have doubts about European also but was hoping that would be the only one, until today, sickened!

Zero hope for results but sure nothing to be done now except wait and buy tissues :(

Rhetoric suggests EU is marked fairly so you prob be ok. You've a 77% chance based on last paper stats. I hope I'm in that category to complete my FE1 two year 'adventure'

It was just such a sly paper designed to catch people out. I only have myself to blame because clearly I cut too much out but to fair these exams are difficult enough, taking huge time, energy and expense to pass, without an examiner serving up an exam like that.

I won't even bother trying to predict and cut down the course for this exam in March. Waste of time.

I have sailed all the other 7 subjects and I'm stuck in no man's land with this Equity exam, again!

  • Closed Accounts Posts: 84 ✭✭MagicThree18

Well that's me done on here folks. I'll be closing my account. Thanks for sharing the struggle with me.

I hope to be back next year as FinalFour19

Same man. Looking back I have no idea how I got my magic three taking absolutely mad risks .....yet Equity I just can't nail down even when I actually cover most of the course !

I was devastated after today’s exam got 3 good questions. I’m not sure how they mark them so I presume I failed. I have only done 3 cause I wanted to pass and focus on getting through them.

It is so unfair the 50% marking scheme. A mere memory test. My topics I focused upon for equity never came up. I worked really hard. If I covered it all as some people claim I know the cases won’t stick in my head.

Just wondering what's going to be on the March 2019 paper.....

Hope nobody's feeling down after their exam fortnight - try not to take them to heart and bounce back if they didn't go your way! Whether you've sat them or walked away, it's taken guts to make the decision. Best of luck with future endeavours (at them, or whatever path!)

Now that exams are finished. When are we getting the r suits? And how do we get the results ? Online or by post?

Not sure the date but I think December and you can view them online from 9am or 9.30am on results particular day. Make sure you can log in on the law society website (check email and password works in advance; if not contact the law soc). They're also posted out and arrive on results day. Good luck with yours :)

Lads and ladies, I was stuck on a bus after the exam so decided to flick through the Equity past papers as my phone was dead.

March 2014 - With the exception of the CY-Pres question, was the exact same paper. Topics and questions were the exact same!

I would love to know the pass rate from that exam!

Ugh, that’s annoying when you can only order past papers from the law society as far back as 2015 this year if I recall correctly. So annoying, they’ll likely not mark it too easy so damn it.

It is usually 6 weeks after the Friday of the last exam. By my calculation that would be Friday 23rd November.
