I am sick of reading about this Family and their many travels through various Courts.
They seem to be making a complete mockery of the process every time.

I wonder if his plan is to just appeal indefinitely and hope that the bank get annoyed and drop it.

At the end of the day it's a numbers game and if the bank see the costs piling up they might decide to cut their losses. Not sure where O'Donnell's funds are coming from though.

Brian and Mary Patricia O'Donnell have lost their High Court appeal against their eviction from Gorse Hill - but a further appeal to the Supreme Court could grant them another two to three months in the Killiney mansion.

I've said it before, but I find it baffling how any one person can owe anyone or any institution that much money, its insane. And the fact this bloke has the gall to drag it out long as possible like he has some defence of what he's done, so he shouldn't have to leave.

The appeal is on a point of law not a de novo appeal where everything starts again.

Could potentially be an appeal on a point of EU law but I doubt it.

1. The Supreme Court rules that the bank are the owners.

2. An eviction notice served

3. It is appealed to a lower court (even though the SP has given their ruling)

4. The appeal is refused.

5. A new appeal is being considered .......to where? yes, the Supreme Court

Will the bank nail him for legal fees? though I presume he's already transferred all his assets to his children and will declare bankruptcy in England once he gets bored of dicking the bank around.

Say if an average Joe were to be in the exact same situation, would they ever be given as much leniency as these people have been receiving?

It's actually not that baffling at all. The celtic tiger is a perfect example how one person (or a government) can owe so much money. It's a simple case of borrowing money that doesn't exist and spending it. When you're promised that a million euro loan isn't a big deal because you'll make it back ten times over, it's human nature to take the money. And you're right, it is insane but the burnt hand teaches best. Except in this clowns case. He must be seriously deluded to think he is in the right in this case but I suppose that's what money does...

The Supreme Court only deal with points of law. It's been bouncing around the High Court in relation to various injunctions and orders. The piece linked looks like it was written by a law student describing the Campus Oil test.

no, such charges will be nothing to do with this, but will be to do with the begging boal mentality of the bank who will use this as an excuse.

Rubbish. The banks are losing money on arrears and this costs money which is transferred onto the variable rate lender.

I have an odd take on this, I do think its a joke how much they are wasting court time and money but on the other hand I think if it was me id be digging my heels in and doing anything I could to hold onto it. The fact that they are minted and owe millions make it seem obscene. That said I find it very hard to have any sympathy for them.

Doubt had been cast on his credibility because of his failure to reveal that he earns a £120,000-a-year consultancy fee for managing an office block in London, which had been bought at the height of the success of his property empire, while he had been “evasive” on other issues.

In addition, Mr O’Donnell had claimed all of the couple’s creditors – not just Bank of Ireland and AIB – had been told about their move to London late last year to a house bought in Westminster in London in 2007 for £10 million.

“I cannot accept this. Had it been the truth, the O’Donnells would have copies of the letters and would have exhibited them,” said the judge, while Mr O’Donnell’s denial that he had applied for a renewal of his Irish solicitor’s practising licence was not “plausible”.
