Hi everyone looking for some guidance on post commencement dispositions. Does any one have a sample answer to this question (other than griffith)

or can any explain the impact of the MB case - can i assume a bank is only liable if they have actual notice. Is gray's inn now obsolete?

My manual goes around the houses on uk position irish position - and like three lines on new position since 2014 act

willing to swap for anything at this stage maybe even my soul haha

Hey, if anyone doing EU this sitting or any EU enthusiasts in general wouldn't mind providing a quick steer it would be much appreciated.

The following is what I am covering and my question basically is; do I have enough done to leave out Free Movement of workers/EU Citizenship? I understand its a personal preference kinda question but if anyone feels that its a no go then I would be eternally grateful to hear.

    Covered:
    Institutions (general essay)
    Sources of EU Law
    Direct Effect/State Liability
    Judicial Review
    Free movement of Goods
    Competition Law

    Thanks in advance!
not an expert but could get caught here - institutions and sources - could be one question - power of an institution.

adding another subject will depend on your time pressure though

if you had a sample answer for essay on equal pay - and equality provisions - could like off quite quick. lot of work if you don't have an essay
services and establish is long but honestly so simple -

i think citizenship could be hard to get your head around this stage

workers is short if you can good notes you could learn off so fast - but it doesn't always come up on its own - if you skip
citzenship you will not be able to answer ... realistic if you do workers you should do citzenship

I would probably add services and an equality essay

    Hi all,

Can anyone provide some clarity on tonight’s email.

The online proctoring and record and review method - when they review our environment, are they asking us to move our webcam around the room and desk or are they just reviewing what is behind you?

    And

At the end of their attachment they state that :

If you do not wish to participate in an exam subject to online proctoring, you will have to wait until Covid-19 related measures are relaxed, and we can once again offer exams and resits on site. This may represent a delay on your studies. That is why we are trying to solve this issue as best we can through alternative forms of examination and online proctoring.

I presume by this that there will be additional sittings arranged in the coming months outside of the usual March / October sittings ?

I am at the stage where I am not entirely comfortable sitting all of my exams and may have to skip one or two.

Since it says we can login from anytime after 8.15am in the morning and the exam doesn't start til 10 does that mean from when we login to the start of the exam itself we cant review notes? I havent seen any clarity on this.

Is there any point in doing election law for constitutional?
Doesn't appear too much on my grid (but my grid isn't fully accurate)

Hi all. I just read though tonight’s email. And it mentions looking away from the screen for a prolonged period. My typing wouldn’t be the best and I most definitely can’t type without looking at the keyboard. Is anybody else in this position or know is that ok?

I'm the exact same. I have to look at the keyboard to type...

Sorry what happens if they think you’ve cheated like how do you prove you haven’t after the fact? Will they tell us during the exam there’s been suspicious activity detected????

Does anyone else look away to the side or up high (but into space really) to think?

That's completely fine, most people will be like that. They're not looking for you to stare down the webcam for 3 and a half hours and not going to question anyone who looks away when they think... Just do your exam as you normally would!

It's only if the system gives you an exceptionally high score, they will review the tape and if they see you're reading your "legislation" in between every line you type for a whole answer or two.... with barely a line of legislation in your answers... Or see you typing out a full answer while looking up at the wall the entire time you were typing... Then they'll ask questions.

Do you reckon this will prolong the giving of results if they need to make further enquires for some people? Seeing as the March sittings are around the corner

What are people thinking for company? The notes aren’t sticking for me at the minute. I’m half tempted to drop Restriction and Receivership?

    I’ve covered

    - SLP
    -Directors Duties
    -Reckless and fraudulent trading
    -S.212 Oppression
-The rule in Foss and Harbottle
    -S.819 Restrictions
    -Corporate Borrowing
    -Winding Up
    -Share transfer
    -Receivership
    - Corporate Authority
    - 5 main changes brought in by the 2014 act

Would I be leaving myself short?

This is basically what I've got too! And also very worried that none of it's sticking - find Company unbelievably dry so very hard to retain the info.

I know the Company March 2020 paper isn't in circulation but could anyone even from memory let me know what came up?

Hey, Can anyone tell me how the nuisance question came up in the August Tort sitting?

Also, does it ever come up as public nuisance or is it always private or Rylands v Fletcher?

    Thanks!

Are there any non fatal offences which people feel could be left out?

  • Registered Users, Registered Users 2 Posts: 38 orlaghs

Seeing some worry over the whole online/typed exam stuff. I have experience watching candidates doing exams as an online exam invigilator. It's very easy to notice that someone is just looking away from the screen in concentration or at the keyboard, compared to someone who is looking at their wall and reading notes on it. You'd be surprised how easy it is to spot someone cheating!
I'd advise to do the exam with honesty and to try to treat it as a traditionally invigilated exam, as I'm sure the proctoring software is more than capable of detecting suspicious behaviour (like reading through notes on a wall/going on your phone etc)

Are there any non fatal offences which people feel could be left out?

possibly demands for non payment of a debt (S.11), endangerment maybe (S.13/14)?

I like how they are all in sequence, i have just learned them all off as to what section of the act they pertain to, some of them you will not have to go into much detail, such as threats to kill, its section 5, case would be DPP v Wayne Dundon that is about as much as you would need in a problem question where the accused has threatened to kill, more likely the main points will be assault or sexual assault or something, so you are talking about easy marks

does anyone have condensed notes on medical negligence or atleast tell me the main things to know or would it be worth leaving out?

    Oh really? Ok.
And do the same principle apply to public as private i.e Locus standi, conduct for which the defendant is responsible, damage/interference etc?

This is literally all my notes on pblic nuisance, I can't see it coming up as a full PQ but would be handy to know for part of an essay or part of PQ

    Public Nuisance

Civil actions for public nuisance are taken by the Attorney General.

A private action for a public nuisance can be taken where the Plaintiff suffered particular or special damage beyond that suffered by other members of the public.

Boyd V Great Northern Railway :
The Plaintiff must have suffered “some appreciable damage peculiar to himself beyond that suffered by other members of the public”

    Smith v Wilson :
“Everyone who individually sustains particular injury can apply for damages or an injunction.”
