    If they stop you just to ask where you’re going then they started it. Absolutely no legal reason for them to be stopping someone at county boundaries, pure intimidation.

    They're allowed to stop anyone, anywhere. It's part of their job. Oh, and it was at the border with the north.

    It seems one Dublin restaurant group has had enough anyway
    One of Dublin’s biggest restaurant groups has threatened the Government with legal action if it extends coronavirus restrictions on pubs and restaurants in the capital beyond October 10th.

    Lawyers for Press Up group, which employs 1,800 people across five hotels, 12 bars, 27 restaurants and two cinemas, have written to Government, saying Minister for Health Stephen Donnelly has published “no empirical, objective and verifiable evidence” to support the closures.

    The group has said that if the restrictions are extended, it “will be left with no alternative; but to issue proceedings in respect of the laws bearing on operation of their premises as a last resort”.

    About time. Let's see now how well the Government's/NPHET's "evidence" holds up.

    What kind of bubble are you living in that you think your standards will have equal importance for someone living week to week in a precarious industry, as opposed to those unaffected financially and even financially better off? No worries about feeding, clothing and educating the kids and keeping a roof over their heads? Can afford all the standards you want.

    Miniscule risk for majority of society, but maximum suffering for those that can least afford it.

    Everyone is living week to week, in terms of just existing. Its putting food on the table, paying bills and getting on as best we can.

    The priority for EVERYONE needs to be not contracting and not spreading covid. Being cautious, careful and health minded 100% of the time... if you are going back to a fûcking bedsit or a six bedroom mansion, you still have a duty of care to do the right thing.

    Certainly some folks are doing it in more comfort but them is the breaks.

    Checkpoints have a purpose. They can’t just stop someone or pull someone over without a reason. I know exactly what I’m talking about.

    I’m guessing it’ll be the same weasel words they gave Ryanair, we never said you had to close, it was just a guideline.

    Licences have been renewed, it would be interesting to see them do that with their main threat taken away......

    Related to the Press Up litigation is the FBD test case due to be heard soon, where pubs are suing FBD for not paying out for business interruption.

    The UK courts found against the insurance companies in similar test cases recently.

    You can bet that, should the court rule in favour of FBD, there will be murder from the publicans directed at the insurance companies and politicians.

    The Supreme Court adjudged on something similar in 2011 using the proportionality test derived from existing case law. Without going into nuances of the case/judgement itself (because I can’t for the life of me remember the details) they ruled that government actions in relation to a national emergancy et al must be proportionate!

    Surely any legal challenge would use this test! This isn’t the place to debate if the actions are or are not proportionate, but there is atleast precedent in the Irish legal system!
