Hi all! We have been experiencing an issue on site where threads have been missing the latest postings. The platform host Vanilla are working on this issue. A workaround that has been used by some is to navigate back from 1 to 10+ pages to re-sync the thread and this will then show the latest posts. Thanks, Mike.

    I have nothing, No link for the practice yesterday or two weeks ago, no username or password to log in next week, no email from anyone about anything except to say I am registered.

    This will be my last three so I'll crack up of I can't get them done

    I got mine from OPW last week..they're still open but they only take orders by phone not online anymore. on top of that, they are only open Tues-Thurs @ 10am - 12pm.. Idk if this is helpful, but just thought everyone should know if they havent yet

    QUESTION EIGHT
    Rachel suffered a serious injury as a result of negligence of a driver who crashed into her parents’ car. The medical advice is that she will suffer long-term consequences and will require expensive medical care for at least 40 years. It is unclear how much these costs may be but they have been loosely estimated at €500,000 per annum (or €20m over 40 years).
    The driver was insured so that there are, in principle, funds available to discharge these costs.
    Rachel has initiated a claim in negligence before the courts. Before her case is heard, the Oireachtas enacts the Capping of Insurance Costs Acts 2020.
    Section 1 of the Act provides that it applies “to all actions currently in being and subsequently initiated before the courts”.
    Section 4 of the Act imposes a maximum cap on damages in a claim involving personal injuries of €10m.
    Rachel’s guardian has asked you for the legal advice as to whether there are grounds of Irish constitutional law upon which she might challenge the Act, Advise her.

    I'd definitely look at Buckley v AG, State (O) v O'Brien and State (McEldowney) v Kelleher for SOP caselaw on this q I have notes on these if you need them just pm me

    for a problem on duty of care in tort am i right in saying you'd talk about the test set out by Glencar which reitered the test set out by Caparo and then go through forseeability (case Breslin v MIBI) then Proximity (shrinkwin , Fay case) policy factors and then fair just and reasonableness to establish if a duty of care exists or am i missing anything? or would that all be too much is theres a couple of issues ?

    Cast a wide net in Constitutional and Tort - these questions feature a lot of topics.

    Someone sent me their Tort paper from March with their answers for feedback and I would say there wasn't a problem question with fewer than 4 torts.

    With at least that number of constitutional issues to discuss in ~30 minutes, you don't have much space for discussing the history of the concepts as people tend to do - just write down the advice you'd give Rachael.

    She can challenge the Act on the basis of incompatibility with the constitution on the following grounds...1, 2, 3, 4... Give the most pertinent one the most amount of time, the least to the less applicable one.

    The lion's share of the points go to identifying the issues in a problem question then getting your advice right. Doesn't have to be Senior Counsel level of advice but it needs to make sense in line with the law you base it on. Don't write out passages of legislation or cases. Make sure you are concise given what you've to deal with in the time.

    Thank you! I emailed them today and got an automated response saying they closed yesterday in line with restrictions. It had completely slipped my mind until this morning hence why I'm so last minute. Might call them to double-check now that I know they've been taking orders this week!

    I'm doing property and contract so ideally I would have all four of these:
    - Succession act 1965
    - LCLRA 2009
    - Sale of Goods Act 1893
    - Sale of Goods and Supply of Services 1980

    I did contact someone selling them on adverts.ie but I have yet to receive a response.

    Yes, as above. Also just a general tip that any time a question involves someone's money it's useful to look at property rights. Is it a proportionate restriction? Might even come in as a very small part of a problem q.

    Hey, if anyone doing EU this sitting or any EU enthusiasts in general wouldn't mind providing a quick steer it would be much appreciated.

    The following is what I am covering and my question basically is; do I have enough done to leave out Free Movement of workers/EU Citizenship? I understand its a personal preference kinda question but if anyone feels that its a no go then I would be eternally grateful to hear.

    Sources of EU Law
    Direct Effect/State Liability
    Judicial Review
    Free movement of Goods

    I did it in August and I left out workers/ citizenship.
    As far as I can remember I did the exact same as what you have there, but I also added general principles.
    That's what I remember off the top of my head, but August feels like a lifetime ago now so maybe someone else can weigh in too

    I think the 50/50 topics, like workers and citizenship are going to be hard to be really hard to predict this time since this is the 4th paper the examiner will have set this year. Sources really isn't that popular with this examiner.
    You most likely have 4 questions there in this 6, but you might struggle to get a 5th if an essay on institutions of JR throws a curveball.

    I did a prep course and the lecturer pointed out that for JR the Q is always the same, it's always on the difficulty with direct and individual concern (and then you should also discuss the change made by Lisbon Treaty).
    For an essay it's usually a quote from UPA, but it's always asking the same thing
    And then it's only been a PQ 2 or 3 times, but it was the same issue - so you could still use your prepared answer on direct & individual concern

    Hotspot from your phone if you can. It worked fine for me for the mock.

    That's so stressful!! I'd say try your hotspot on your phone for a few hours today and see if it works for you
    Is it back working now or is it completely gone until Wednesday? You might want to consider if there's any one you know who would let you use a quiet room in their house on Wednesday for a few hours if it comes to that


    Edit: It could also just be the weather today, it's very stormy out so maybe when that clears up your wifi will be okay

    If there was a power outage even for under a minute it can cause your modem not to work (even if the light comes on). I was lucky to have a spare modem....maybe you could borrow a neighbour’s to check? Might have to be virgin as well.

    Your phone bill could be crazy using your phone as a hotspot between now and then so could be cheaper to get one of those mobile broadband things. I think 3 is the cheapest but don’t know about signal.

    Also find out how the phone signal for whichever network you choose works (Eg 3 in my area requires electricity and broadband to the aerial on the mountain. Vodafone usually works without either).

    If you have someone in your family or a friend who can deal with it and take the stress away from you all the better too! Feel so sorry for you

    Thats more than enough particularly if you have covered them thoroughly. There isn't one past paper where you wouldnt have 5 questions with those topics covered.

    Hi all, hope everyone is getting on ok with the study this weekend - even more nerve wracking than it usually is with the first online sitting looming!

    Sorry if this is being asked already but I haven't looked at the better examinations page since the first mock and just checked and noticed none of the 3 exams I'm due to sit are there and it says I have nothing upcoming... just wondering if this is an error on mine or if they aren't showing for anyone yet?
