I must say this story caught my interest earlier.So he was brought in for lying about being a doctor.Then charged with rape.Awfully sad to see his gf had advanced cancer because of his lies.

What do ye make of it?

No, it's just I didn't hear, either on the news or read in that why it was rape.

Maybe because she only agreed to sex as she thought he was a doctor, I dunno.

I just don't see how rape factors in.

I would imagine it's due to the 'invasive procedures' that he carried out on the girl. It doesn't have to be penatrative sex to be counted as rape afaik

It does have to be penatration to be counted as rape otherwise it is counted as sexual assault, that's the law.

this happened about 12 years ago.
my friend and her boyfriend went to cork for the weekend,condom burst so she went to doc next day for m.a.p. he asked did she ever take it b4,(she hadnt)he then said he had to carry out a procedure and gave her an internal,she didnt know any better and thought this was routine!

Yep.

Rape is the penetration of the Vagina by a penis without consent. Anything else is varying forms of Sexual Assault. e.g. A woman can never be convicted of "Rape" other then as an accessory. But obviously can be convicted of varying forms of Sexual Assault. (Also, there is another crime known as "Rape under Section 4" which is probably what is being referred to here)

Also, if she consented to having sex with someone claiming to be a doctor it's still OK consent because she consented to the physical act being carried out, even if it turned out to be based on a false pretence (there are cases on this point). The only way I can see how your man could be convicted of rape would be if he told her that it was a form of medical treatment (i.e. she consented to a medical procedure and not sex) or she can prove that the only reason she consented was because he was a doctor and nothing else, very very very hard to prove and probably wouldn't stand up in court anyway.

So in this case she must have had sex without consenting to it at the time for your man to be convicted. i.e. the usual type of rape that everyone associates with the crime, being forcing someone to have sex against their will and not a technical type of rape, i.e. where consent can be nullified.

My cousin was sharing a house with this guy when he was arrested. He told my cousin that he wanted to be a priest!!
