Woman loses claim case after fall in Coppers...ends up paying all costs!

    Great result and a sensible judge for a change. There was a time when cases like that meant an automatic payout. Will see ever pay the costs though? I seriously doubt it.

    Why is THIS case being reported in the news, and not the hundreds / thousands of other litigation cases? It's not for huge money, it's not about "celebrities" suing or being sued.

    Could it be something to do with the slightly sexual overtone of "Copperface Jacks"?

    Very strange choice of news by the national broadcaster . . .

    Not only a hugely mistake on her part but a hugely embarrassing one too with her name all over the news. Sucks for her..

    It could be seen as a very important case in future in compo cases. It's not the facts that are the most important thing but the principle.

    Of course she will, solicitors are experts at "retrieving" their fees from people. If she doesn't pay she'll find herself back in court soon enough.


    Serious question, What happens if she does not have the money to pay the costs ? Do they check you financially before you are allowed pursue the case ?

    My favourite quotes from the article:
    Ms O'Connell and Mr Humphries were engaged in modern dancing "of the kind that takes place in night clubs and which is not easy to describe in terms that make sense".
    The defendant denied liability and also claimed Ms O'Connell was engaged in dangerous and reckless dancing with Mr Humphries.

    In some cases, you can be ordered to post a bond to cover some/all of the defence costs. It'd need to be a fairly no hope case as most recent attempts I've read of by a defendant to stymie a case using this tactic have failed.

    Thanks for that MYOB but in this case the amount is one hundred thousand in costs against the claimant,where she go and get that ?



    maybe she will have to dance for it :P

    But this case was on the airwaves long before the verdict was known. If she had been awarded compensation there would be nothing new in that . . plenty of people sue and receive compensation in circumstances which are questionable. I'm fairly sure it's the reference to "Swayze"-style dancing, and the sexual overtone of "Copperface Jacks" establishment which made it 'newsworthy'.

    We are being fed crap to keep us entertained.
