Is pinching someone's butt sexual assault?

    First I am a bloke. I have never pinched anyone's butt nor do I condone it. I have had my butt pinched twice by women on a hen's night out. No big deal. I appreciate it is different for a female and it happens more frequently . I would say that it is down the scale from groping someone or feeling their breast. So is it sexual assault?

    Irish Statute book says indecent assault is sexual assault since 1990. So I'm guessing yes is the answer to OP

    Ive had it on a bus and I was raging with him it was really not appropriate and shouldnt be acceptable by either men or women.

    It's on the lower end of the scale but it is assault if someone, male or female, puts a hand on another against their wishes.

    Now with the topic at hand.. I think it largely depends on the circumstance. If you don't know the person, then it certainly disrespectful.

    Legally yes-- and also morally, in my opinion.

    This country has a terrible attitude about non-consensual touching. When a woman does it to a man, it's "Sure he should be delighted" and when a man does it to a woman, it's "Sure that's normal, and boys will be boys". Touching someone without their consent is wrong, especially in a "sexual" area (bum, breasts, genitals).

    Don't put your hands on someone's bits without their consent. This should not be a hard edict to follow, and social pressure should be brought to bear on those who do otherwise instead of making excuses for it and encouraging them.

    Not disagreeing with you but has anyone been charged with pinching someone's bum and, if they have, what was the penalty? (Btw, as a male, if a bloke pinched my butt, I would be extremely offended)

    I remember a thread a few years ago when a guy was either fined or jailed for following a girl and slapping her on the butt. I don't think it's the kind of thing that goes before the courts much though.

    Yes it would count as sexual assualt. And I'd say most people would respond in a fairly frosty manner, but at most I could imagine it leading to a bouncer kicking you out of a club / pub. I can't imagine most people being so put out that they involve the guards.

    Assault.

    2.—(1) A person shall be guilty of the offence of assault who, without lawful excuse, intentionally or recklessly—

    (a) directly or indirectly applies force to or causes an impact on the body of another, or

    (b) causes another to believe on reasonable grounds that he or she is likely immediately to be subjected to any such force or impact,

    without the consent of the other.


    (2) In subsection (1) (a), “force” includes—

    (a) application of heat, light, electric current, noise or any other form of energy, and

    (b) application of matter in solid liquid or gaseous form.

    (3) No such offence is committed if the force or impact, not being intended or likely to cause injury, is in the circumstances such as is generally acceptable in the ordinary conduct of daily life and the defendant does not know or believe that it is in fact unacceptable to the other person.

    (4) A person guilty of an offence under this section shall be liable on summary conviction to a fine not exceeding £1,500 or to imprisonment for a term not exceeding 6 months or to both.
