Zamano still "at it"

    I've just been Zamanoed!

I must have inadvertently hit an ad button (I suspect it was while playing Scrabble on my Android phone) and yesterday I got a message which flashed up that I had received a "reverse charge text".

I then noticed that 12.50 euro had been mysteriously deducted from my (prepay) account. I can be so specific because I had just topped up and knew that I had not deliberately made any chargeable calls.

A web chat with Vodafone alerted me that the premium call charge came from number 57030 aka Zamano.

The three texts I received from this number said

"AppMob Portal is a non subscrioption service it gives you 7 days access. Helpline 0766801002
(I won't complete the full address just in case somebody else clicks it with disastrous results. )

    The second message says
"Welcome to the AppMob Portal. You have 7 days access. Click here (addrss given) for your download. Helpline 0766801002"

"Download your tone and more here (address and number given)"

I then got a repeat of message 2.

I sent a stop message to the number and got a reply from Free Msg saying "You are not subscribed to any services"

I now have to faff around seeking a refund for something I didn't want.

I won't risk a banning saying what I really want to say about this company but guess what I'm thinking.:mad::mad::mad::mad::mad::mad::mad:

Email them for a refund at csemails@zamano.net they payout pretty much straight away. Tell them you want a copy of the data log the banner ad between yourself and them. Also ask them how they got your number was it via your service provider.

All those "services" where you can be robbed subscribed with one accidental click should be banned and replaced with a system where you must enter your number then you get a totally free subscription text which must explain fully that it will cost you lots of money and you must confirm and reply to subscribe.

But too many people with big business and political connections are making too much to stop these scams!

There was a proposal to put into consumer legislation a provision that people needed to actively ask for these services instead of being duped into getting billed by clicking on links. If enacted, the measures would have pretty rapidly put these people out of business. They threatened to go to law and the proposals were shelved.

Even with all the conspiracy theories floating around these days, the notion that these people get away with their business practices because they have 'connections' is a bit far-fetched. No political party would want to be associated with what is a business who's modus oprandi is to take money off people under false or grossly misleading pretences.

Posted this over in eir's forum too but maybe some more experience/expertise here
    Hi,

more a query for other eir users and the team on here.

recently got charged 30 euro extra on my phone bill. With deeper digging, turns out its Zamano (57030).
Now eir advised me to go to comreg, comreg then sent me to zamano. Zamano claim I subscribed for video content (video nudies more or less). The times give were 7.10 am on weekday mornings I'vè been on my way to work. I have never signed up to this. No history at all. Surely this is a data protection issue for phone companies? How did they get my phone number while I'm commuting? Ads on an app?

now zamano have hung up on me when I mentioned how they have been previously taken to court for illegally charging customers, and have been featured on consumer shows etc. They gave me no details of where they got my number, how, or what they claim I subscribed to. Where can I go now?

Wow, this company is still scamming people?

I had a similar issue, I'm not bothered reading back through the thread and don't even remember the outcome, but thankfully nothing like it has happened to me again.

Yip, still at it. Incredibly rude customer service to boot. According to the Irish Examiner thereis actually a case in progress against these cowboys for illegally taking peoples credit. Seems to be a blurry line between consent and informed consent and these operate in that place.

I actually care more now about how they acquired my number rather than the refund. I want exact details.

From previous threads on here, and from investigations by consumer experts, they seem happy enough to just refund people who challenge them, and shut down any questions or discussion about their murky operation.

whats spooked me more is that at least Vodafone and 3 (possibly other providers) are partners of Zamano's. No wonder phone companies paas the buck, they profit from this shady stuff.

A friend of my Dad's got caught by these guys for a few months. He rang vodafone about it and they gave him an address to write to. I wrotr the letter for him and advised them that he did not sign up to anything, that he did not enter an contract with them.and they did not gave his consent to bill hom for services he did not request or recieve. He got a cheque within 5 days. I think he was being charged €25 euros a month.

Yeah Meteor is Ive been hot before with them

  • Registered Users, Registered Users 2 Posts: 25,695 ✭✭✭✭coylemj

Some minister threatened to introduce legislation a few years ago which would have the effect of putting these people out of business. It was going to make it much harder to people to be 'accidently' signed up for these services because it would require a double confirmation. I believe the 'added value' companies threatened to go to the courts and the plan was shelved.

  • Registered Users, Registered Users 2 Posts: 71,964 ✭✭✭✭L1011

They have somehow managed to hoodwink Comreg and the DPC in to thinking a single click is "informed consent".

