Payment recieived placed on hold paypal

I sold a phone and the money has been placed on hold, buyer says he never received it though i have a tracking code which says it has been signed for,

Sounds like he's trying to pull a fast one. Send PayPal the proof of delivery. Also, if this was sold on eBay and you are a new seller, PayPal hold onto your money for 21 days to protect the buyer (and probably eBay too).

He said he never received an i6 (even though i sold a different phone to him) it was on donedeal, and that he sent me multiple messages which i never replied to (he didn't)

It's worth sending PayPal the proof of delivery and emails between you and the buyer if possible. Makes it more awkward if deal was done through phone/text message though. If you can do a screenshot of your ad so they know it's not an iPhone 6 that you sold him, as much information you can gather will all help your case.

Also the address he gave me was not his paypal verified one, i believed him as he had a lot of good feedback, will i automatically lose the case then since i mustn't have paypal seller protection ?

If you sent it through registered post which I assume you did. They would've asked you a value for insurance if you gave the correct value then it should be covered if the intended recipient didn't sign for it.

yes it was signed for but a different name did so, i thought that was only if it was for the wrong address and not the wrong name for the signature?
Will the Gardai be able to force paypal to give me the money if i have all the needed evidence?

Well if it was addressed to someone and someone else signed for it the I'd assume an post are answerable. Did An Post provide any more detail of the person that signed for it. Does the buyer recognise the name of the person that signed for it? You've done everything you possibly could to ensure delivery so I can't see a reason for not being paid.

You might have to make an insurance claim and refund the buyer though if it is covered.

I know he's a scammer so no point talking to him, yes i got his surname, and first name initial, he probably put a fake name on paypal, an post said it was delivered to the correct address so i can't get a refund they said, even though wrong person signed for it.

I suppose that makes sense in so far as you could send it to your mate and he signs a false name and you claim on insurance.

I'm not sure where you'd go so op that's a crap situation to be in.

I just checked and the address isn't even real (the first line is a fake address), if i showed this to paypal would they side with me, or is for confirmed address only, even if the address is fake?

If you are the sender of the item you can. The contract is between An post and the sender.

I wanted to confirm as I called them and they said it was delivered to the correct address and that i can't make a claim due to that, though the buyer has said he never recieved it and i don't have proof of his name signing it

Ask them to provide a copy of the signature. Also ask the buyer to look around the house as I have had the postman sign for packages for me and hid them in hedges in the garden, under bins etc.

Registered Post only guarantees that a signature will be obtained when the item is delivered, which may not necessarily be the person its addressed to:

If you want proof of who the item was sent to, then you need a Certificate of Postage, which you ask for when sending the item

From the link you posted, it says - "Recipient signature available online"

From the OPs post, the recipient did not sign for the package, someone else did. So, the intended recipient did not receive the package.

I htink he's a scammer because he's not replying, he must have given me a fake name for that address, and don't have proof of his given name signing it, so he is getting a refund off paypal, which is why i wanted to know if i could get the amount of which i insured it for off an post (it is less than the value of the phone but better than nothing)

Give all the info to Paypal. I have had two claims in the past, all successfully resolved. They give the buyer time to respond to queries which is a little frustrating but you should have it resolved in your favour.

If you don't send the goods to the address that paypal gave you, then you are not entitled to a refund through paypal. The contract you had with paypal was to send the item to the address that they have provided, sending the item to an alternate address at the sellers request is a breach of paypal's terms.

It probably would be in my favour but as the guy below said it wasn't sent to the confirmed address so i doubt they will in that case
