Woman orchestrates false rape accusation against her own brother

    She said this was done because she suffered from depression and anorexia and wanted her brother out of the house.

    "I told her a lot of stuff to say, to blame him and what kind of things he did. It took a lot of time to get her to understand, she didn't want to do it.”
    The woman admitted she had been cruel to make her daughter say this.

    A statement written by the accused was read out in court by his counsel, Feargal Kavanagh SC, in which the man said he could not understand the allegations and had always instructed his solicitor that he was innocent.

    The man said at the time of the allegations he had been drinking an enormous amount of alcohol, and could not recall that period of his life with any degree of accuracy.

    "I knew there were days I could not account for as I had been drinking so much. My memory was never good; it's almost non-existent now," the man said.

    The court heard that the man has a mild intellectual disability and has spent time in hospital for mental health issues. He is the youngest of a very large and extremely dysfunctional family, counsel said.

    He said he was "overcome by panic" and in a state of near nervous collapse at the thought of going to prison, and was terrified that he would be preyed upon by other prisoners.

    He said a member of his family convinced him to plead guilty to at least one of the allegations in the hope that he would get a suspended sentence.
    Ms Justice Iseult O'Malley granted the man's application to change his plea, and adjourned the case for mention.

    She remanded the man on unconditional bail, removed him from the sex offender's register and excused him from attending court on the next date.

    I can't believe how someone would do this, let alone to their own (intellectually disabled) brother. What's worse is that I can't imagine our judicial system will punish her is any meaningful way.

    She destroyed her brother's life, screwed up her daughter's and makes it harder for real victim's of rape to get justice.

    Some people are sick f*cks, simple as. She had nothing to gain out of this and destroyed her brother's life and damaged her daughter's as well for no reason at all.

    I hope she's the one that gets thrown in jail, make her learn the severity of calling rape on someone like it's nothing.

    Just give her the maximum jail sentence for the crime she fabricated and put her on the sex offenders register to see how she likes it.

    It's actually distressing how easy an accusation can be made, and essentially end someone's life as they know it.

    Obviously not taking away from the numerous real cases in Ireland every year. The mother/sister should be made to face prosecution, or at least massive compensation to her brother.

    Surprising that the daughter didn't come out earlier with the truth, there's no way that could rest easily on a young person's conscience... YOLO and all that jazz.

    Personally I wouldn't be inclined to lay any responsibility at the young girl's feet. Who knows what way her memories could be distorted and what coercion she could have been under (and who's to say she wouldn't have spoken out eventually) by that mother of hers, who IMO is fully to blame and deserves to go to prison for perverting the course of justice.

    Agree, false claim should be met with max sentence of the crime. Which should go to the mother rather than a girl who was 10 at the time.

    I hope both mother and daughter are dragged to there nearest station and charged ,

    Amazing to think arrested ,charged ,sentenced without any evidence against you

    There is something seriously wrong regarding our judicial system.

    I hope he brings charges against her. That cannot be acceptable to let that so-called woman away with something so mentally damaging for both folk.

    This judicial system here in Ireland makes my head spin 180 degrees, it's a nutcase system.

    The mother yeh, but the daughter was a 10-year-old kid when her mother got her to make the statement. The mother basically did it, just used her daughter as the tool to bring it to fruition.

    I was so appalled when I read this I just had to post this...stories like this really make be loose faith is society and our legal system.

    At no point in this process did anyone ever consider that the child could have lied...it makes me wonder how many other innocent men have had their lives ruined in this way.

    I think the saddest part of this is that, even though the man knew he was 100% innocent, he was willing to plead guilty in the hope he would get a lenient sentence.

    I just can't imagine being in a situation like that

    Was the woman not arrested there and then? So many charges can be pinned on her: Child abuse, wasting police time, slander/libel, wasting taxpayers' money etc. And her excuse? Depression!

    Fabricated rape accusations are so easy for a woman to do, and hard to disprove unless you have a solid alibi. More so if a woman rapes a man.

    I can imagine there are a LOT of people in prison for rape they have never committed.

    Women like these really need to spend the amount of time in prison to the same extent as murder, cause they've ruined people's lives...

    The whole thing is very sad. Not excusing the woman, who I think should be punished for what she did, but there's obviously a very sad background to the whole thing for her to do something as horrific as that to both her brother and her daughter. I really hope her daughter and brother have good support from other family and friends at this time.

    Some people are seriously seriously disturbed and our mental health facilities in this country, despite the hard work of many, are just sadly inadequate.

    FYI false rape claims are actually very rare.

    That is bloody awful.

    Its disgusting for this to have happened.
    That poor man must have been in terrible distress to plead guilty.

    On the flip side stories like this make it more difficult for girls/women who have really been raped to report the crime and go through the process.

    That women should be charges and sent away for a while to teach her a lesson.
