    I'd be interested to know what the milage limit is with the warranty. It's never just a warranty for a period of tie, it'd always have a milage limit as well.
    Chances are with a taxi, it'd be over that mileage limit fairy quickly.
    Coincidental that it's not mentioned anywhere?

    That's a very interesting point!

    So, if it were a private car, it would have 12 months and however many km warranty.

    If it were a taxi, it would have 3 months and however many km warranty.

    Does the garage have to ask the consumer if it will be used as a taxi? Or is it up to the customer to declare it?

    if the customer told them it would be used as a taxi and they still gave him a 12 month warranty (depending on mileage) then I think M&G should pay. If the customer traded in his previous taxi as a trade and they gave him the 12 month warranty knowing this, then I think M&G should pay as they should be aware he is going to use this as a taxi.

    The comments on facebook are very one sided, the family are saying he drove in a taxi, so M&G should have known. So it's not clear what was disclosed.

    If the customer did not declare it would be used as a taxi, signed the contract as a private car, then I don t think they should be liable.

    The fact that the car cost 30K does not make a difference really. It is an expensive Audi that was at lease 2 full years old at time of purchase, therefore out of manufacturers warranty already (Are Audi 2 or 3 year warranty, but not unlimited mileage???). Customer could have had a brand new Skoda Superb taxi model (for example) for in and around 22K. An Avensis probably in and around the same? So the customer opted to buy this already 3 year old car as a taxi. That's his perogative. But surely he knew he was taking a risk that something could go wrong quicker with and older car.

    If I opted to buy a 6 year old Merc might have cost 200K new, but 30K after 6 years and use it as a taxi, then I should only still get 3 months warranty but its quite likely something may go wrong with it and it will be an expensive repair.

    The posts on facebook do have an element of DEY ARE FRAUDSTERS AND CHANCERS and many do not indicate people wiling to listen to reason.

    I find it a very interesting case, because for me it shows the power of social media. It also shows that people will jump on the bandwagon and immediately support the individual against any company, without hearing full facts.

    This item came up on a friend of mine's facebook page, and she shared, passing it on, despite it being clear it would be unable to make a judgement as the facts were unclear. Sharing posts like this are damaging to a business reputation. M&G are in business for years. They are main BMW dealers. Surely BMW would not have dealers who do not honour warranties? Even if it is a used car, they are still bound over by BMW rules.

A year later (without the use of the vehicle which he needed for his work ) he was no further on so he and some family members placed a peaceful picket at the front of the garage on the public footpath. They were there for about 3 days when the garage finally caved in and replaced the vehicle with a new one for free.

    I don't know of any solicitor that fixed a car yet.

    Used to work in another dublin garage back in the day & have been following this with interest :) Strange one!

    Surprised that nobody has mentioned Audi Ireland in this at all but a 3 year old car regardless of where it's sold should not need a new gearbox imo :confused:

    Do they only have a 2 year warranty from new here?

    As long he he has that contract he'll be fine, I'd upload a pic of it to facebook to prove the doubters wrong

    The pic they have up on Facebook has the reg of the car as 10-C-5324. Car is taxed as a taxi according to motortax.ie.

    I presume that once the car is used as a taxi the warranty goes from 12 to 3 months. It's a biit frustrating that they don't put the whole warranty up on FB for us to have a look at it. Warranty also seems to say that the car cost €26,435, not €30,000 but I guess that's maybe a minor issue.

    I'd also expect Murphy & Gunn to have made a statement of some sorts if they are totally innocent, but I guess they could be screwing themselves on grounds of customer confidentiality.

    Either way I get the impression that we haven't heard the 100% story.

    Can I ask what was the mileage warranty.
    It's very strange for any warranty to not include a mileage warranty, even a new car fresh off the production line, will have a mileage stipulation, after which the warranty period is up, if it occurs before the time period.
    Now if they have given him a12 months warranty, no where in the contract he signed mentioned that it only applies to the car being used for personal use and he's within the mileage condition attached, then he has a case alright.

    If he's surpassed the mileage warranty, or it did indeed say in his contract that the warranty is only a 12 month warranty if it's used for personal use, then he's in a tricky situation.

    Why audi paid out may have something to do with the infamous chocolate gearboxes that plagued some of their cars 10 or 15 years ago.

    if Murphy @ Gunn gave a warranty for 12 months they should honour it. Unless of course it was a condition of the warranty itself that using the car as a taxi would void it, or if the fact that it was going to be used as a taxi was misrepresented.

    The rights and wrongs of this should be pretty simple to figure out if the actual documentation was out in the open. And if people are willing to wage a social media campaign against a company they should be fully open with all of the facts.

    There must have been a manufacturers flaw for Audi to pay out, which if that is the case they should be paying the full €7000 not just a portion of it. I know someone who had a similar issue with volkswagen & they had some serious hoops to jump through before they were entertained.
    M&G in my opinion shouldn't have backed down if they sold the car for private use.
    I'm all for people having the right to protest but there is an air of bullying & intimidation from some of the comments on facebook. Which in my opinion doesn't help Dave's case.
    There's a lot of assumptions being made, my own post included, & I really think it would be in the benefit of M&G & Dave to sort this out properly without airing their dirty laundry for the whole country to see.
    Maybe set up a mediation with an independent solicitor both parties are agreeable with & hammer it out like adults instead of waging an online campaign. It really doesn't make either side look good.

    What the € figure on that?

    I can see a cropped picture of what looks like sales agreement that mentions a warranty, but I don't see the warranty itself.

    The company? Not with the data protection laws in this country.

    The company aren't waging a social media campaign so I don't expect them to share any information.
    But there's nothing to stop the people who are waging the campaign to PST the full warranty agreement.

    Is there anything in the contract that you say they aren't fulfilling that makes them liable to pay €7k in compensation?

    Hate to be the one to break it to you but this story will be old news by next week. If someone sees a car in M&G for the money they are willing to pay then they will buy it. If anything they will look for a written explanation of what is covered in the warranty of the car they are buying just to be sure. It may stop immediate family buying off them again but I'm sure they would be expecting that to be the case regardless of the outcome.
