She stopped me pulling out by standing behind the car & as luck would have it a warden arrived.

Is it legal to block someone on purpose like that? Serious question.

Unless there the Gardaí who was going to charge her?

Fair play to her! It wrecks my head when I see lazy tossers parking in disabled spots!... You might think twice about it the next time, although from the tone of your initial post, doubtful!... So, heres to loads more fines ;)

What is even worse. I know a guy whose wife is disabled, but when he goes out on his own he uses the disabled badge. You would think he would know better

As a person using a wheelchair full time my perfect day is when I see an able bodied person parking in disabled parking space, I try to let the air out of two tyres (without getting caught). I have done this a number of times, The driver's of these cars are then parked legally, they now have a disabled car and everyone is happy.
PS amazing how many moderators support the original op.

It's funny - I've often "accidentally" hit such peoples cars with my shopping trolley. It's not illegal if it's an "accident".

You're allowed to physically detain someone if you've reason to believe they've broken the law and have contacted the Gardaí. (Or at least that's what I was told by a Garda after being detained in a club.)

So I'd imagine something similar would apply here.

Great it's not like some people forget to put up their passes when bringing elderly relative shopping who have permits.

A friend of mine who has only one foot drives a sports car. He has his sticker and walks very normally and has his car attacked by "do good idiots".

What's the problem? I said it was an "accident".

It clearly wasn't. Sorry but reardless of your circumstances, you do not have the right to criminally damage another person's property, and like Ray said, how do you know the person is not assisting someone else?

It's not criminal damage if it's an "accident". These things happen.

What the guy only has one foot and legitimately has trouble walking long distances. Just because he looks fine and has a nice car he isn't disabled?

Don't people in wheel chairs also do the marathon?

You're incessant use of quotation marks every time you say "accident" would suggest it was intentional.

    http://www.iwa.ie/services/motoring/disabled-parking-permit-scheme

Permit Car Parking terms and conditions

In Ireland the Parking Permit enables the permit holder to park the vehicle in designated on-street accessible parking bay free of charge for an unlimited duration unless otherwise stated.
Generally, all street parking spaces or local authority car parks provide parking at no cost to the Permit holder.
The terms of the scheme do not cover private car parks, however, in practice the majority of private car parks recognise the Disabled Parking Permit as the basis for eligibility to park in the accessible spaces.
The Parking Permit does not entitle the permit holder to park in bus lanes, loading Bays, clearways, single or double yellow lines or any other restricted area.

That explains the scheme. Its doesn't explain anything about the legality of a wheelchair marked space on a private ground, or public space, (if there's a difference). Does a wheelchair marking mean anything on private ground?Even if its a private car park you'd be governed by their rules. So you can be clamped/fined for parking in certain areas, like a wheelchair space. Depending on their rules.

So where are you getting the idea you can park in a wheelchair spot if no where else is free. You seem to have plucked that from thin air.

    http://www.dttas.ie/press-releases/2013/varadkar-publishes-draft-laws-regulate-clamping
Local authorities around the country operate a strong policy of enforcement regarding spaces reserved for people with disabilities. A fixed charge parking fine of 80 euro will be issued to drivers without a valid European Parking Card who park their cars in disabled parking spaces. In areas where clamping is in operation (Dublin, Cork and Galway), cars parked illegally in these spaces will be clamped and the fee for release will be 80 euro or more.

Private car park operators are responsible for policing the use of designated disabled parking bays in their own car parks and cars parked illegally in these bays may be clamped. Fees for release will vary depending on the operator. Gardai and traffic wardens will not issue tickets for cars illegally parked in disabled parking spaces in a private car park.

Not being able to walk long distances is not normal.

What sports car does your friend drive?

coming back to my original comment, if its a public place, then yes you are breaking the law, and are liable to be fined.

A Supermarket car park is privately owned, but is a public place. The same laws don't apply here as they do in public car parks, such as the one beside a public library, for example.

In a privately owned car park, the wheelchair spots aren't bound by law.

The venom in this thread is unreal!

I don't have anything particularly relevant to add to the thread except that to the person who rams trolleys into cars over a fcuking parking space... if I seen you do that to any car "accidentally" or not, I would be sure to call you out on it. That is disgusting behaviour to cause criminal damage to someone else's property because they are illegally parked. I hope someday your car or some other highly expensive piece of personal property is damaged like you do. See how you feel being on the other end of it.

    Asshole of the highest order.

You should have just said you pulled in without realizing it was a wheelchair spot, and then this woman would not let you reverse out of it. Your word against hers. And then you should have drove off and given her the finger while LOLing

To you who are probably able-bodied thats all it may be! But to someone that isnt as mobile its the difference between being able to go to the shop \ chemist etc and not!

I know disabled ppl that have had to leave without getting their items when all disabled spaces are taken because they are not mobile enough to walk the distance \ go through the traffic from a further space! (granted this instance was christmas week an all the disabled spots were legitimately taken)

Child and Parent spots are a different scenario, I dont really see them as being as important to keep clear.

I rarely see a person parked in a disable bay with a permit displayed get out or going back to a car and actually looks anyway disable in any shape or form.

Can you get a ticket without the warden seeing you stopped/parked?
