    If you look up the definition of discrimination you will find that for the most part it is down to common sense and discretion. People bringing up lads' night out or all-girl schools are just being difficult for the sake of it.

    Some discrimination IS allowed if there is a valid reason that allowing a member of a certain group would adversely affect the other members, the business, etc. And by business I'm not talking about not letting a black guy into your restaurant because no whites will then come. That doesn't qualify. The majority of services and amenities should be available to all regardless of their age, gender, race, creed or orientation. Only a pain in the arse would complain about not being allowed to attend fucking kindergarten because they were 15.
    There are sex clubs (swinger clubs / resorts) that ONLY allow couples because that is the nature of the activity...i.e. shagging/sharing different sex partners. They don't let in single males because the place would be inundated with horny lecherous dudes who think they are porn stars and would fuck up the mood for the genuine couples. Sometimes these places admit a number of single females who have an interest in threesomes, etc.

    Likewise with gay resorts. The predominant raison-d'etre of the resort is for gays to interact (read: shag) with one another. I'm sure lesbian resorts don't allow men.
    Discrimination occurs when people are excluded from a group where they would otherwise be admitted but for a specific characteristic that they have no control over.

    If a woman is excluded from an all male (gay) resort then it's not discrimination based on gender as far as I can see. If a gay man is excluded because he's black then it IS discrimination.

    Getting back to the original ad. A lot of people claimed quite confidently that the owner of this villa/holiday had the right to discriminate against who stays there since they are the owners ("their house, their rules"). Well I don't think it quite works like that. I got this list from the Australian .gov website regarding discrimination in renting and is states quite clearly that it is against the law to discriminate against someone based on sexual orientation when renting accomodation:


    When renting out a property, a landlord or owner has the right to choose the most suitable applicant. These decisions may be based on factors such as an applicant's rental history.
    However, it is against the law for a landlord or owner to stop somebody from renting a property, based on certain personal characteristics. In Victoria, it is against the law to discriminate because of actual or assumed:
    • age
    • carer status, family responsibilities, parental status
    • disability (including physical, sensory and intellectual disability, work related injury, medical conditions, mental, psychological and learning disabilities)
    • employment activity
    • gender identity, lawful sexual activity, sexual orientation
    • industrial activity
    • marital status
    • physical features
    • political belief or activity
    • pregnancy, breastfeeding
    • race (including colour, nationality, ethnicity and ethnic origin)
    • religious belief or activity
    • sex
    • personal association with someone who has, or is assumed to have, one of these personal characteristics.

    Now I don't know specifically the corresponding laws are in Spain but since it seems to be a very 'gay-friendly' country I can't envision the Spanish deviating from the above. Of course the age thing will cause a lot of people to howl "no kids policy", but what can I say.
