    Well come on - tell all - how big is the room, roughly how many people have sat tort and company so far, are the invigilators helpful, are you allowed a bottle of water, is there a clock etc...

    Hi, just wondering whether anyone did this question today and what they answered it on? Need some reassurance!


    Yeah I was much the same.. Was defo my worst question by far! Answered it on the basis of Ostensible Authority..Freeman and Lockyer .v. Buckhurst Park Properties! Was under pressure at this stage so only really got through the four step test. And you? I am almost certain it related to corporate contracts..Please God it did!!!

    I wouldn't do it. Their logic is that you could have copied and pasted anything into a doc you print yourself.
    Try the Waterford RTC bookshop. If they haven't it, go via Limerick and the UL bookshop (O'Mahonys) will have it.
    To be honest, you should have had it long ago so that you are used to referring to it and navigating around it, but good luck anyway.

    I sat tort yesterday. there seems to be two rooms. if your exam number is 570 - 1006 your in the hotel everyone else is in the exhibition centre i think. i'm in the hotel function room.
    i took in a bottle of water with me and seen loads of people with one too so no prob there. there are clocks at the front of the room. it is pretty packed but didnt think it was too bad where i was sitting.
    I didnt have any problem with the invigilators, people were laughing outside the room but the woman went out and must have told them to be quiet so it was fine.

Mentioned the doctrine of notice too and brought in the rule in Turquand for the outsider relying on the contract. It was a tricky one !

    I just looked at it again there and started thinking had it done all wrong!! But you've clarified it. I answered in the same manner, once you outline the four stage test you're flying it i'd say. Mentioned the doctrine of notice too and brought in the rule in Turquand for the outsider relying on the contract. It was a tricky one !


    Thank God! Pheewwww...Post Exam Analysis is DANGEROUS! Yeah I was the same myself and didnt want to ask here incase someone told me I had totally screwed it up! Honestly I was sketchy on it but knew Freeman and all the steps so hopefully it'll get me over the line on it. Was uncertain as to how the relevance of Turquand and just didnt have the time to do the thought process on it etc. but should have seen the relevance of not adopting MR 112 in hindsight! Hopefully I got the substance of the question in any event!

    Don't do what I did last October - forgot the Lawsoc's letter one day. I was lucky enough, it was Cork and the nice decent lady remembered my 'orrible mug from the previous day, but it put my stress levels in the stratosphere for half an hour when I realised I hadn't it.
    Up at 5.30 for the mad dash to the Red Cow...God bless it and all who sail in it...

    No didn't do that question, regretting it now but hadn't it prepared well enough! In relation to model reg. 112, forgot about that too myself! Anyway I'm hoping I had the substance of the answer ok!

    Sure as they say..Hindsight is always 20/20!!!! Sure look we got the main issue right anyways! Onwards and Upwards! And hopefully it won't be marked too harshly!!:P

    i had a mini crisis before company and a really lovely woman was there! she was very nice! theres a clock at the top of the room and the rows arent very far back so u could see it any way???
    ugh i was in the room beside the night club it smelled! somebody said about ear plugs!! defo earplugs the desks are squishy,

    also theres two different places like block a and b are in one room and the rest sumwer else its realli badly done i think??

    just saying!

    theres two rooms, think im in the smaller room, but theres a huge event center room aswell with a couple of hundred ppl. U can bring water or any drink but for some reason they dont allow cans? felt really sorry this am when a girls two red bull cans were taken away from her, it was like they ruined xmas for her or summit....
    I handed in my legislation this am as I couldnt part with it yday eve after tort coz I felt like I needed to make sure that every thing was tabbed in my nightly cram. They gave it back to me at ten o clock which was grand!

    There are multiple rooms. The one I've always been in usually goes up to candidate number 600 or so roughly.

    Seems like all the rooms have been pretty full both times.

    Haven't spoken to the invigilators to know.

    Bottled water ok. They won't allow cups or cans though.

    In my room there have been a clock per "block" of people (200ish per) that's been easily seen, and I've been towards the edge of the blocks where you'd expect to have a bad view.

    I have one, and only one, complaint thus far. Yesterday at tort they let us leave our bags at the back of the room. Today they insisted we leave them in the HALL across the way. It's not that I expect budding solicitors to be thieves or anything, but it's not like no one else could walk by or anything! I did not like that at all and probably will be writing of my displeasure to the law society. Whats more annoying is the invigilators have a room that they could totally let us put stuff in for safe keeping!

    Trustees' duties
    Mixed trusts problem, some failures, some valid charitable
    Some shaggin' thing out of remedies, hard to call it, maybe undue influence and a bank because everybody hates banks at the moment..

    Just guesses, good luck with it anyway.

    I have the examiner report but dont have specific question please...

    I dont think the law society copy right the questions do they??

    They do in fact. I haven't a scan of it, if I had I'd help you. The Google Group for FE1s is usually a better source for materials they shouldn't be putting on the www...

    Sat company today and i must say i have no compaints with the red cow so far (apart from the fact its so far away!)

    I was in the events centre.. i brought ear plugs with me following yesterdays comments and forgot to put them in and never even noticed that i'd forgot, noise levels were fine..

    Compared to neptune stadium its a bit more packed in together but no more than you'd be used to with college exams. Having sat the exams in cork previously i have to say the number of people sitting was a little daunting..

    Good luck to all sitting tomorrow..

    Thanks for the replies guys, your right I should of got it ages ago but like a dumbell I didint read the exam rules etc they sent me in full until this week

    Ill get it somehow online or in a shop before next week

    No, it's 1960's. Ultra-quickly - Ralli died in 1898, leaving a life estate in his properties to his wife, then to his two daughters Helen and Irene. Helen got married, and in a marriage settlement, she covenanted the property she was to receive under her father's will to her husband. Irene's husband was made trustee of the settlement - NB.
    Helen died in 1956, her mother died in 1961. Irene's husband was also Helen's executor.

    Ct held, applying Strong v Bird, that he held in two capacities and he could elect, it was up to the other beneficiares to prove thay had a greater equity - which they were unable to do.
    Irene's husband therefore used his legal title as executor to perfect the otherwise inperfect gift, ie the marriage settlement.


    Complicated? definitely, but is shows how Strong v Bird works with the vesting of the legal estate in the executor.

    Don't delay any more you dozy eejit ;-) , forget about online, get in to a decent bookshop asap and buy it and start thumbing through it to get familiar with it, there are huge chunks of it you'll never look at.

    Funny you say that.. I did company today and the legislation is twice the size of the EU legislation.. The funny thing is that I used it so so much in my studies for the exam..Dont think you can study for company without it..But I barely used it in the exam today...Its really only a crutch for when you doubt yourself in the exam..Realistically time constraints just dont allow you to use it for anything else.. Sometimes it can be handy if your stuck for a fifth question too just to paraphrase in a worst case scenario! So if you havent had the the legisaltion at this stage you may just manage without it now! Best of luck anyways!
