    What are people focusing on for constitutional?


    I would love to know this too! what I have/am planning on doing is:

    for essays: The president, interpretation, AG, general SOP, art 38.1, referendums, duty to give reasons

    then just general topics I have are: non delegation, international relations, oireachtas, Judiciary/art34.1, proportionality, privacy, access to courts. property, religion, FOE, assembly/association, family/children, fair procedures and if i have time right to life/die

    I dont know if this is enough or a good mix? drowning a bit with constitutional tbh:(

    Does anyone have any predictions for the note Q in Equity... I'm thinking the rule in Strong v Bird and Satisfaction. What are peoples thoughts???

    Do you guys think Burke v AG (homeschooling, LC predicted grades case) is a possibility for the case note in in Constitution or no? Not sure what the criteria for predicting that Q are?

    A possibility for sure, but that case might even be too recent to make an appearance imo.

    I assume you’d need to know the Tuohy test as well, or at least recognise Heaney isn’t the only test

    Has anyone ever applied for a copy of their script after a recheck? I have just been sent mine and the only additional writing is the same overall grade on the cover page of the booklet. They didn’t even mark each individual question again. I fully accept my mark but I found this a bit annoying given how high the recheck fee is and all I get is one number. Anyone have a similar experience ?

    At a minimum you'd also need the Tuohy test
    Even for a PQ, you should mention both. Heaney is the more commonly applied one, but the Courts have said that both are correct and they do still apply both

    I wonder would anyone be able to give me their thoughts on this list? is there anything I should add or anything like that? defo stretched thin with this subject but i am fully open to suggestions!

    Anyone have a plan for the fair procedure essay on the duty to give reasons since Mallak? I have that case in my notes under Duty to give reasons in administrative decisions But I don’t have anything on how it changed approach or anything?
    Also could you discuss duty to give reasons of judges decisions ? I have loads of cases on this topic but haven’t a clue what I’d put into that essay

    Is there anything almost guaranteed in equity, some things to focus in on?? Obviously injunctions come up on every paper but there's not much of a pattern as to what will pop up. Grids show me it's such a mixed bag and I don't know if I can afford to whittle down the topics much.

    From my cursory understanding there’s about four seemingly guaranteed questions from three categories of topics:
    (1) one question on injunctions (my guess this year will probably be quia timet or mandatory?);
    (2) one question on charitable trusts (plus purpose and cyprès in either here or below at part c); and
    (3) two questions from either undue influence, estoppel, or specific performance (with rectification). My speculation would be probably undue influence and specific performance this year.

    That’s what I can make out from the topics as being bankers anyway.

    There then seems to be at least another four general categories of questions from where we’d likely get our fifth question:
    (a) either resulting or constructive trusts (sometimes the former is mixed with another topic as in March I think with secret trusts?);
    (b) trusteeship and/or tracing (either in a question or as a note, the latter seemingly almost every second year so perhaps due an appearance on Tuesday);
    (c) a note style question (the most common I can see are the Rules in Strong v Bird and Hastings-Bass [more often than not those two appear together], satisfaction/election/, unilateral mistake or something from charitable trusts); and
    (d) express trusts (DMC, secret trusts, and 3 certainties, the latter of which hasn’t appeared in 3 years).

    For my own part I’ll be doing all the topics from what are hopefully the four guaranteed questions and then (c) and (d) from the second category, which will hopefully be enough. Of course, this is just my own analysis of the trends but I think they all hold true. Best of luck everyone!
