Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

    So a 43 year old claims they can't use a swing without instructions in a court but feels she is competent enough to be a TD. Give her the cash but explain to her that if she can't operate a swing properly then it's in the best interest of the country that she probably shouldn't be in a position where decisions she makes can affect the whole country.

    Hopefully the judge will make an example of her and lambast her for her frivolous near fraudulent claim. How can any adult with any self respect claim she fell because there was no supervising the swing???

    I hope she loses the case, has costs awarded against her and then loses in the election because people are disgusted at her greed and stupidity.

    How did we let this country get so bad, the claim culture is shocking and idiot judges are to blame for handing out such big claims for next to nothing.

    Woman slips on a chip in Liffey Valley awarded 30 odd grand despite having numerous claims in past few years. Disgraceful, maybe foodhalls should have people hiding in bins waiting to jump out and pick up dropped foods. If you slip on a chip, it’s your own fault if you ask me for not looking where your going. If you fall off a swing it’s most certainly your own fault for not holding on properly.

    This woman like all the others just looking for an easy payday should be ashamed of herself. Her and greedy ***** like her are putting businesses and jobs at risk all for greed.

    It’s time judges took responsibility and stopped handing out these payouts.

    Yes, McDowell articulates the problem very well -

    Mr McDowell added that "if the Government is serious about driving down the claims culture, we cannot stand idly by when adults lose their seat with two objects, one in each hand, and fall off a swing and then claim there should have been a supervisor looking after them.

    "Especially when it comes from somebody who has so much public influence and clearly influence over Government policy in these matters," he added.

    Did this only reach the news because the hotel publicized it? Thats two FG TDs with dodgy claims. Also the fact that staunch Fine Gaelists Madigans solicitors are involved is even shadier.

    Leo must surely be absolutely fuming with her. Im just perflexed by how stupid the claim is. It reaks of desperation for some reason or another. Did she see it as an easy way to raise campaign funds? Are there any more that we dont know of?

    Its a sad day for the country if she is compensated and there will be real ramifications going forward.

    My perception during this Local/EU is that the Fine Gael TDs (with nothing to lose) are talking very arrogantly and pompously. They have lost touch. They sound like the Fianna Fail TDs in the early 2000s.

    There will be no one or no parties left to vote for if people won’t vote over one members behavior.

    Don’t worry she will top the poll, because the blue shirts will put a spin on how she is fighting for kids rights in the play ground and will promise to get every one in dunLaoghaire a big pay out.

    There's a door which I assume I could use to leave but I can't find any instructions on how to operate it, neither is there anyone here to supervise me and make sure I don't injure myself while attempting to open it.

    Sorry Paulie, just a small correction here of your post, and in defence of Maria, it actually happened five years ago when she was only 38. *Sniggers*
    Would she let her children on a swing with their hands full ???
    As said , this happened five years ago when Enda was Taosieach.

    Maybe she's the person with a pint in each hand he was always on about?

    As a side note.

    Her local swimming pool have felt compelled to install signs in anticipation of Ms Bailey's weekend visit.

    Fair play to Senator Michael McDowell who highlighted the case in the Seanad last night.

    He questioned the proposition that “there should be supervisors for swings when adults are using them and that it’s a matter of civil liability if there isn’t”.
    We live in a strange world where civil liability can exist in such circumstances,” Mr McDowell added.
    “If the Government is serious about driving down the claims culture, we cannot stand idly by when adults lose their seat with two objects, one in each hand and fall off a swing and then claim that there should have been a supervisor looking after them.”
    He added: “Especially when it comes from somebody who has so much public influence and clearly influence over Government policy in these matters.”

    Did ye know that Fine Gael TD Maria Bailey’s lawyers (not just one) listed 18 particulars of alleged negligence or breach of duty including a failure to have signs or supervisors. 18!
    Her lawyers claim there should have been signs or a member of staff to instruct how to use the swing safely.
    They also state there was nobody to supervise and intervene if a patron was at risk of a fall, and there was no cushioning of the area surrounding the swing. Feckin' cushions!

