Basically all speech in America is constitutionally protected by the First Amendment. Films, music etc can be as violent and abusive and morally wrong as it wants to be.

California is trying to say that video games are not protected by the First Amendment and should be censorable and that the sale of video games to minors which are violent should be outlawed.

Many see this as the first step in censoring video games outright in the US as once it loses the protection of the 1st Amendment then states can basically make any laws they want regarding video games.

And all these US laws and lawsuits arise over ar$eholes committing crimes and someone pinning it to videogames, and when its a 13year old who has a copy of GTA its very easy to get Oprah to listen and condemn the game. You know you hear of such and such schoolkid going on a violent rampage of some proportion and a copy of Modern Warfare 2 is found at his house with hundreds of hours of playtime and if the kid is under 18, they go nuts on the developer even though the parent bought the game.

This is all arising out of a case that Schwarzenegger is taking against EMA (America).
