    Paid the parking meter, it was covered up until 1631

    I'm not making excuses, I was late back to my car, had the two kids with me (both under 3)and through one thing an another was late back, plain and simple.

    NCPS must make a fortune at this lark. €90 release fee, plus another if paying by card.


    I'm sorely sorely tempted to get out my bolt cutters tbh.

    Cut or pay AH?

    The system didn't beat you. The system caught you as it is supposed to do. You were illegally parked. Kids are no excuse. You were late back and old enough now to know the rules and the repercussions of breaking them.

    As previously discussed, I had two small children with me today, which was extremely lucky for the clamping company. Had they not have been with me, I would have gotten that clamp off. The trade I'm in, I'd have had no bother acquiring the tools needed to get it off that's for sure.

    First you advocate illegal action but talking about removing the clamp. Then you think parking without sufficient fee paid is not illegal parking? The clampers are acting within the law and on behalf of the law in clamping vehicles parked, like you, illegally.

    You need a large dose of reality.

    Consumer contract
    A further problem for private car parks is the operation of consumer contract law when a motorist enters a car park as a consumer to purchase parking. The motorist reads the signage stating that clamping is in force for vehicles without tickets,purchases a ticket and parks – but returns after the time indicated on the ticket has expired. In such a situation, the motorist is not a trespasser and has not consented to his vehicle being clamped, but rather
    has entered into a consumer contract to park, which has expired. The car park in such a scenario is entitled to a quantum meruit claim for the additional cost of parking rather than the deterrent type fees normally charged to de-clamp.
    A large deterrent fee – even if agreed to by the consumer through reading
    the signage – is a penalty fee and unenforceable, unless some relationship can be shown with the damages suffered by the car park through the overstaying motorist. A penalty fee rather than liquidated damages is void under the common law and is regarded as an unfair term and, therefore, unenforceable under the European Communities (Unfair Terms in Consumer Contracts) Regulations 1995 (SI 27 of 1995, schedule 3, article 1(e): “requiring any consumer who fails to fulfil his obligation to pay a disproportionately high sum in compensation”.

    I'd look into taking them to the small claims court.

    Disclaimer: I'm not a solicitor and the above is just my understanding of consumer law.

    I'm not so sure NCPS have the lawful authority to clamp a vehicle, I am open to correction on this, but they seem reluctant to take anyone to court who has forcibly removed clamps.
