This might help clear up a few matters...

    For the record:
    Statutory Murder.

According to the Criminal justice Act 1990 where a person (other than a child or young person) is convicted of (a) the murder of a Garda acting in the course of their duty ; or (b) a prison officer acting in the course of their duty; or (c) murder done while committing certain offences created by the Offences Against The State Act 1939; or (d) murder committed within the state for political motive, of a head of a foreign state or of a member of government, or of a diplomatic officer of, a foreign state, the court shall in passing sentence specify as a minimum period of imprisonment to be served by that person a period of not less than forty years.

The Means Rea required for Statutory Murder was laid down by The People (DDP) v Murray (1977) where fleeing bank robbers, who shot a plain clothes police officer, had their convictions for capital murder quashed by the Supreme Court which held that there must be an intention to kill a police officer, or recklessness, which means an advertence to the possibility that the person to be killed is a police officer and then the taking of that risk.

Any updates on the perpetrators? Last I heard the Gardai believed it was a local gang. Are there many criminal gangs in Dundalk? I heard of dissidents around there but I didn't know that there were many organised criminal gangs in Dundalk.

Any link for that? The only thing I've heard about suspects is that a couple were arrested near the airport on the night of the shooting and that they were from Dublin city.

There appears to be a media blackout since that was reported.
Two of them were arrested in Whitehall, near Dublin airport and are understood to be from the capital.

According to this there are no arrests, I think AGS all ready said there was no arrest in whitehall.

"Detectives in Dundalk also believe it is likely that a criminal gang was involved rather than dissident republicans."

I must find the link there that said they were questioning local dundalk gangs as to their whereabouts at the time of shooting

Adrian spent his life giving his best to his job as a Garda. He had absolutely no enemies. I knew him through sport.
He was a great family man and always rushed home from work when he could to be in time for their bedtime, to kiss his lovely kids goodnight. He was a great community man, training young kids in the art of Gaelic football and generally teaching them to be fair and to respect each other. He went to bed early and got up early. He worked hard. He drank only an odd time and in moderation and he had a good sense of humour. A good lad.
He didn't lie in bed all day, scrounge and steal. He had a good work ethic, always fair.

Adrian was everything the people who murdered him were not.

For historic record, I think you should post that in the condolences section also (here).
    Thanks, great piece of writing.

If I'm reading this correctly, the gang could receive the death penalty for murdering the gard?

    http://www.irishstatutebook.ie/1964/en/act/pub/0005/print.html#sec1

    Death penalty restricted.

1.—(1) A person shall not be liable to suffer death for any offence other than—

    (a) treason under the Treason Act, 1939 ;

    (b) capital murder, namely—

    (i) murder of a member of the Garda Síochána acting in the course of his duty, or

(ii) murder of a prison officer acting in the course of his duty, or

(iii) murder done in the course or furtherance of an offence under section 6 , 7 , 8 or 9 of the Offences Against the State Act, 1939 , or in the course or furtherance of the activities of an unlawful organisation within the meaning of section 18 (other than paragraph (f)) of that Act, or

    (iv) murder, committed within the State for a political motive, of the head of a foreign State or of a member of the government of, or a diplomatic officer of, a foreign State;

No. The death penaly has been abolished and in fact the Constitution now prohibits it.

After the June 1989 general election, Fianna Fáil formed a coalition with the PDs; their agreed programme for government included abolishing the death penalty.
It was abolished thereafter for all offences by the Criminal Justice Act 1990.

This was done also to comply with European law - Ireland's 1989 ratification of the International Covenant on Civil and Political Rights.

Horrified by some of the eye catching headlines just trying to sell papers today, Truth been is that Journalist havnt a clue what happened and who did it as i believe the Guards have not released any information and i do believe they have handled this atrocity very well. The papers are just using ink without any facts. I hope they are all caught every one who was involved in any matter in the robbery.

Aye, the Gardi are being VERY careful in what information is being released - and rightly so.
The press are by their nature, hungry for tit-bits and insights but to ensure maximum chance of the culprits getting caught, I don't think anyone really minds waiting a little bit longer if it goes to ensure those responsible's last destination is a cell for 40 years.

From what Iv read of this tragic incident is that neither Guard had a chance to draw their weapons let alone return fire...but this is where Im a little confused.

I recall standing in the ATM que at a Bank of Ireland on Camden St and there happened to be a cash in transit to the bank...it was then I noticed the patrol car parked behind the security van with 2 armed guards sitting in the car with their weapons on their lap ready to go!...why did these two guards appraoch armed men without their weapons drawn or ready like the guards in the Camden St example? What is the standard procedure for armed guards confronting aremd raiders?

So very sorry for the family, friends and work mates and so sad!

There's no way any Garda or member of the DF is going to answer that on a public forum.

ive read car burnt out in armagh.....how will that affect the garda operation???they now need to rely on the PSNI if they are based in the north....is this right???disaster

Why is it a disaster if they have to rely on the PSNI?

No disaster relying on PSNI, if it was one of these border criminal gangs, then hopefully this does to the oil laundering plants what the callous murder of Veronica Guerin did to the drug lords.

    RIP

It has emerged that the gang that shot Detective Garda Adrian Donohoe dead then held his colleague, Detective Garda Joe Ryan, at gunpoint while they robbed the Lordship Credit Union in Dundalk, Co Louth.
