I hope your brother has the appropriate licence to photograph those birds of prey on the nest.

Here's the law. I thought it would of been fine to take a picture like the one in question as the birds are out of the nest, but as you can see if there near the nest at all you cant take pictures.
under Section 23 (6)(b) of the Wildlife Act, 1976 (as amended) for a person to take or make photographic, video or other pictures of a protected wild animal of a species specified in the licence, and
under Section 22 (9)(f) of the Wildlife Act, 1976 (as amended) for a person to take or make photographic, video or other pictures of a protected wild bird of a species specified in the licence on or near a nest containing eggs or unflown young.

Maybe my comment seemed a little harsh but at the end of day the main concern should be for the birds. Glad he has a license and good to see the young birds looking good and almost ready to fledge.

No you cant take photos of em,but its fine to cut the trees down while the young are still in the nest. What hypocrisy.. Coillte have been clear felling trees near hear for about six weeks now. There was a pair of Kestrels breeding there for the past seven or eight years and they just cut the lot.Makes my blood boil.
