    Correct me if im wrong, but i hope for our sakes im right, i think q 3 was a vic liab question if thats the one your referring to, there was no evidence of any psychiatric illness in the question, 'distraught' is not a recognised psychiatric illness so isnt it wrong to deal with it re: nervous shock?? I promised I woudlnt post mortem the paper but im up here on my own n wanna make sure I at least identified the right topics :o

    I also threw negligent misstatement in the PL question, along with general negligence - did anyone else do that? For the nuisance question, the first part was Rylands, but I just mentioned it as I didn't know anything else about it, then dealt with the rest as per nuisance.

    I did every last problem question! Did the same as you in adding in neg misstatement to the products one, and actually felt while I was writing it that that was mores what the question was. Felt like a lot of them required you to talk about multiple things!

    Yeah ur right!i answered it on nervous shock and distraught isn't a psych illness, kicking myself cos i know that, panicked in the exam

    hi hope everyone got on ok. i thought it was ok, sickened defamation didnt come up tho. i discussed the nervous shock but said that there was no mention of her having ptsd then went on to discuss vicarious liability so hopefully that should be ok. done product prob q, res ipsa, crypian and bertie and really ran out of time for my last q so had ten mins to do eddie and ellen q had to bullet point the whole way. what was the last prob q on i couldnt decide.
    so glad its over tho.

    Just down from Dublin travelled up from limerick. thought it was terrible. Did not start til near 10 with the questions. no Defamation what did anyone answer to the one about Ellen slipping and the product liability one which one was that. i got so confused f...er who set the paper why cant they make things more simpler.

    Thought the exam place was terrible. Bunched in together and it was cold when you went in first no heat.

    And the thing about the cans and cups etc did you ever in all your life.

    It was on Rylands and Fletcher which I hope is right Heard a few people talking about it on my way out and then I did the one on product liabilty and somebody on the way out mentioned causation and remotness which really freaked me out.

    what was the last prob q on i couldnt decide.


    Answered it a rylands fletcher heard a few people when leaving talking about the last question being that but sure who is to know with these exams. Anyone one down one to go tho I will be repeating this one in oct.

    The venue is fine, couple of teething problems with noise which I hope they sort out. Otherwise, the only thing I found odd was that I wanted to study beforehand but the punters in the hotel had the cheek to be carrying on their conversations as usual. Also background music everywhere. Small annoyances that you don't think of.

    I took the LUAS, so I don't know. There is a big carpark on site and a bigger one by the LUAS stop 5 minutes away.

    Yeah, I just twigged it when I was near the end and added a few paragraphs on at the end - felt like I was throwing in the kitchen sink!

    I found the venue to be fine, first time doing them so I have no real comparison.

    Was at that stop about 6 months ago and can't remember seeing any pedestrian walkway's back across M50.

    I Answered the following questions:
    Q2- Eddie and Ellen- Duty of care, causation, standard of care (was he reasonable) and mentioned think skull (fact she old/ frail could make her more likely to suffer hypothermia)

    Q3- Acme Technicians- Vicarious Liability

    Q4- Res Ipsa Loquitor (only managed 3 pages on this :( )

    Q6-Roadster Ltd- Products Liability, contributory negligence, spoke about 1991 Act and claim under negligence

    Q8- I dealt with nuisance and negligence (causation, possible remoteness re sheep etc)- think this question screwed me over a bit!

    What everyone else make of it? What are the examiners like with marking? Is it as tough as company or as easy as EU?

    Will i get any marks for not dealing with Rylands in question 8? Feck!!!!

    Yeh, it is definately possible, there's a small little pathway.

    I know what you mean, it's just that these silly little things cause so much stress on the morning of an exam if they don't go your way!

    Oh stop, i got train up from Cork this morning and then Luas to Red Cow from Heuston- I passed the Red Cow Moran Hotel on the Luas i.e. I saw it but I have no idea how to get there from the tram stop. I am staying at the Ibis across the road and I had to ask the man for guidance cos I had no idea how to get on to the pedestrian bridge, it is all so hideously complicated! First exam not until Thursday but I will defo be taking a tour this evening trying to figure out my way around this place! Is there anybody on here staying in the Ibis too who can give me clear directions to the Moran?

    Found it dire altogether.

    The essay q's were okay but the problem questions were impossible to decipher. Q8 - I said it was Rylands and Nuisance. I totally fecked up Q3 - heard someone mention causation outside afterwards = major 'doh!' on my part as I spoke about vicarious liability but it didn't dawn on me to talk about causation! Would say that I'll be repeating tort! :(

    f*** it its over now, anyone els trying to cram some last minute company?? absolutely shattered n cant concentrate. anyone have some divine inspiration for it???

    At the luas stop, facing it, walk to the left under a bridge n theres a long footbridge that takes u all the way over to the door of the moran.
    Venue was a bit better than Cork anyways, but v bunched n I was seated by a hissing pillar, v annoying, though it was a gas leak or something...v negligent indeed....:mad:

    Could anyone tell me what it means to say a company has a common seal.. came up in a question a few years ago and I checked it out before but the head is so frazzled at the min i cant remember what it means..

    All my good topics . . . and needless to say I hadn studied Ryland given that it only came up once 8 years ago.

    Anyone thing paper was a little restrictive/ unfair besides other years, then again that the essay questions weren't to bad

    On the luas issue-

    There is a specific footpath that doubles back and then over the motorway from the stop. It's a good 5+ minute walk, but it's pretty obvious, IMO. I had never been out there and had no problem getting to the venue just following what looked promising. I also found it was easy enough to tell who else on the luas was going to the exams and following them helped!

    The venue itself seemed fine. I didn't find it cramped, cold or noisy! If you went away from hotel reception down towards the place to hand in stuff I found it quite easy to chill there.

    Just make certain you know where you're going as there was 2 places (convention suite and events place) when you get there as apparently some people didn't know where they were going.

    Thanks for directions guys- seriously don't underestimate my ability to get lost! And to think that i considered bringing my car up instead of getting train- now THAT really would be the icing on the stress cake that is the FE1 marathon!

    Would Q1 not have been Duty of care and omissions?? thats what i said, therefore no need to talk about causation, standard of care, etc as no duty existed at all.

    RE: Q3; along with VL, would it not be psy damage too: Our lecturer told us we are not psychiatrists and therefore how can we judge what is psy dam in such instances and according to Cuddy, witnessing your child in an acident.. you're owed a duty of care... plus the Q said state the possible responsiblity in these eventS!! therefore Im hoping we get marks for noticing this...

    Thats what Im hoping anyway. But hopefully every argument we put forward will get us enough marks to pass. Fingers crossed!!

    Some one mentioned about EU examiner marks easy, really???? God I hope so!!!

    It's just a gadget to impress the company's seal on legal documents like this:

    A company would use it e.g. on contracts, remember contracts under seal need no consideration. The company secretary would normally keep custody of it. A major corporation would have a big elaborate one but a mickey-mouse company would have the 30-dollar one here, or an even simpler one that looks like a stapler.

    Did anyone else get an email from peter maxwell in the law soc today about setting up an account, this is the msg:

    I don't know if it's legit or a phisher.
