    Even an air gun is considered a firearm for the purposes of aggravated burglary. The law does not dintinguish between types of firearms in that situation, and any person found guilty is liable to be convicted for life.

    As an aside, even if it were an imitation firearm, i.e. a toy gun, it is also punishable with life imprisonment.

    There's no reason to believe it was a toy, but I would agree that airsoft guns are not unlikely.

    Is an airsoft gun a fake one that does nothing or does it shoot something harmless or what

    The justice system in this country is a shambles. Judges are far too lenient on repeat offenders and Gardai are fed up and frustrated by the revolving door. These ****ers who terrorised this family didnt turn into animals overnight. They probably have years of criminal activity behind them.
    Free legal aid is another cause for all this criminals being allowed to walk free sometimes without even being charged. I have no doubt from my own experience of being burgled that money and budgets are influencing the DPP when it comes to deciding whether to prosecute or not. FLA should be paid back to the state from dole payments for however long it takes. It's also a shame that there's so many spineless solicitors in this country who take these cases. In my mind they are every bit as bad as the scum who commit the crime. They might as well be part of the gangs as they are aiding and abetting these criminals and using the system to line their own pockets with essentially dirty money. A solicitor with a conscience is as rare as a hen with teeth.
    I'd also like to see the "three strikes" rule brought in. Hard labour would also be a deterrent and I can't wait to see the super prison built although judges will pick on easy targets like tv licence and car tax to justify their existence and undeserved high salaries.

    Dont care what anyone else might think but trash like that threatening to shoot a 10 month old baby with a shotgun arent human anymore, theyre rabid animals and they should be put down for good without mercy like the animialistic scum that they are.

    I think what happened effects more than the kid.

    Did you ever hear of the ripple effect?

    It must be so disheartening for Gardai when absurdly lenient sentences are passed down. Look at how often you hear about guys with 80+ convictions being locked up after committing a particularly nasty crime.

    How many of their man-hours must 80 successful convictions equate to.. only for the scrotes to be afforded leniency and understanding?

    It pisses me off big time.. and I'm not saying that we should follow the mental & paranoid American '3 strikes' system, but a bit of common sense from our judiciary would be nice, though that would require common sense from politicians and the public too.. so not likely to ever happen.

    I fail to see how one could put a gun to an infant's head and threaten the babies life and be nonchalant or insouciant about it afterwards.At some point that thief will have to face his own actions,he may never be caught by the gardai,but he will know what he did,his accomplices know it too.

    An action like that would surely eat away at a man.

    Devils advocate here, but does anyone actually believe that the guy had any intention of pulling the trigger? Because as nasty as pointing a toy guy, or even a real gun, at a baby is, it's nothing compared to actually killing a baby.

    Assuming the safety was on, there's no difference between pointing a real gun and pointing a toy guy if there is absolutely no intention of pulling the trigger.

    It's fcuking horrible beyond words for the parents. I can't even imagine what they're going through and it will probably take years to get over. But no-one was killed.

    Although we have no way of knowing for certain, there's a HUGE difference between pointing a gun at a Baby and killing a baby so we can't assume one way or the other. Although this bit from the story implies that they were very violent but not killers since they did not follow through on threats "They told me to get down on my hands and knees and that they were going to blow my head off. One of them counted to three and then pulled me into the hallway and started beating me again."

    I say lock em up for the maximum sentence for armed robbery and assault breaking and entry and whatever else they can be nicked for. That'll probably keep them away for a few decades.

    The baby is probably fast asleep right now and hasn't got a clue about what happened. The baby is probably the only person in the country who doesn't care. It's the parents who suffered in this.
