Obviously based on today's events, they do not have enough evidence to bring charges at this time.
Gardaí release a suspect against whom there may be the intention to raise a charge, but when the Gardaí want to 'stop the clock' on the interview, i.e. don't want to use up their time until they have more concrete, usually forensic, evidence to work with, or if they are seeking clarity on a point of law from the DPP.

The fact that a file has been sent to the DPP suggests the question relates what form any case against an accused would be likely to take, murder or manslaughter, etc.

AFAIK, the file is still being prepared, which leads me to believe that the Gardai may be still gathering evidence.

There has been a file sent to the DPP, which indicates a certain aspect of the investigation has reached its limit, pending an answer or an authorisation from the DPP to pursue a certain line.

This is completely speculative, but I would speculate there is a question of self defence.

One of the things that struck me about this case at the time was why the hell did they use that picture of her that they did in the missing poster? The one where she was dressed up like a teen hooker.Surely they had some normal pictures of her that they could have used?

That's fairly below the belt..She's a teenage girl, Of course she will dress to impress as its part of teenage life.

Even when you were typing this, did the thought not cross your mind that it is a crass point to make?

His excuse in court for the Drink Driving was self-defence because he felt his life was in danger:

    Quote:
Judge Ann Watkin described the 42-year-old's dangerous driving as "horrendous" and said he had told "blatant lies".

    ...

Mahon claimed that he first noticed that he was being followed while he was driving in Santry Village. He said he feared he was going to be shot because he was being followed and senior gardai were aware of threats to his life.

He had not known that the man who followed him was a garda. "I did not know if he would get out with a gun or a knife, I assume the people who have made life threats to me would be carrying a gun," Mahon said.

He claimed that when he was outside his house in his car he picked up a Jack Daniels whiskey bottle to use as a weapon in the event he was going to be attacked. While he waited in his car, which was now stationary, he began to drink from the bottle, he claimed.

"I thought my life was at stake, I took more than a sup, I would have had around half, minimum," he said

In relation to the stabbing he is claiming self-defence because his own life was in danger:

    From the Indo:

"He told gardai he stabbed Dean in self-defence because he felt his own life was in danger"

Excellent idea. Drink half a bottle of Jack Daniels when you've picked it up to use as a weapon because you are scared your life is in danger thus rendering yourself incapable of defending yourself. Something stinks.

It's a popular defense strategy I think, I recall reading a couple of times how people claim that they drank after the event when they were caught over the limit.

Any case of that nature in the past has related to the accused drinking a non-alocholic beverage, cigarette or food product before being subject to the 20 minute nil-by-mouth rule on the old evidential intoxilyzer readings.

I've never heard of a previous case where someone had claimed to have downed half a bottle of whiskey after an event as Mahon as claimed, but I can't see that ever being a serious defence... certainly wasn't for him.

You're missing the point.Nothing wrong with the photo in its original context but I thought using it in the wanted poster was poorly thought out.Locals may have seen it and gotten the wrong end of the stick about her that she was a bit of a tearaway and probably ran off.Surely there was a more neutral image of Her they could have used is the point I am trying to make.

Yeah looks like the Step Dad stabbed the son in "self defence"
That step dad is one unlucky fella !

The Independent reports that Dean Fitzpatrick was killed unintentionally.

Reports state that David Mahon handed himself in to Coolock Garda station.

Mahon is reported to have stated that he stabbed Dean in self defense because he felt his life was in danger.

Mahon has been released without charge and a file is being prepared for the DPP.

Something I didnt like about that guy right from the start... He just seemed to enjoy the limelight or something.. Or just didnt have the body language you would expect a person in his position to display.

At the photoshoot for the release of the book about Amy's disappearance..

I have to say that i disagree. I've also watched the Morning show video posted earlier in the thread and I really don't see anything suspicious about him at all. I've always got the impression that he was very supportive and genuine. I remember watching them interviewed on the Late Late show a few years back and form what I can remember it was he who broke down in tears. I was really shocked when I read the News because he was the last person I would have thought was responsible for this :(

My heart goes out to Amy and Dean's Mother, its unbearable to think what she is going through right now.

so first he had to drink drive because he felt his life was in danger.
and then he had to stab his stepson to death because he felt his life was in danger.
    is this accurate?

There is a main suspect in the disappearance of Amy,a guy from a notorious Dublin scumbag family who was convicted of another murder in Spain and who was supposed to have been heard bragging that he killed her.

Mahon must have a strong hold over the Mother: c&P:

Meanwhile, devastated mum Audrey told The Star newspaper “I know he would not have done it on purpose."

But why leave him to die on the street? Why dispose of the knife down a drain?