Your network provides them with your details from the website click - again, cleared by Comreg as OK despite clearly being a data leak, and the DPC defer to Comregs decision. Despite the DPC - and, eventually, Comreg - admitting this was happening Meteor insisted that they didn't do it! They were willing to let me leave with no notice period when I gave that behaviour as the reason, surprisingly.

Sooner the business model dies the the better.

We've had numerous Zamano threads here over the years. I've merged your thread with one if the most recent ones

2 days later, various emails, more phine calls - 1 line response - "we are processing your refund". Ends.

no details of how they acquired my number, no details as to how I allegedly signed up. Very shady.

Onto the next person for Zamano I guess.

I got stung by this crowd about a year ago as well. I remember getting on to 3 and asking what could be done about it and as said already in this thread it was a case of writing an email to zamano asking for a refund. The whole thing stinks especially given the fact that 3 and zamano are official billing partners.

Agree I exchanged quite a few emails with 3 over it and they claimed there was nothing they could do. How about not partnering up with or sharing data with companies that have such a bad reputation or so many complaints against them. Left 3 because of it.

got charged 12 cent by them for receiving a text from Zamano. Got onto them today and they are issuing me a cheque... for 12 cent.

Bit petty to get a refund for that amount but screw them!

  • Registered Users, Registered Users 2 Posts: 73,537 ✭✭✭✭colm_mcm

My wife got caught with this a few weeks back.
3 mobile said they'd never heard of them and that they'd launch an investigation etc etc, despite them being a billing partner.

Rang zamano, got through to the Philippines and they immediately offered a refund, was expecting nothing to come, but it did today.

Still wrong that a browser pop up can access your phone account.

Sorry for necroposting- please delete this if it's not okay. I just noticed the posts span between 2014 and 2016 so thought it might be okay as this is an on-going issue for many.

Got caught with one of these from Bounce Mobi games- just like some of the other posters here, my phone was in my pocket, it went on a youtube app, I pulled my phone out and saw a pop-up ad and I just clicked 'back' and closed youtube. Thought no more of it until all my credit disappeared and I got all these reverse charge texts. Have contacted them and they have refused a refund, saying that since I 'interacted with' one of their ads they can charge me all they like. Any suggestions as to what to do or how to get my money back? Have contacted comreg and vodafone.

You have to email them and be very clear and firm that you did not sign up for any of their services, be clear that you will not stop until they issue your refund. In my experience they will fold pretty quickly - presumably because they don't want the publicity if someone takes them to court.

Zamano still at it! Got 8 txt messages from them last Sunday morning which took all my credit that I had put in on Friday! Got onto Three and they told me what had happened. They told me to top up again and txt stop to 57030 and that would stop them sending me the messages. They also but a block on my account to stop it happening again. Problem sorted but they only done the bare minimum to help.
I wasn't happy so I emailed comreg and Zamano on Monday afternoon. Got my refund through paypal from zamano this morning. I'm not going to leave it there though. I'm like a dog with a bone when it comes to this stuff. Registered address is in Kilkenny and I'll drive there if I have to.

Whatever about toothless Comreg, this should be taken all the way under the GDPR. How are peoples mobile numbers (personal data) being captured and processed as billing information without their explicit consent.

I’d lodge a formal complaint with the Data Protection Commissioner. This stuff needs proper investigation and the law has changed since GDPR came into force.

This is the route I am going down. I have asked them for evidence that I subscribed to their "premium" services. They have sent me back a form to
fill out because of GDPR regulations.

That's the big question I had at the time. Who gave them my number. The service provider said it wasn't them, I didn't give it to them. As far as I can tell my son clicked on something playing a game, did the game send the number. Even contacted the makers of the game they said no. My service provider said they didn't Zamano said they got it from the service provider. Would love to know how they got the number if anyone knows.

I’d also question what protections the mobile networks are providing. Why is your mobile number being transmitted to an advert on the web in the first place?

Considering how much effort goes into ensuring cookies and data gathering on websites is absolutely clear in the GDPR world, I don’t really see how it’s reasonable that a mobile network would pass your mobile phone number, without your explicit consent and understanding, to a 3rd party.

The whole thing shouldn’t be possible.

Comreg give some wishy washy nonsense of an excuse but they allow it cause the PRS operators pay them fees to be allowed exist. DPC accepted Comregs claim but that was pre GDPR

I lodged a complaint with ComReg in early 2017. They told me I couldn't proceed until I had pursued the matter with Zamano.

So I sent Zamano the following:
Yesterday, when reviewing my meteor mobile phone bills for February and March of this year (ph: xxx xxxxxxx), I became aware that I had been charged for five premium rate text messages from your company in February, and six in March. These charges amounted to €22.33 in total.