    Don't forget that Culture Minister Josepha Madigan’s family firm is taking the case, or should that be Vulture Minister Josepha Madigan?
    And I apologise firsthand to the scavenging bird of prey for this reference.
    We live in a strange world indeed.

    What I would love to see is a message being delivered to Fine Gael on Friday.
    Do not vote for any Fine Gael member running for the various positions and I'm sure that the message would go out to them to stop treating the Irish people with contempt.

    I'd be sorry if the media and political momentum rang out of this story so soon. For me it's massive. This is a very clear and real chance for our government to show that it's against claims culture and the consequent tax on insurance premiums that is placed on Irish society. If FG put the interests of one grasping TD ahead of making good optics on an important issue, then they don't deserve to be elected again.

    While the sums in this particular case are tiny in comparison to the folly of rural broadband and the children's hospital, there's an important principle to address. I long thought that FG weren't quite as venal as FF, but shíte like this tells me otherwise.

    Never thought I would say this, but Michael McDowell talks alot of sense especially in regards to the behaviour of Maria Bailey. If ever an individual deserves to be rejected by voters, she does. I'm sure her behaviour will be mentioned at the next GE .

    He's one of the main people behind the canceling of the luas metrolink because he owns and rents a couple of properties near that single rat run in ranelagh that would be closed.


    If it was a politician in office who pulled what he did with the metrolink he'd be giving out about them too, the mans a pious hypocrite.

    Considering his time as a politician and AG, I doubt he spent much time arguing for compensation. I believe McCabe was happy with his representation though. Anyways this is not about McDowell other than to highlight the sense he spoke in the Seanad.     A few years ago, a child family member fell off a swing and broke both their arms. Pretty serious breaks in both, and to make matters worse, they were a lead in a play later that week. Got to hospital, got them all patched up, and do you know what we did then? Told them to hold on tighter next time.
    During the play, they actually had to sit on one of those fake swings. Despite having both arms in casts, they still managed to do this, and act and sing... and not fall off.

    Same goes for time the Irish Times. They covered McDowell's comments, not Maria's case itself. No letters to the editor on the topic either. Haven't looked for an editorial or comment article yet. I think this one is ripe for legitimate coverage and comment. I would think there's something funny going on if there's no such comment in the IT.

    I'm a reluctant FG voter. I've said why before but it's basically because FF are corrupt as hell and screwed Ireland over the last time they were in power. The rest of the parties are pretty much incompetent for various reasons.

    However having twats like that in the party makes me even less likely to vote for them. All FG have to do to attract a voter like me is not be corrupt and not have chancers like that.

    Although I guess to a certain extent there are probably people like him in every party in every local council across the country.

    If she wins this case, every gouger in the country will use it as a precedent. Child falls off swing in playground? Sue the council or whoever owns it. Insurance costs go up and playgrounds will be shut down. I can see something like this as a possible longterm outcome of the case.

    I hope she loses.

    To be frank, Frank, I think you may be right.
    Soft-tissue injuries everywhere and then people will wonder why the parks, playgrounds, and outdoor facilities all over the country are closed permanently.

    You would have to wonder about the optics of this whimsical lawsuit by the Fine Gael TD?
    The Fine Gael elite will be around soon to proclaim that she is "entitled" to sue the hotel for falling off the swing. They are so out of touch with the regular people in this country that they do not see the support that they have lost in the last 24 hours by this case.

    But they'll battle on ............. and shout loudly at us to do what they say, but not what they do.

    Leo needs to do 2 things.
    1. He should be thanking Maria Bailey for highlighting the compo culture which is laughable.
    2. Then, Leo should get her removed from FG.

    Leo has views on everything, but I bet he will remain tight-lipped on this. Lets hope Ms Bailey loses and gets hit with massive costs.
