    What is the maximum sentence for manslaughter does anyone know?

    About 10 years less than what it should be.

    Exactly. You can get sentenced to life even for manslaughter in Ireland.
    [off the top of my head I know the fella who killed melissa mahon got life for manslaughter], so I don't know why they got such little jail time.

    If I remember correctly, some of those guys went to speak to their principal and got a letter from him, BEFORE going to the guards. I think it was in that documentary about it.

    Its a disgrace, there was no history between the parties either so for a stranger to end up dead and his attackers to only get charged with manslaughter and receive useless sentences, its crazy.

    Yet look at the guy in another part of Clare today and contrast the difference in the murder charge and sentence..

    I didn't know of the Dinan's before this case as it happens

    As for it being murder they were not found to have the "mens rea" for murder "guilty intent" only manslaughter
    A) Victim is struck by a punch, falls to the pavement striking his head = Manslaughter, his death was unintentional.

    B) Victim lies unconscious and helpless on the ground, where he is then viciously attacked again. = Murder, the attacker demonstrated clear and obvious willful intent to cause further serious harm to his defencless victim.

    Unfortunately, quite often the law and the judiciary dont' do cop on! These scum will serve half their sentence at best. In fact, I often think the bigger your criminal record is, the more rights you seem to have in this country.

    Different kettle of fish, the accused reloaded the shotgun that shows intent to kill
    If he only wanted to injure the first 2 shots were enough

    In that case the prosecution should just argue that it makes no sense that Chewbacca lives on Endor. He's a Wookie from Kashyyyk yet he lives on Endor surrounded by 2 foot tall Ewoks. That does not make sense. Therefore they should get life in prison.

    The law is a big hairy sweaty ass on this one.

    Intending to seriously hurt someone and then they end up dead should be treated as murder.

    Lets say I only intend to break a guys neck causing him to be paralysed. But he ends up dead. By law I shouldnt get done for murder because all I intended to do was leave the chap in a wheelchair. Punching and kicking an unconscious person in the head is a sure way to cause severe brain damage or death.

    Fvck the law on this bring in vigilante groups and take out the vermin.

    Second degree murder.... except it doesn't exist here. Think the sentencing is generally 10-25 years.
    This case is technically manslaughter but I think manslaughter incorporates far too much.

    The intent requirement for murder is an intent to kill or an intent to cause serious injury, I don't see why this attack shouldn't be seen as murder.

    Im angry, but the law and its parameters are the wat they are for a reason, ironically to protect the innocent. As i said its the length of time they get in jail that is ****ty, but that takes law reform. Judge afaik cant do it

    Absolute disgrace, but sadly it's the norm in this country so I don't know why we are really surprised. Making matters worse one of these animals was out on bail for another offence and the other guy was on parole ( I'm open to correction on this). They'll probably serve 2-3 years and be free to beat some other innocent guy to death.

    Several years back Harry shared a prison cell with another young fool whos case made headlines in 2000, John Tangney of Killarney who was jailed for knocking down and killing a man on a scooter...

    It's a fúcking joke, the economy is fúcked, the judicial system is fúcked, the banks are fúcked, the weather is shít, the social aspect of the country is fúcked, almost everything in this country is fúcked, even the educational system.


    If I didn't have family and friends here, I would be gone tomorrow.

    There was insufficient evidence for a manslaughter conviction whether we like it or not that is the fact of the matter

    Spouting hyperbole about it is not going to change the facts

    As for the "scumbag lawyers" again whether we like it or not every accused is entitled to a reasonable defence

    I would like to think that I would count among those that wish for a decent society
    I'm the daughter of a cop and the wife of a cop so I listen to moans & complaints about the legal system every day of the week

    BUT at the moment the system we have is the one that we have to live with

    If it makes anyone feel any better there is supposed to be a judicial review of our sentencing for murder/manslaughter to bring us in line with the US model which allows for degrees of murder

    Says here the Judge involved was Carroll Moran - In my opinion lots of unbelievable Newspaper articles seem to feature his name towards the end of the text......

    This is horrific. Does anyone know much about the case? Given one guy on temporary release and the other on bail why was the judge so leniant?

    I don't want a liberal bashing answer, was it made out to be an accident or something?
