Mugged at ATM - Any way of getting money back?

    I was mugged a while back at an ATM and the guy ended up getting €300 off me. There was not much I could do really as he had a knife poking into my back so handing over the money seemed better than getting injured or possibly worse.
    On a plus point the guy was caught, but my money was gone and he has "no means of paying it back to me".
    I was just wondering if there is any way of getting that money refunded to my account from my bank due to fact it was robbed from me, or if anyone else has had a similar experience?
    Any comments or help would be appreciated. Thanks.

    There is no chance of you getting your money back from the back. This has nothing to do with the bank.

    If your handbag was robbed would you try get a replacement from the shop that you bought it in????

    I am sorry that you were robbed but you will just have to suck it up.

    sorry to hear that OP. Its happened to me a few times but they never got anything.

    I don't know any specifics but there is some way for the victims of crime to get conpensation on a conviction. the solicitor or the guard in charge of the case should know more

    No, you won't get the money back from the bank. Try asking the mugger for your money back, I think he's the only one liable in this case

    You could try the small claims court, have you any insurance?

    What a joke the scumbag says he has no way of paying it back so expects then that he does'nt have to.What about his dole can that not be given to the OP.

    I cant see why a judge cant say in cases like this that the scumbag must give back what ever he has robbed or gets an extra so many months in prison.

    Follow the mugger around all the time asking him for spare change.

    Give up your job and do this constantly.

    Eventually he will snap and murder you OR he'll give you the money back to get you to leave him alone.

    e.g, you at machine, intending to take out €50, knife in back, told to take out more.

    If so I'd say you would be entitled to it back.

    Great suggestion about taking it from his dole. That's the way it should work in this country. can't see that ever happening though.

    Knife crime should have a minimum 3 year sentence but you can bet he'll be convicted and given a suspended sentence.

    Unfortunately OP it's not likely you'll ever see that money again. Though maybe when the court case is over you could hire a couple of *cough**cough* "bailiffs" and get your money back that way :)

    No neglience at all, never said that.

    I'm fairly sure the bank recommend this action though if you are at an ATM under duress, i.e., take the money, give it to the mugger and they'll reimburse.

    Its not completely dissimilar to the tiger kidnappings, no bank employee has had to pay back via their wages the €1M they took out.

    Similarly someone breaks into your house and forces you at gun point to do a transfer using your PC and your 24 Hour banking - would you be liable, surely not?

    However if the OP took the money and got mugged 3 seconds later its a different story.

    Sorry to hear about yet another robbery and that the perp will not be forced to repay what he stole.

    The Bank or ATM service provider are not liable no matter when the robbery took place. If they were they would be liable every time a card was skimed at an atm and the details missued.

    Have to agree that the perp should be forced to pay back his/her ill-gotten gains from whatever income they have.....from a headline I saw over the last few days some are in receipt of social welf even while in jail !

    IF you was REALLY determined, you could always try claiming against him in the small claims court?
    For a very small fee for the legal papers, you can try suing him in small claims case and as such his dole/welfare would be docked at source over a period of time.
    Its only a remote possibility and chances are if being again being honest, he will probably go out and steal again to make up the money difference in loss.

    EDIT: Reading back - I see Hondasam suggested the same thing before me.
    Personally, I'm the type of stubborn sod (the wife "Madmammy" will vouch for this) that would try doing the above. I'd be so angry and thick-headed, I'd be fcuked if I'd just let the bollox away with it!

    Sorry to hear about your situation.

    It serves as a timely warning (Christmas 72 days away and folks will have been saving, taking some more money out now for presents, etc) to the rest of us to watch our backs and surroundings when at these machines. They don't watch just from close up but sometimes from across a road and/or further up or down. They wait till they see what looks like someone taking out an amount that would make their effort worthwhile. Then when you walk away, they follow you till they see a prime opportunity - an alleyway or a deep recessed doorstep to shove you into and mug you.

    I would doubt you could get the money back. It's fairly stupid to mug someone at an ATM, sure there is a camera facing right at you!

    I don't know about getting your money back but I would contact the bank to tell them what happened.

    They might have a camera on the area so this may help in catching the pr*ck.

    Also this could be a repeat offended robbing people and so could force the bank into providing more security (even if this is a camera).

    Have you gone to the Gardai? You should let them know that you've been robbed. Again if this is a repeat offender they may be able to do something.

    I was robbed at gunpoint using a drive-through ATM at a bank in the US. I had an account with this bank at the time, and it was on their property.

    I got every cent back from them.