I did not request to be registered for these services, either intentionally, or accidentally.

I did not receive any notification that I was subscribed to these services, either by text or any other means.

I did not receive any text message, from your company or any other similar premium rate number.

Having discovered these charges, I contacted your company yesterday. I spoke to an agent who agreed to refund the money to me in total. I expect to receive a cheque without delay.

I do not consider that this adequately addresses the fact that you effectively steal money from people and only agree to return it when caught. I expect that you are getting away in instances where the victims, children and the elderly in many cases, are unaware that you have taken their money.

I have lodged a complaint with Comreg. I hope that they prosecute you to the full extent of the law. They have told me that they cannot proceed until I have first lodged a complaint with you, so that is the purpose of this email.

Zamano responded with a few screenshots from dodgy banner ads, and the following gibberish:
You interacted with AppMob Once Off NON SUBSCRIPTION Service.
Log file and screenshot of promotion attached.

This service is promoted on mobile Internet and in apps. You see a banner click on it and be taken to the promotion page attached

    Date: 18/01/2017
The promotion interacted with is: Babe Vids V15
    User Agent: xxx
    IP Address: xxx

    Date: 20/02/2017
The promotion interacted with is: Babe Vids V13
    User Agent: xxx

    IP Address: xxx

These pages have all the relevant terms and pricing indicated before the button that will initiate the charge. Once the button is pressed we obtain your number as indicated in the terms at the top of the page and process the billing.

    Terms on top of the page state that;
“By continuing you consent that zamano can request your Mobile Number from your mobile operator to bill you for this service. Your details will only be used by zamano to bill for this service and not be shared with third parties”
These pages and services also comply with all relevant regulations. We now consider the matter closed. If you are still not happy with the response you can address your complaint to ComReg.

    Regards
    Customer Service Zamano

This might have scared a teenage boy into submission, and many people don't have the energy to make proper complaints, but I don't visit websites with cr@p like that on them, and wouldn't be stupid enough to click on them if I did.

I also had a lot of time on my hands in early 2017.

So I then sent Comreg the following:
In accordance with xxxx’s email below I submitted the attached complaint to Zamano this morning

    Comreg replied with the following:

    Thank you for your email.

Please be advised that ComReg will now raise your complaint directly with Zamano.

Once ComReg refers your complaint to the service provider they will be responsible for maintaining contact with you to resolve your issues. Once a complaint is referred to a service provider, it is typically resolved within 10 working days.

We will monitor the progress of your complaint and when notified by the service provider that your complaint has been resolved we will review your case and close as appropriate.

    Thank you for contacting ComReg.

This morning, upon seeing GavPJ's post I sent them the following:
Could you advise me of the status of this complaint please?

I have recently become aware that Zamano continue to engage in fraud within this jurisdiction.

    To which they responded:
    Thank you for your email.

I can advise that due to ComReg's statute of limitations in relation to Premium Rate Service issues your case cannot be re-raised as it has been over 2 years since the issue was raised with ComReg.

I can although advise that in 2017 Zamano did advise that you had been processed a refund and a log file had been sent to you as requested.

Unfortunately ComReg would not be in a position to pursue your case any further as a resolution had been provided in the form of a refund in 2017 and it would be outside or regulatory remit to do so.

If you have any further issues in the future please do not hesitate to contact ComReg.

Any previous correspondence related to this case is noted in the table below. All correspondence from ComReg will have had the same subject as this email: Your ComReg Case Reference Number xxx has been updated.

    So there you have it.

If the regulated body engages in systematic theft, and a single victim notices this theft and has he time and energy to pursue it, and the regulated body then returns the money to this single individual, the regulatory authority is not in a position to pursue the matter because this is a perfectly adequate resolution.

Frankly I feel like a fool for not setting up a company to steal money in this manner. How many millions have Zamano made from those who don't know how to stand up for themselves?

Of course if I went to the Guards with this they'd tell me it's a matter for ComReg.

And people will tell you with a straight face that Ireland is capable of regulating Facebook.

Zamanoed this morning at 9 trying to exit an annoying pop-up on my phone, don't know how it happened, got a message that said I was charged 15 euro for six babe videos and got six texts in a row, emailed them (Zamano) and they refunded my Paypal by €15 euros this afternoon. But so annoying trying to resolve all this nonsense. Thank God for this thread I wouldn't have known where to start.

I hope the €15 is all they have taken, I haven't got confirmation from my provider, 3, yet as to what has been taken from my bill.
Also texted stop and got message saying I am unsubscribed from all future messages.

I have no idea how they got my number, I was just exiting a pop-up.
