That should be the case, but the likes of Smyths were insisting that hardware issues were dealt with directly by the manufacturer, though I think they are on shaky ground with that one.
Nintendo have been pretty good with returns and repairs/replacements as far as I know, though people have reported losing data as a result.

Your contract is with Smyth's though so they can't legally tell you to deal with Nintendo.

Maybe not, but they have been.
During the last 12+ months, when people have returned hardware to Smyths due to issues around the controllers, for example, people have been sent packing instead of being given a replacement.
And, to be honest, the response from Nintendo themselves has been excellent and swift.
I know most people, myself included, would be miffed at having to spend a week or more waiting for my Joycon to return all better, but having dealt with shops over the decades, they can take far longer.
But, you are right, legally they should be doing the leg work in returning and replacing.

So I cracked out the Switch today to finish off Golf Story. As it boots up, my fingers catch off something along the back of the casing... What was once a small bump opposite the kickstand is now a full blown crack!

The bump developed after only a month of light use and it’s well documented online. I chose to ignore it. But now I’ve a 6 month old console (that only sees mild use), with a crack in its housing. Thankfully it’s still under warranty.

Anyone know what the tech department at Nintendo are like to deal with?

    there's your problem :)

Why don't you just return it to the shop you bought it?

I actually worked in Game back when they were in existence. We would’ve always taken the broken console off the customer if it was within a year old. Smyths said they’d only do this for the first 28 days after purchase. I thought it was poor form, but there’s not much else I can do. As far as I know they should be dealing with it and not pushing me off to Nintendo.

I can live with waiting a week; I assumed it’d be closer to a month. I’m sure Smyths have done their research, but I wonder if legally they’re doing the right thing? It’d be no skin off their nose to send the console back, and it’d keep customers happy.

Is it EU vs local rules, if they can get away with the EU terms and conditions they might be finding that their own time and money isn't being spent, despite Irish consumer rights making the responsibility that of the vendor, not the manufacturer, to handle customers and their returns.

Yes, but a distressed parent and a well schooled staff member can make such distinctions difficult and the parent will just take the path of least resistance.

It could be something Ninty have agreed with them, we sell products from a company who have asked us to refer customers straight to them if there's an issue. We legally have to take it back if you insist but its easier for all 3 parties to go straight to the manufacturer.

It's much easier for the customer to exchange a faulty item in the store they bought it in.

€46 for Wolfenstein on the SA eshop - thats a 13 quid saving over the cheapest I can find the physical copy. Might be too good to turn down.

edit: actually its 55 on Amazon. Still 9 euro cheaper for the digital.

Nah these guys pick it up from the gaff for you, obviously Nintendo don't but it some cases it'd be easier. Tbh i'd find it easier to post something back than find proof of purchase and then time to drop into and argue with Smyths.

Been waiting all year for Wolfenstein to come out. Switch has been gathering dust, which is something I really didnt think would happen after the insane quality of 2017 releases.

I think Wolfenstein would be better physical - I think it will hold some trade in value for a good while and it's the kind of game you might play through once or twice, max.

I'd agree with that. Clear it and then trade it in to GameStop on one of their New Release for €10 offers.

Anyone know the price in smyths? can't find it on their site.

Sorry it's €20. I could have sworn it was €10 though  I definitely only gave €10 when I pre-ordered RDR2 while trading in Fire Emblem, and paid €0.50 for Bayonetta when I traded in Xenoblade and Binding of Iaasc.

I love physical carts, it just fits in with the rest of my games collection!
I have waaay too many carts and cds/dvds/blurays of every description and while I have tons of digital downloads across the systems that support them, there is something very pleasing about a tangible cart.
Pity then that no one except Nicalis seem to bother making the most of the physical format, with manuals, sticker sheets, alternate covers and even a squishy toy, in the case of The End is Nigh.
So, I will have to give this one careful thought, I'm not short of things to play right now, so I might just wait and see if Wolfenstein II gets a price drop, pick it up then, or pick it up for a song on another format, get another Nicalis game instead!

There is quite a few making the most of the physical format with companies like NISA, Limited Run Games, Super Rare Games, Signature Edition Games and Play Asia Exclusives putting out some interesting games some are pricey and the games may not to be everyone's taste but there is a growing amount of companies making the most of the physical format.

I thinking I might get Wolfenstein II digitally for cheap, there's plenty of time in the future to pick up a physical copy for posterity in the collection!

Doom is still basically launch price 7 months later...

I bought Doom for 40 euros on Amazon when they had a deal back in February, and sold it to someone for 35 euros a few weeks later after completing it.

I’ll wait a bit hoping I can do something similar with Wolfenstein.

I'm more thinking of the long game, I still pick up titles for the Famicom, Atari XE and PlayStation, to name but three.
I'll be buying Switch games for the next 20 years!

This. Completely agree here. Saves any hassle or waiting around for a replacement. I think Smyths are doing a disservice to the customer here.

I contacted Nintendo and they’re sending out a box with a pre-paid stamp. Asked if I could return it to Smyths and they said they needed an engineer to check the source of the damage to the console. Half of me is worried that they’ll tell me to jog on. We shall see.

There was a post on Reddit last week about a guy who's switch cracked down by the screws on the bottom. He sent it to Nintendo 3 times and they kept sending it back saying there was no fault.

He ended up complaining to Komplet and they gave him a new one.

I’ll keep that in mind. My thoughts are that it’s a faulty battery which is starting to expand, and I don’t think that could be pinned on me.

Can just see it now, sitting on a hammock in the shade with the switch in hand.

Just think of all the sweat you are saving and doing your bit for the impending water shortage by not needing to rehydrate, let alone the skin cancer protection offered to gamers by staying out of the sun :D:D
