    Do you guys think Burke v AG (homeschooling, LC predicted grades case) is a possibility for the case note in in Constitution or no? Not sure what the criteria for predicting that Q are?

    Reading through exam papers today to get a feel. Came across this from him;

    "The same principle applies to any expectations which candidates might have that matters which are newsworthy or politically topical are more likely to come up on the exam. That is not the case. In previous examiner reports, I have indicated that students need to be aware of recent legal developments. This comment was based on the fact that, at the time, many candidates appeared to be relying on notes which were years out of date. Candidates are expected to be aware of very significant recent developments in the courts, i.e., any major High or Supreme Court decisions from the previous 12-18 months. That does not mean, however, that the fact that something is in the news – such as a referendum or Presidential election – makes it more likely to be on the exam."

    For my own part I’ll be doing all the topics from what are hopefully the four guaranteed questions and then (c) and (d) from the second category, which will hopefully be enough. Of course, this is just my own analysis of the trends but I think they all hold true. Best of luck everyone!


    Would trusteeship not come in the almost guaranteed section? At least one question per paper for the last 11..

    You’re completely correct, mea culpa. If anything, it is likely to come up twice in a lot years. Didn’t feature in my head because I decided not to do it.

    Anyone have any advice in answering charitable q which includes the Cypres doctrine? how to spot if she wants us to talk about cypres?

    also in regard to cypres only applying to a valid charitable trust which fails can anyone explain why the valid charitable trust initially fails? (feel really stupid asking this but i want to be clear)

    I think a charitable gift initially fails for example in a situation where the donor leaves a gift to a charity that never existed or a charity that existed at the time of making the will but is subsequently wound up before the donor dies. Basically, there was never a chance of it being able to be applied to the original charitable purpose!

    Also, if she wants you to talk about cy-pres I feel like she will specifically say something in the question like John made a gift to X fund, but X fund was never established.

    Idk if that is helpful or more confusing lol.

    Lingham v HSE - Updated the first part of the test. Need at least a strong case

    Also - the Merck, Sharpe & Dohme recent case has changed the test in that it now incorporates the adequacy of damages into the balance of convenience assessment

    It's actually one of the higher pass rates - I think around 70%

    Don't worry it's personal preference, a lot of people struggle with equity and get on fine with other subjects

    It's just that equity is one of the shorter courses imo, contract & company aren't too complicated but there's just a lot to them

    I’d say that’s more than enough, I’m doing constitutional Wednesday so leaving out privity and certainty and don’t think I’m going to have time for terms / interpretation either, so you should be set!

    Can anyone clarify what happens when there is an automatic email? For example in Oct 2018 Q1 with Paula buying the playstation online and getting the automatic email saying it was accepted. Is this proper acceptance or what cases/legislation say that it isn't?

    I have a constitutional grid up to Spring 2015, does anyone have a more up to date one, even to 2018 or whatever?

    I have lots of material/grids for prop, contract, equit, const, company, and tort myself if anyone need something please do pm.
