    Offer and acceptance
    Consideration (and briefly estoppel)
    Formal requirements
Terms, exemption clauses and consumer protection
    Mistake and missrepresentation
    Undue influence and Duress
    void and illegal contracts
    Discharge
    Remedies

also gonna have capacity and privity in my back pocket if I have time to cover them.

I got stung by not covering enough in contract before, so perhaps I'm being overly cautious, if you were going to leave anything from that list out capacity, privity, formal requirements and illegal/void contracts are probably the safest ones to ignore/skim

I did this question and mentioned a number of things.

Nervous Shock of Fred - that it needed to be foreseeable and proven by a medical practitioner, and proven that it was caused by the event.

Brought in Negligence to show it was foreseeable.

Mentioned Trespass to the person and said Sally verbally assaulted Fred unknowingly, causing him emotional distress to the point where he got physically sick (Kelly Principle requirement to show a real and describable illness).

Brought in Vicarious Liability for Harrison here as he should have seen Fred was likely to believe the situation, and Sally was working in the scope of her employment. Finished off with saying that Harrison breached his duty of care towards the individuals on his set but barely touched on this.

Not sure how well I did in the particular question, but I got a high pass in Tort overall and at the time, felt this was one of my better questions.

Can I ask which topics came up in the online tort paper please?

Yeah, but the website says if you didn't get it the two reasons are that you're not registered or you email address is wrong. Which is not the case for for me and the previous poster, and possibly many others

Oh sorry I didn't see that on the website, my bad!
I am registered and my email address is correct too so I'm in the same boat as you guys then

What are people covering for Equity ?

I have the following covered but feel like its not enough:

    - Trustees 'Duties'
    - Charitable Trusts & Cy-Pres
    - Quia timet & Mandatory Interlocutory injunctions (Mareva omitted - appeared last March)
    - Estoppel
    - Undue Influence
    - Specific Performance
    - Rectification
    - Secret Trusts
    - Strong v Bird
    - DMC

I am considering adding in Joint accounts & presumption of advancement but not sure. I feel like the above could be enough to hopefully pull five q's from the 8 on the day.

So if you are not using boards AND you did not receive a direct email then you are none the wiser about the exam being in typed format with approx 2 weeks to go. This really is an absolute disgrace.

From memory and a really quick glance I believe the following was covered:

    - Employers Liability
    - Damages essay
    - Occupiers Liability/ Causation/ Battery
    - Trespass/ Negligence
    - Nuisance (Noise and smell)/ Occupiers Liability/ DOC
    - Vicarious Liability essay
    - Nervous Shock/ Trespass to the Person
    - Difference between Contributory Negligence and Assumption of Risk essay

I think!! I've been rusty and obviously didn't do some of the above- if you want me to send you the paper, just DM me your email.

I will note I fell off my chair when I saw no defamation- I thought it was going to be a guarantee going forward...

So they said more details were to be circulated today - has anybody heard anything yet? Wonder why updates, whenever they're actually provided, are always sent out so late.

Yeah, sounds good to me. I posted the other day about equity and PoA & Joint A/Cs and Constructive Trusts were topics that skipped my mind. I would do PoA and Joint A/Cs if you’re considering an extra topic. Secrets Trusts is a fascinating topic alright and it’s something I was on for Uni but not in the FE1s. I’m not saying it doesn’t come up but IMO there’s more value in spending the time elsewhere. You’ve probably already done your notes and learning it off now though. Strong v Bird is something I’d be on too but IIRC it’s asked as a 10 marker 2 outta 3 style question so IMO if you’re going to commit to it then look at the past papers and see what topics usually come up with it - The only one I can remember off the top of my head is satisfaction but there will be others. On Marevas, it’s something that was highly likely for March considering the previous two sittings and the popularity of it. It did come up but that’s not to say it won’t come up for you next month. Out of the three injunction topics, it has the highest probable value although that is reduced now by Marchs appearance. Just something to consider if you don’t want an extra topic but to maximise the chances of an existing one appearing. Best of luck for the exam pal!

Yeah I think your right about Secret Trusts, it was there on the last paper so the chances of it reappearing again are very remote. Joint accounts was there on the last paper also, so probably safer to go with POA this time around and hope for the best.

