    It's newsworthy because the country is full of idiots and this is the type of story that keeps them chattering away while ignoring the important stuff.

    I slipped in my local a few weeks ago, a combination of a 12 hour bender+ massive high heels. Ended up on the broad of me back and bruised all over.I went down the next day to apologise, being a country pub they said "ah would you ever **** off you stupid hood!" Maybe this thing of suing for falling when there's drink on ye is a city thing

    I love the way everyone here presumes she made the story up just because she was from tallaght.

    The high court will usually make decisions based on policy and what is in the publics interests and would not want the floodgates to open here if she was to be awarded money for falling over.

    She may have had the best case in the world but if the court thought a judgement in her favour would not be in the publics interest then the court can dismiss the case. They wont phrase it this way but they will just say that no negligence took place according to the facts. This is very difficult to disprove after the highcourt as an appeal could cost you a lot more money if you lose.

    No it wasn't.To suggest that non-merited personal injury claims have been a norm in the recent past is false.

    Yes there has been an increase in personal injury/ medical negligence claims over the past 25 years. But only when compared to a long period of time in Irish history where the law was almost completely inaccessible to the poorest people.

    As an example, preventable errors with negative consequences for patients occur in about 4% of Irish hospital cases. However, the number of medical negligence claims is much smaller than this, which sort of destroys the "compo culture" argument.

    All that is happening is that more claims are being taken than were taken 30 or 40 years ago (when people probably should have been taking cases). And this increase - although still less than the rate of damage done - has led to a somewhat misguided belief in an Irish compensation culture.

    Of course you'll always get chancers, but it's not as easy to chance your arm as people believe.

    Fair enough, but almost everyone so far believes its the right decision. I was just pointing out there may have been other reasons which determined the outcome of this case. Either way, i would not like to be in her situation. It was a big risk to go to the high court in the first place, she will be regretting it for a while.

Not a situation I'd like to find myself in tbh.

    Senior Council would have warned her of the risks prior to the case, thats why i am sceptical that this case wasn't as black or white as people think. She may have genuinely thought she had a case. Sadly thats not how the system works though and she has learnt an expensive lesson.

    They have to issue her with a Bill of Costs first before that can happen. She has a right to have the costs taxed. I have my doubts whether they will even give her a Bill of costs.

    I went to a dance once in west cork in the 80's where the old parish priest stormed in and demanded the hall lights be fully turned on

    instead of those "disco lights". Now thats what I call health and safety. DB
