Post Packet left on driveway

    A small package was delivered to me today (not by An Post or DHL),but by another well known postal delivery firm. XXXXWAY. The package was just dumped in the elements in front of my outside door without any attempt to ring my doorbell. Anyone passing could have picked up my package, if it was taken without my knowledge where do i stand?

    Your contract is with the seller so if you did not receive it then you take it up with them.
    If it is not delivered, the seller follows up with the courier, not you and potentially the seller will have to re-send the product.

    However, you got it so stop worrying!

    They have an awful reputation for this carry on. No matter which busy period they are in. Like most couriers, there are severe demands deliver. One would think they would at least ring the bell or knock. But if they did or not, it would be your word against theirs. As a company, they would side with the driver as he did his job. Again, the complaint should be directed with the seller. But the fact it has been delivered, thats the main thing.

    To be honest, you’re lucky it even made it into your driveway. I’ve had one marked as “delivered” they couldn’t tell me where it had been left, my security cameras showed nobody had been near my house all day. The retailer was going to ship me a replacement the following day when at about 10pm that night there was a knock on the door. It was a woman who lived in the local town (I’m about 3km outside town) asking “are you Mrs Toots?” and she told me that she’d had a parcel delivered for herself earlier on and discovered that the driver had left parcels for me, and 3 other people who lived in the locality, outside this woman’s door!

    The OP's contract is not with the courier so it really doesn't matter what the courier said back to the seller.

    The only way it might affect you is that you may have to wait a few more days for a second delivery to come.
    The seller is obliged to get it to the buyer - not to somewhere near the buyer's driveway.
    Legally, you as a buyer are protected in that the seller is obliged to get it to you. You then have rights of return but that's not part of this discussion. If you as the buyer don't receive it then the contract has not been fulfilled.

    TLDR: who signed for it?

    But it doesn't matter to the scenario you are querying.

    You order from online seller. You don't received parcel as courier failed to deliver. you tell seller it wasn't received. Either they send a replacement or issue a refund (likely their choice which they do)

    A family member had a case where they left it in the blue bin.

    Trouble was the bin was the neighbours and they left it out for collection.

    Parcel gone to the dump.

    Item out of stock so no replacement, refund issued.

    Unless YOU paid the courier directly, you have absolutely no comeback whatsoever with the courier as you simply have no contract and therefore they are now answerable to you in any way shape or form.

    You have your package - get over that it wasn't handed over to you with gold gloves

    Shop elsewhere if you don't like the courier being used.

    don't they sign it themselves (couriers).

    not sure what happens if it goes missing & it's signed for delivered but it must have happened by now to someone

    Yeah, my point was that @drury.. wouldn't have signed for it. There would be no evidence that it was delivered.
    Coincidentally, a package was delivered here today (I'm WFH) and the courier asked me for my name to put of the delivery note.

    but the courier signs it times & throws it in driveway, marked as delivered. then get stolen. what happens then?

    There's no proof of delivery, so it goes back to the sender to either dispatch a replacement, or give a refund.

    I've said this several times now - if you don't receive it then the contract hasn't been fulfilled and the seller needs to dispatch another one to you. How it got lost or where is not your problem in any way.

    i might be misremembering this but i think one showed up as for signed by me, when i wasn't even home.

    Lately I have found couriers take photos of where they leave the packages if you're not at home.

    I can't remember the last time I had to sign for package - they usually just scan it when they get to the address.

    Although, for some items, Amazon emails a passcode that you have to give the driver on delivery.

    As an aside, I got these labels for my bins, as I was pissed off with couriers putting packages in my wheelie bins.

    In the real world, with the amount of deliveries, if they all required a signature, nothing would be delivered due to the sheer volume.

    Yeah, things change. Covid times made sure they no longer have to sign. Its the normal now. I'd say An Post and only 1 courier in recent months have asked me to sign.

