Hi all,
Vanilla are planning an update to the site on April 24th (next Wednesday). It is a major PHP8 update which is expected to boost performance across the site. The site will be down from 7pm and it is expected to take about an hour to complete. We appreciate your patience during the update.

    I thought question 4 was non est factum too tbh and that’s what I answered but someone said it was undue influence

    In relation to the general principles and proportionality, what cases are people using? I know any case can be used here but just looking to see if theres any ones in particular that should be mentioned

    Fair, I only glossed over it in the exam assuming it was misrep whoops!

    Would have been a nice Q if I had copped

    Edit - Misunderstood, I glossed over Q3 assuming it was Misrep, Q4 I thought was undue influence from a quick glance but I could def be wrong

    In my conclusion I suggested that the Court would overlook the obligation to enquire into the content by virtue of duress undue influence and capacity but that was it. Yikes, fingers crossed.
