    What are the chances of the crystallising of a floating charge coming up again? Am I better to focus on other areas of borrowing or is it a must?

    I passed tort in August last year and don't remember learning the depth of material to answer that question to be honest.

    There are many areas of tort and i would argue that's the "incoherency" and are they all necessary. Is the real focus of tort law on rights, wrongs, duties or just for loss?

    Tort in essence can almost be taken on a case by case basis. But on the other hand if Tort was too rigidly reformed, it would create a social injustice in that genuinely injured parties could be left without proper recourse/redemption.

    I would possibly go down the route of his Tort hasn't had a big reform (like in property etc) and a lot of it is common law based as opposed to legislation. Also the law of torts is widely interpreted on the "reasonable man" and assessed objectively.

    Just the last few months the Judicial Council Guidelines have come into place so i would mention that in line with compensation for plaintiffs and likelihood of reduced awards and claims going forward etc.

    Sorry I cant offer more of an insight.

    Not to panic anyone but AP, easements, finding and I don’t think a q on mortgages was on the March paper. One of them surely has to come up this time.

    I’d add the essay on influence of equity on land law…but I would be careful as I think the property paper has become less predictable.

    To be fair, property is fairly predictable! Surprisingly, neither easements nor adverse possession came up which are normally extremely common. Succession always comes up twice! Wouldn’t be far away with them predictions!

    The ones which we were advised to have excellent and detailed knowledge were -

    • Excellent Knowledge -
    • General Negligence - Duty
    • Product Liability
    • Nuisance
    • Professional Negligence
    • Defamation
    • Duty of Care, Problem Areas - Most importantly Nervous shock, affirmative duties and public authorities.
    • Detailed Knowledge -
    • Passing off
    • Occupier's Liability
    • Vicarious Liability
    • Trespass to Person
    • Duty of care - Economic Loss
    • Limitation of Actions
    • Damages

    Personally, I am not covering damages as it came up the last paper and doesn't tend to repeat, also limitations is very hit and miss so if you don't have time to cover it I would sacrifice this too and also economic loss came up the last sitting so may be likely one of the other duty of care issues.

    Also, defamation is only ever one question so if you are strapped for time it comes up a lot but up to yourself! Hope this helps

    I think the examiner is purposely throwing a few curveballs in so I wouldn't be surprised if there are a few unexpected moves - perhaps only one questions on succession (which has happened before). My thoughts were maybe there would be an intestate question.

    From the March 2021 paper though, Licences & rights of residence came up in two separate questions in the form of a note on Bare and Contractual licences and a problem question on estoppel. She also had an essay on Landlord and tenant and as that only ever appears as an essay I would gamble on it maybe not coming up again so soon.

    Hopefully AP makes a return though!

    Yeah, only two left now but Iv worked full time throughout all of them. Would obviously be a lot easier if off but plenty of people pass them all while working as well

    Regarding company law - I am a bit unsure of what to leave out and I would appreciate feedback from anyone who has done/is doing company. I'm working out of the city colleges manual. Would I be okay with leaving out:

    • Disqualification of directors
    • Maintenance of capital
