Could someone point to an actual law and the relevant legislation that has been breached..so that people can then go to their local Garda station and complain about it.

It appears section 18 of the Central Bank Act 1971 has been contravened. However the penalties are mickey mouse as set out in Section 58/59.

18.—(1) A holder of a licence and any person who carries on the business of a building society, an industrial and provident society, a credit union, an investment trust company or a unit trust scheme shall furnish to the Bank—

    (i) at such times as the Bank may specify from time to time, such information and returns concerning the business to which the licence relates or the business aforesaid, as the case may be, as the Bank may specify from time to time, being information and returns which the Bank considers it necessary to have for the due performance of its statutory functions;

(ii) within such period as the Bank may specify, any information and returns (not being information or returns specified under paragraph (i) of this subsection) concerning the business to which the licence relates or the business aforesaid, as the case may be, that the Bank may request in writing, being information and returns which the Bank considers it necessary to have for the due performance of its statutory functions.

    (2) A person shall not furnish information or returns under this section which he knows to be false.

    (3) The manager under a unit trust scheme shall for the purpose of this section be deemed to be a person carrying on the business of the scheme

    58.—(1) Any person who contravenes section 7 , 14 , 17 , 18 or 27 of this Act and a holder of a licence who—

    (a) contravenes section 19 , 20 , 26 , 31 or 33 of this Act,

    (b) commits a breach of a condition attached to a licence,

    (c) fails to comply with a direction under section 21 or 22 of this Act, or a requisition under section 23 of this Act, or

    (d) contravenes regulations under section 24 or 25 of this Act,

shall be guilty of an offence and shall be liable—

    (i) on summary conviction, to a fine not exceeding one hundred pounds, or

(ii) on conviction on indictment, to a fine not exceeding five thousand pounds,

and, if the contravention, breach or failure in respect of which he was convicted is continued after the conviction, he shall be guilty of a further offence and shall be liable on conviction on indictment to a fine not exceeding two hundred and fifty pounds for each day on which the contravention, breach or failure was so continued.

    (2) Where there is a contravention in relation to a unit trust scheme of section 14 (2) of this Act, the manager under the scheme shall be deemed to have contravened section 14 of this Act.

Brendan Howlin now in RTE on the news saying again that they are rushing through procedures to conclude and get started this parliamentary enquiry...

NO ONE wants this, people want prosecutions.

Wasting dail time with people that have no skills or no power to question anybody in relation to this matter is ridiculous

    It gets even worse -

The government of the day (FF) back in 08 dressed up the bank guarantee as a measure for an overnight emergency and this to be quiet honest is nothing more but pure cock and fcuking bull. FF or some within cabinet knew god damn well of the troubles in the banks long before the bank guarantee. Come on! Golfing and dining together.

FF - where the fcuk are they? Cowen? Bertie? Why aren't they being hauled up here?

Banking Regulator Neary - where is he? Why hasn't there been any action taken against him? For incompetence or something. Negliance, maybe?

Can CAB not be enacted as their salaries were derived from fraud.

Nothing will happen as a result.

Not only will none of these bankers go to prison, i'll be quite surprised if any of them are even taken to court.

That's why any investigation is doomed to failure. Not only will it go to the top of the banking sector, it will go to the top of the political and legal systems and beyond.

After watching that if we were not a laughing stock, we are now, I like the way they slipped in the possibility their actions were a reaction to other goings on far far away,

long live the fools that allow themselves to be fooled, nothing will be done, nothing will be fixed, our grandkids will be still affected by this 40 years down the road,

North Korea looks like a good spot to live now.

An enquiry, thats a laugh. When has there ever been an enquiry in this country that has ever led to jail time??... im going to say never.

All that will happen is it will get dragged out for 10 years, loads of smoke and mirrors, the lawyers will get rich and **** all will happen.

It sad when you think about it, clear evidence that at the very least they defauded the state of billions of euro, but they cant be touched without an enquiry... Would i get an enquiry if i lied to the taxman? ...me hoop id be slapped in jail.

I still dont understand why these morons are not dragged from their beds?

I would bet some of their cronies in the Dáil/Seanad actually had loans with these crooked banks let alone let them off scott free. We dont know the half of it.

Why else would they protect the banks so much in fairness?

They protect banks per se for the same reason every other country does - yes, even Iceland - because the banks are economic utilities. You have to have money and banking services in just the same way you have to have electricity.

And what the tapes show is that Anglo put the frighteners on them - promised the collapse of the whole Irish banking system if they weren't given what they needed.

The politicians went with protecting the existing banking companies because they thought they could do it, and politicians always go for the least disruptive option if they think they can do it. The Icelanders would have done it too if they thought they could get away with it - the only difference is they knew they couldn't.

It's not a mystery, and it's going to happen every single time there's a bank crash, no matter how squeaky clean the politicians are.

    Scofflaw

    God.

I would love to see so many people hung by their balls out to dry for the crap that they threw upon our back. Like what has been mentioned though, fcuk all is ever going to come of this. There are just people right now in the top of our country in the establishment, clinging on milking whatever they can, while they can.
Our government of today and in the past have been up to their necks in corruption. Nothing is ever going to happen. They'll be too busy lying and protecting themselves to even care.

If we never want to see this sh1t happen again we need huge changes. That will only start from our glorious politicians but movement won't happen from them or they'll see their jobs lost and their pockets becoming very holy.

-We need a new system of politics - ie get rid of pothole voting for national issues.
-We need new people in politics. I'm sure some unemployed would love to come forward.
-We need a new constitution. Michael D talked about this before becoming elected.

    We need a revolution.

Hard to disprove his claims now.

Cant just decide you need new people in politics, what you need a paradigm shift in voting patterns which looks unlikely to me.

If you held an election today, with this still raw. What would the outcome be?

I think incredibly enough FF would come out of it all pretty well, SF would make gains too but not enough to govern. I reckon the current crop of independents like Wallace, Daly, Boyd Barrett and co have been so ineffective that they would push seats back towards FF as the protest vote dwindles. SF might pick up a few of those.

What would really change? Nothing much.ne

Do you honestly believe they didn't? If you owe me 100 million, and I call you in and tell you what you are going to do, or else, would you do it or risk instant ruin? "Sean old fruit, this is the way it's going to be....." You are dealing with very cynical, ruthless people here. And they will not be touched, not a hope, not an inkling, not a chance in hell.

Anyone see "Fingers" having a good old chuckle with Smurfit on the cover of the Phoenix? These guys will never know a days poverty or real worry in their lives. They have suckers to do that crap for them.

You don't think that Sean Quinn thought taking out a massive loan to buy shares in Anglo was a good way to make a quick buck?

The lads in Anglo were total cowboys, but that doesn't change the fact that Sean Quinn gambled his company's money and lost. He also acted in the exact same way as the rest of them, transferring his assets to family members and selling off assets in shady deals in Russia and the Ukraine.
