    The Spouse:
    The legal right share (LRS):
    Section 111 of the Act provides that where a spouse dies either wholly or
    partially testate leaving a spouse and no children, the surviving spouse is entitled to a legal right share (LRS) of 50 per cent of the estate.

    I think i am confusing intestate where the spouse is entitled to 100% if no kids and no will...............

    I am i write in saying:
    Testate = 50% spouse no kids legal right share........1/3 if kids
    Intestate = 100% spouse no kids............. 2/3 if kids

    Leaving out injunctions completely. PRT ie. joint deposit a/cs came up on last two papers so I'm going to focus on automatic. Both undue influence and rectification came up the last 4 sittings so I am ditching them too.

    jesus christ what the hell was ultimately held in Quinns Supermarket?

    I know that the SC held that the religion clause COULD require a discrimination to be made on religious grounds,and that this warranted the exceptional opening hours of kosher shops.

    Buuuut were Irish butchers then allowed to open sundays-no? HELP! PLEASE!

    im doing the same pretty much, but within those topics i'm cutting down like say in sp im only doing contracts requiring supervision, i don't think land or personal property have ever been asked, can anyone clarify?!

    You have the answer there yourself - kosher yes, everybody else no, to allow the practise of religion. Just ask yourself why would Superquinn have had a go otherwise?

    Edit - btw I'm not the JC you adressed the question to, but I'm often mistaken for him ;-)

    For SP i am looking at contracts requiring supervision and defences and i have bulletpointed contracts for service and contract to build in case a problem q comes up like it did in April 2005.
    I would be hoping for a nice little defences question... a girl can dream!

    Lol did anyone notice that for Q6 in company he asked about effectiveness and power of s.205 actions for minority shareholders? Gave the cheeky answer that Model Reg 3 allows a Director to refuse registration and thus a shareholder may not be a member under s.123 CA'63 and thus they have "no power" under s.205 to bring an action ;) - just look at Banfi v. Moran Ltd - no power for shareholders.






    ...but then proceeded to examine the question from the viewpoint that he asked about minority "members" :P

    Also mentioned in the exam that my trip to Holland only cost 400 euro :D

    hahahah the €50,000 trip to amsterdam!! sooo glad thats over....naptime then start on equity :(

    i did separate legal personality, receivership, realisation of assets, transfer of shares and sec 150.
    didnt think it was too bad but sorta of ran out of time! :eek:

    Quick question for those doing EU. In part (iii) of q 6 oct 2009 the provision allows a natural person living in ireland to claim an exemption from income tax on dividends distributed in the form of shares of a subsidiary by companies established in Ireland.

    Any thoughts on how to structure this answer. Finding it quite confusing...

    Just reading the letter sent out by the Law society re exam rules etc, and the permitted text books for eu

    Just wondering is it possible to just print off the acts and bring them in after being checked or does it have to be the EU legislation text books listed in the exam rules?

    Havng trouble locating a copy of the named text books

    Does anyone know if you can hand in Legislation the morning of the exam and then get it back during the exam?? Or must it be put in the day before??

    Hey everyone,

    For those doing constitutional, re non justicibility, what sort of questions come up? Trying to look at it here but cant seem to find anything in past papers.

    Im covering referenda, national security etc and resource based issues, but not sure what sort of question can appear on this topic!

    Any help would be greatly appreciated.

    Also CFOLEY- Last year people were allowed to hand leg in the morning of the exam and have it on their desks before 10am- I assume same thing applies this year- maybe ring law soc and try to find out? Although they are quite useless!!

    Hi i sat tort yesterday and they said about handing in legislation etc. your not allowed to bring in downloaded or photo copies it has to be the originals. I went into the local bookshop and they didnt have the nigel foster book so they ordered it in for me. took a few days tho. has to be handed in before the day of the exam as well. did you try on line on ebay and see can they send it straight to you.

    Has to be before the exam. i handed my eu leg in yesterday coz i won't be back in dublin til tues afternoon. You get it back the morning of your exam. thank god i had all my pages tagged.
