If you bothered to read the info you would see that the average time served was between 7- 15 days in jail....for not having a TV licence. In 2007 the average time in jail for not having a dog licence was 35 days. That's over a month in prison for no dog licence!

How much time in jail will Foley serve for an assault which led to life threatening injuries? A: 0.

fair enough anyone i heard of only spent a few hours there. But i think people who do not have dog licences should get a few months esp when the let their dogs muck someone garden

The info is in response to a question put to Alan Shatter and clearly states 'The average custodial sentence length for each category'- this means time spent in jail as opposed to non-custodial or suspended.

So ALL of Foley's sentence was suspended but some poor fecker spent over a month in jail..in a cell...for not having a fecking dog licence!!!

I reckon execution would fall short for some people posting here, the guy did very wrong, a moment of madness, it's cost him his career, he's sold everything he owns to pay compensation and his life is in tatters, he's genuinely remourseful and his victim does not want him jailed. Many offenders meet none of the above and get suspended sentences. Get a grip folks and move on!

Time in jail includes time spent on TR.

so when a cop goes bezerk and walks away
everyone else has to move on?? is that how it works
what about the next guy coming along for serious assault
does he get the same sort of justice??? or do we just jail him
even though he might be remorsefull too ...
so you think a person letting their dog sh1te in a garden is more serious a crime
    than a person beaten to a pulp???#
    i do despair

'remorse' is just a legal tactic like crying in court

Definition of remorse: onion in ones pocket...

    From: http://www.irishtimes.com/newspaper/ireland/2011/0527/1224297853162.html
Mr Murphy suffered a broken nose, fractures to his cheekbones, broken teeth and bleeding to the brain in the late-night assault which happened after words were exchanged over the clothes worn by somebody in Foley’s group.
    This happened after
    http://www.independent.ie/national-news/courts/garda-weeps-as-he-is-jailed-for-beating-man-unconscious-2659529.html
The attack was triggered when Mr Murphy drunkenly joked that a t-shirt worn by one of Foley's friends was "a bit gay".
Which was a response after they remarked about Mr Murphys clothing and laughed.

So to summarise, Mr Murphy "drunkenly joked that a t-shirt worn by one of Foley's friends was "a bit gay" and Mr Foley then attacked Mr Murphy and left Mr Murphy unconscious. For this Mr Foley gets no jail time because he's a guard.

Would commiting murder get a Garda jailed? Or would they be let go?

Yes, He is a thug, I wouldn't criticize the man if it was only a slap but what he did was scandalous, It was excessive and anyone else would get roughly 3 years for that assault.

Its bosco who is the garda clearly but im sure he doesnt condon the actions of the off duty guard there is noone with any decency or sense that would!!! There are good and bad in every walk of life you cant tar people for the actions of a few, What about the huge misjustice in the case of Garda Mcallion who died because he was a garda doing his job , No justice was given in this case either as his killer walked free !!!!

he is a scummy thug with onion tears and legal 'remorse'

Can the DPP appeal the sentence?

I thought the guards had psychological tests to weed out people who snap at a remark. I hope they review their procedures.

I can understand the rationale behind the Judges decision. The guy would have to spend a good deal of time in solitary confinement which would be a substantially greater punishment than an ordinary person would get. Your career would be in tatters no matter what career you happened to be pursuing.

However, it does send out the wrong message that he's got away with it.

How did he get off? He didn't get jail but he still got a conviction and a suspended sentence. In addition he will lose his jon and has paid a large amount of money in compensation. There are cases were sex offendors don't have it that hard.

Shudder. Since you are such a fan of unrhyming poetry, and have appalling grammar:

We must be free or die, who speak the tongue that Shakespeare spake.