Point taken on Mareva, it has come up two papers in a row and could occur again next month, I'll go with Mareva and POA as an additional.

    Thanks Jay, appreciate it!

I still couldn't get through to the number. They said they would provide all details today and they still haven't done that. They need to let us know what's going on. Wonder is it time for 1850 715 815? :p

Don't suppose anyone is very good at guessing and can predict what will be on the Constitution paper??? Or what topics you're going to chance leaving out? In theory, how many cases should we be using for essay questions (working on the assumption that I use the right cases for the right topics in the first place!!).

I welcome advice or feedback from anyone who has passed it in the past :)

This would have been a far less stressful way to have dealt with this entire situation:

    - Take a shot every time the Law Society hangs up on you
    - Take a shot every time the Law Society transfers your call to at least two different people
    - Take a gulp every time the Law Society gives you information but it's incredibly vague and leaves you with even more questions
    - Take a shot every time the Law Society's FE1 helpline rings out
    - Down your drink for every time you've found out something from Boards before the Law Society had the decency to email or update website but instead update one person over phone
    - Take a shot every time each of your exams is postponed
    - Just take a massive drink every time you regret starting these bloody exams
    - Also one which is particularly relevant for today, cheers and down your drink when the Law Society give a date to provide more information but unsurprisingly do not

This is the exact same for me. My email is correct and application approved for weeks now - no email. They are unreal trying to act as if the issue is on our end! It seems the majority of people didn't get it.

They are saying anyone who didn't get it needs to email novemberfe1@lawsociety.ie by 11am on Monday - how are people who don't check boards going to know any of this!?

Same situation here - My email address and application have been approved and still didn't receive the same email update.

Hey trying to narrow down my topics for constitutional. Would these be ok or am i missing anything substantial ??

    Personal Rights
    Equality
    Religion
    Family & Education
    Interpretation
    Locus Standi
    Proportionality
    SOP
    Oireachtas
    President & AG
    Property
    Inviolability of Dwelling
    Freedom Expression/Association/Assembly
    Amending Constitution
    Due Course of Law

  • Registered Users, Registered Users 2 Posts: 23 Samuma

OMG is there anything you're leaving out??

I'm going to guess here and hope the stars align:

An essay on either the President or AG
    Constitutional interpretation
Trial in due course of the law
Problem question on freedom of assembly
    The case notes: Crotty/M v MJE/Kerins
    Referendum problem question
and 2 SOP questions: Judicial independence, non delegation doctrine

And all of the above better come up cause that's what i've decided to limit myself to! :D

    REPOST

Some Constitutional analysis for anyone interested:

SOP - Every sitting since March 2012. Last paper was very SOP heavy.
    Art 40.3 - Only missed 2 appearances since 2011 (March & October 2016)
Trial in Due Course - Very popular question, appeared 5 times in last 7 sittings but not in March.
FO Expreesion - Another very popular topic that did not appear last round.
Private Property - Appeared in the last 6 sittings.
Equality - Every second sitting since Oct 2018, no appearance in last paper, may be due a run.
Family/Education - No appearance in either 2019 paper but featured in March.
Religion - Featured twice in 2019 but did not appear in March.
Referanda/Reform - Featured twice in 2019 but not in March, has never gone more than one paper without appearance since 2012.

Cons. Interpretation - hasn't been up in last 3 sittings, never gone more than 3 without an appearance.
Sovereignty - hasn't been up in last 3 sittings, never gone more than 3 without an appearance.
President/AG - hasn't appeared in last 4 sittings, may be due a run.

This is just what I have noted from my own analysis of past papers, I am open to correction! Hopefully might help for anyone taking Cons. in October

Injunctions (Mareva came up in March but I'm leaving it in with all the others).
Express Trusts (3 certainties, DMC and Strong v Bird - usually in 2 of 3)
    Charitable Trusts and Cy Pres
    Resulting Trusts (PoA, Joint A/C)
    Recission (including undue influence)
    Estoppel
    Trustees
    Tracing
    Specific Performance

I hope I'll get 5Qs out of that and that i will remember it for the exam.

    RE WILLIAMS TULLAMORE

I can't figure out whether the judge granted §212 (ex 205) or not? He seems to have said it was oppression but didn't.....arghhh idk! Any ideas? Would it be bad to just exclude it from my notes?
