How many appeals are they going to get I wonder?

No matter how many it is, it won't change the fact that it's not their house any more.

I couldn't give a monkey's who's house it is or how many appeals they get, as long as it costs that wretched bank a king's ransom and sends at least one of the directors to the rubber-room. :D

I am sick of reading about this Family and their many travels through various Courts.
They seem to be making a complete mockery of the process every time.

Pending appeal, then leave to challenge the results of that appeal, then another appeal.

It'll be a long time before they have to leave that house.

Are they representing themselves or are they forking out for a legal team? And if the latter -where is the money coming from?

He is, but different kettle of fish in the supreme court? It is a bit like me 'working in IT' turning up at Intel R&D labs and asking them to let me have a go!!

I'd say Johnny Taxpayer will be the one footing the bill for all this sh*te, if it ever ends.

I wonder if his plan is to just appeal indefinitely and hope that the bank get annoyed and drop it.

At the end of the day it's a numbers game and if the bank see the costs piling up they might decide to cut their losses. Not sure where O'Donnell's funds are coming from though.

How can they appeal to the Supreme Court after it has already ruled against them?

  • Registered Users, Registered Users 2 Posts: 5,103 ✭✭✭mathie

Brian and Mary Patricia O'Donnell have lost their High Court appeal against their eviction from Gorse Hill - but a further appeal to the Supreme Court could grant them another two to three months in the Killiney mansion.

More appeals? Are the judiciary reluctant to kick out one of their own?

I've said it before, but I find it baffling how any one person can owe anyone or any institution that much money, its insane. And the fact this bloke has the gall to drag it out long as possible like he has some defence of what he's done, so he shouldn't have to leave.

Profligate banking practices, money creation by way of debt*, lax regulation and socialisation of losses tends to do that.

I'd be more than happy to help him pack his bags.

The appeal is on a point of law not a de novo appeal where everything starts again.

Could potentially be an appeal on a point of EU law but I doubt it.

I must say I don't understand this case at all

    1. The Supreme Court rules that the bank are the owners.

    2. An eviction notice served

    3. It is appealed to a lower court (even though the SP has given their ruling)

    4. The appeal is refused.

    5. A new appeal is being considered .......to where? yes, the Supreme Court

anyone able to explain this in laymans terms?

Will the bank nail him for legal fees? though I presume he's already transferred all his assets to his children and will declare bankruptcy in England once he gets bored of dicking the bank around.