    Having similar problems… But first, I thought "Fastway" was gone. They used to be outstanding, and then had to sell out (I thought) to one that I dislike intensely (not DHL but another biggie, I think). Very sad to hear bad things about "Fastway." Maybe it's just the name and not the same actual group owning/running it.
    The one who shall not be named (do I really need to be this cautious?) delivered a parcel 3 weeks ago, and sent "proof of delivery" image: My parcel, perched on top of one of the posts of my gate, basically out where anyone driving by could take it without even getting out of their car! When I looked out the kitchen window to see if it was there…. It was not there, nor on the ground…
    Twist in the story: HOWEVER, when I opened front door to check post, the parcel was on the front stoop. An Post must have brought it to the actual house. (I was going to attach the "proof of delivery" image here for your enjoyment, but guess what?? IT IS NO LONGER ATTACHED TO THE EMAIL! "Link is expired and image is no longer available." How convenient. Can't believe I didn't save it in one of my files… grrr.)
    To the point: I probably will not order from that source again, and I will let them know why. Unfortunate for me. I depend a lot on online shopping out here in the hinterlands. Now nervous, as I have an expensive delivery allegedly being delivered by "Fastway" (I thought courier name was just not updated on their website) … If it's these eejits… God only knows….

    You may be getting mixed up with Nightline who were bought out by UPS. Fastway have been brutal for a long time now, although the rest are rapidly joining them on the race to the bottom.

    I'm fed up with a tiny little knock on the door from 90% of the couriers, if you get a knock at all, despite a ring doorbell being obvious. UPS delivered the other day, so I asked him why he doesn't ring the bell. He went every colour of the rainbow, and eventually stammered that he didn't want to disturb anyone…….at 2.30pm. I told him that the box he was dumping on the doorstep cost near enough €1300.00. Told him that the last UPS delivery for my son was from Hillfiger and left in the open (We have an open porch where it could have at least been sheltered, but no…) and absolutely p!ssed through wet. He has promised to ring the doorbell in future but I have my doubts. Although it did seem to be news to him that I could go back through the recordings and show exactly what he did on delivery.

    So there's no proof of delivery

    Presumably they don't self scan expensive items where a dispute may arise

    I had a package (through An Post) not delivered recently. I asked the postman (simply because I'm familiar with him) and as I had reckoned he knew nothing of it. (He does leave stuff behind flower pots but, to be fair, he pops a note in the letterbox saying where it is)
    Anyhow, I emailed the selling company and although they grumbled a little (including suggesting that I should have paid the extra charge for registered mail), they sent on another package. No idea what happened the original.

    In terms of "expensive items" - they shouldn't know the value of the package but for expensive packages it would be prudent for the buyer and seller to opt for registered mail.

    typically, my experience is that fastway couriers ring the doorbell but don't wait for an answer, and then mark the package as having been left 'in a secure location' which simply means on the mat outside the door.

    we live on a busy road, i'm amazed we've not lost any to theft.

    All Amazon deliveries are tracked.

    I have found for expensive items, they do require a passcode.

    If they leave your package on a doorstep or elsewhere Amazon will send you a photo of where they left it, as proof of delivery.

    Proof of delivery (to outside your home) is not the same as proof or receipt.
    If I pay for something I expect to receive it, not that I expect to find it somewhere out the front soon

    Literally just got a delivery by DPD ten minutes ago.

    Driver did ring the doorbell, but by the time I got to the front door, (maybe ten seconds?) he was already driving away.

    Parcel propped up beside the door.

    The courier business has been racing towards the bottom for quite some time.

    It appears that businesses are prepared to accept that their customers will get a poor service as long as charges are kept low.

    Drivers are increasingly under pressure to make more drops per day to keep viable.

    There's a roadblock in the online shopping model if customers must have goods handed to them

    The workaround to keep goods flowing means some theft and losses , disputes etc.

    The seller should get what the seller pays for. If the seller pays for signed delivery thats what they should get. I know a friend in retail had to complain to her suppliers that Fastway never stopped for a signature. After that the Fastway driver used to stop to get a signature.

    Amazon in many cases pay for the driver just to scan to indicate the item had been delivered. Thats fine because thats all Amazon pay for.

    Expensive stuff should be signed for to prove receipt

    Proof of delivery probably do for cheaper stuff. Some will be stolen mislaid etc , some fraudulent claims of non receipt

    Its nothing to do with the cost of the item. If the seller pays for a signed for delivery service then thats what they should get not a "signed for by the driver" service.
