Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

    Fine Gael TD Maria Bailey has sued the Dean after falling off Sophies swing.

    She's looking for €60,000.

    When the Politicians are making dodgey insurance claims, you know for sure that the country is absolutely fooked!

    If they take away that swing, what the hell are the Dublin Girls of Tinder going to do!? :eek::eek::eek:

    Fine Gael TD Maria Bailey was holding items in both of her hands when she fell out of a swing, a hotel she is suing over the incident claims.
    Ms Bailey (43) has sued the Dean Hotel in Dublin for damages of up to €60,000 over injuries she alleges she suffered to her head, back and hip.

    The Dun Laoghaire TD says she fell backwards out of an indoor swing while having her photo taken during a night out with friends in 2015.

    In circuit court proceedings, she accused the hotel of negligence, saying the swing was "unsupervised" and there were no signs to instruct patrons how to safely use it.

    Pain

    Ms Bailey claimed she can no longer sit or stand for long periods without experiencing pain or discomfort. She also said she used to run 70km a week before the fall, but has had to reduce this to less than 20km.

    The hotel is denying liability, saying that if any injury was suffered, this was due to Ms Bailey's own negligence or contributory negligence.

    In defence papers filed with the court, the hotel alleged she failed to use the swing in a proper manner and held items in both hands, restricting her ability to balance and preventing her from holding rope grips properly.

    The indorsement of claim filed in court by Ms Bailey's solicitors makes no mention of her holding anything in her hands when she fell.

    Details of the case have emerged at a time when there is considerable political focus on personal injury awards and high insurance costs.

    Ms Bailey's case was briefly mentioned before the County Registrar at Dublin Circuit Civil Court yesterday.

    Grainne Berkery BL, for Holtend Limited, trading as the Dean Hotel, told the registrar that on consent Ms Bailey had six weeks to file an affidavit of discovery.

    It is understood this is to satisfy a request for medical and dental records for the three years prior to the alleged incident. Discovery is a routine part of such cases.

    Ms Bailey was not in court. She is being represented by Madigan Solicitors, a law firm run by a brother of Culture Minister Josepha Madigan. Ms Madigan, a solicitor, stepped away from the firm after becoming a TD.

    In her action, lawyers for Ms Bailey, of Woodside Road, Sandyford, Dublin 18, said she was at the trendy Harcourt Street hotel with a group of friends on July 13, 2015. They said that at around 9pm, her party went to the top floor, where there was "a swing unit".

    Her solicitors said she was sitting on a swing "unsupervised", having her photo taken by friends, "when she was caused to fall backwards".

    She struck the ground, with her hip, lower back and head taking the brunt of the impact, according to the claim.

    €60K is the maximum payout the court can award, it’s not necessarily what she’s asking for.

    If her claim is that she fell off a swing then she should **** off. But if the swing fell while she was on it and she was injured that may not be her fault.

    It’s great that our TDs lead by example. If you need money for a deposit for a house / holiday / whatever you’re having yourself just destroy some business with a claim. Is it any wonder we have such high insurance premiums??

    Ah C'mon, the Swing is not really a playground swing, it's a swing you just sit on, and get you picture taken for Tinder/POF/Bumble/etc. It's about 1.5 feet off the ground.
    There is no way falling off it could seriously injure you.

    Double Facepalm for Fine Gael.. For not convincing these two to join another party. and didn't another sue a paper for a daft headline?


    Alan Farrell actually singled out kids in playgrounds as a reason compo culture should not be tolerated, and less than a year later, he and his colleague have brought two ridiculous cases to court.
    If a swing isn't the perfect example of kids playground insurance premiums...

    The PR people in FG should have told her that this would not look good.

    However it is very likely that this will either succeed in court or be settled.

    The hotel which has an indoor swing where it knows drunk people will be using it should have known better also. Its all grand to be giving out about dodgy claims and rip-off insurance and so on but business owners need to use a bit of cop on too.

    When i was 11 i cut my back open on a slide once.

    It isn't even a proper swing, you just sit on it to get a picture.
    If she fell off it because of her own stupidity then she has no one to blame but herself. It can't always be someone elses fault ffs.

    Sat at work here wondering what kind of millionaire lifestyle I'd be leading if I put in a claim for every single incident that happened in my life. I'd be rolling in it.

    I hate this stuff. It's why playschools are closing down and kids can't run in the yard anymore. I remember when, as a kid and as an adult, if you fell you just felt embarrassed and tired to walk it off. Now first thoughts are to sue.

    I've sat on one of those swings while waiting for the lift. No one needs instructions on how to use them. The dope had items in both hands. I'm sure she didn't just sit still either. Probably tried to swing with no hands. And these idiots are representing us?? That other eejit driving down the steps before too.

    At least the hotel seem to be fighting it rather than just agreeing a settlement. I hope she loses and has to pay all legal costs too.

    A 43 year old TD suing a hotel because

    A: she was allowed to do so unsupervised

    And

    B: there wasn't a sign instructing her how to safely use it.

    Think about it for a few seconds, instructions on how to operate something most of us have gotten to grips with by age 3/4.

    This is a new level of stupidity and unashameful greediness not seen in ages.

    I hope to jaysis the judge fires the claim out to fcuk and her with it. :D

    There will be no one or no parties left to vote for if people won’t vote over one members behavior.

    There is also the other matters of Children's Hospital, homelessness, Climate change, broadband plan, etc., etc. The point is to let them know that you disapprove of her actions and this is the perfect time to do it as it will be forgotten about when the general election comes around.

    Homelessness- scam and gravy train.

    Climate change- only been talked about in the last 2 weeks, what’s your issue with this?

    Broadband plan- many agree with it and say it’s needed.
