    Watch out for Komplett

I purchased a Faulty QNAP NAS purchased from Komplett

It was delivered 2 weeks ago while I was on holidays, when I opened it up on Sunday night it was "DOA", I spent 2 nights trying to sort it out

Now I'm being told it's not DOA, because it was not reported within 7 days, it has "developed" a fault and will take up to 9 weeks to sort it out

This is the quote for Komplett service rep "Please note that RMAs can normally take between 2 – 3 weeks to process depending on factors such as, the nature of the fault and the age of the product. Also please be aware that repairs can take up to 6 weeks."

Simple really - send it back with a letter setting out your position. That is was DOA and that it took you 7 days to inspect. That will count against you more than likely. That aside given you've had it for less than two weeks give them ten working days to resolve the issue by repair or replacement. Inform them that is that hasn't happened you will reject the goods and repudiate the contract under the 1893 Sales of Goods Act as amended by the 1980 Sale of Goods and Supply of services act.

Then issue small claims court proceedings.

Yeah, I've bought a GPU off them before and had no problems. Think I'll be going with them for all the parts of my next build (they also stock stuff I want that HWVS doesn't).

Took about six working days, but I went for bog standard shipping. Be warned; there now seems to be extra charges for paying by credit card or PayPal - I don't remember these when I ordered last year!

ill be doing payment in advance, so I should be grand

Now to decide between the Vengeance C70 or 600T

I had the heart set on the 600T but after been told about the C70 it really is a cool case

Really bad idea. I'd be wary of any company that charges extra for cc or paypal. If you buy internationally you have zero protection if a company folds or flat out scams you unless you are using a credit card or paypal.

iv used it with hardwareversand numerous times

Alot of companies charge extra for cc, just look at ryan air

Overclockers have just posted a price drop for AMD 7xxx series of cards (not the 7970).

Makes me cry a little inside as I put an order in for a 7970 a few days ago.

A straight conversion between the card I ordered (7970, €395) and the 7950 they posted is around a difference of €90

HWVS have a 7950 now for €300 not bad! Hopefully this will force the 660Ti to around €275

Wonder if I can send this back (... when it finally arrives) and go for the 7950 again... 90 euro is a lot for what the difference in performance is

Under distance selling regs no reason you can't. I'm still trying to find out if you're even responsible for carriage charges.

  • Registered Users, Registered Users 2 Posts: 535 ✭✭✭Saadyst

Well they haven't confirmed they have received payment so I can just ask them to sub it out for a 7950 I suppose... and they can refund me the difference. I'll mail them now :D

Most retailers (even amazon) make you pay for the shipping back, but otherwise retailers have to refund the full amount (including shipping costs to you) under EU law.

Thanks N64 - there seems to be some confusion on this point. I appreciate the link but I need to find a primary source.

Seen as it's just a change of mind by the consumer i don't see why he/she wouldn't be responsible for return postage as per the regs?

Could you link where - I'm revising at the mo so dont have chance to go search - I will be next week but I've had a doubt place in my mind by something in Enright: Principles of Irish Contract Law

I was just going by what is in the S.I. with regard to distance selling. My background isn't in consumer law so I could be wrong to interpret it the way I have.

    EDIT:

    6. (1) There is an implied condition in a distance contract that -

    (a) the consumer has a period of 7 working days in which to cancel the distance contract without giving a reason, and,

    (b) if the consumer exercises that right of cancellation, he or she shall not incur any charges or penalties for so doing except the direct cost of returning the goods.

    Section 6(1) a+b
6.(1)     There is an implied condition in a distance contract that -

    (a)      the consumer has a period of 7 working days in which to cancel the distance contract without giving a reason, and,
    (b)      if the consumer exercises that right of cancellation, he or she shall not incur any charges or penalties for so doing except the direct cost of returning the goods.

    and

    Section 7(1).

    7. (1) If the consumer exercises his or her right of cancellation in accordance with Regulation 6, the supplier shall be obliged to reimburse any sums paid by the consumer without deduction of costs, interest or penalties (other than the direct cost of returning any goods).

When you're reading about how a security guard can deliberately burn a factory down and the employer is able to rely on an exemption clause to avoid liability you being to question even the most logical of conclusions.

Photo Production Ltd. v Securicor if you're interested :D

anybody order anything from dabs recently? - Reason I ask this is because my package is stuck as "International hub - Received and processed" status for the last day.

Usally its only at this status for less than a few hours. IIRC, its the status that comes up just before the package is sent to Ireland on a plane. Perhaps there is a backlog? Knowing my luck, I bet the courier crowd has lost it, but I will just have to wait and see I guess :p

Hey guys, while im delighted with my new MSI 660ti and seeing a huge performance boost over my old hd 6950 im kind of wondering if i should have gone with a 7950 incase i decided to buy of those high res korean monitors?
While i understand the 7950 would be better at such high res will my 660ti do a sufficient job?

Ill scour the net later on for benchmarks, just wondering if anyone had any thoughts.

Edit : Benchmarks from Tomshardware and a few more suggest it will be fine
