Five Gardai will not be charged in shell to sea tape

    Five gardaí involved in making remarks of a sexually suggestive and disturbing nature at a Corrib protest in Mayo will not face criminal charges.

    The recording was made following the arrest of two women at a protest against the Corrib pipeline in Co Mayo.

    This afternoon the Garda Ombudsman Commission published its interim report into the incident.

    The comments were recorded on a pocket camcorder seized from one of the women when they were arrested.

    A garda put it in his pocket and it was unknowingly left in record mode - and this recorded a conversation between the gardaí in their vehicle.

    The gardaí were heard joking about raping the women if they did not give their names and addresses. They also commented that one of the women - a US citizen - would be deported if she did not co-operate.

    The report says a transcript of the recording 'supports these allegations.'

    However, the investigation says it established that at no stage were the two women personally threatened about rape or deportation by the gardaí, because 'they did not hear the conversation at the time.'

    Separately a detective Garda told the inquiry that one of the women shouted that the gardaí could rape them as they were being arrested. The Ombudsman inquiry said it could not corroborate this statement from the recording because high winds distorted the sound.

    The inquiry said it found no evidence of a criminal offence having being committed.

    The interim report also found that while footage of the original incident was recovered, parts of the recording were deleted and overwritten.

    It said that a 'sequence of deletions from the device had taken place' before it was handed to gardaí.


    Shell to Sea says it does not accept that the recording was tampered with.


    Spokesperson Caoimhe Kerins said other academic files were removed from the disc before it was handed to the Garda Ombudsman, but the entire file for that day was made available.

    All five gardai in the car when the comments were made were interviewed by Garda Ombudsman.

    The interim report says investigators established within two days that three of them 'took no active part in the contentious part of the conversation, did not engage with the inappropriate comments or make any inappropriate comments themselves.'

    The Ombudsman has now decided that while the other two - a Garda and a Sergeant - remain the subject of a disciplinary inquiry, none of the five will face criminal charges.

    The Ombudsman said the level of cooperation it received during its investigation was unsatisfactory - in particular from individuals associated through academic links with the two women.

    The report states that one of the two women failed to co-operate with the investigation.

    On Friday 8 April this year, the Garda Commissioner apologised for the comments.

    Martin Callinan said he was sorry for the offence caused to the 'community we serve' and for the hurt and pain felt in particular by victims of sex crime.

    Point of the post was,report revealed the tape itself may have been tampered with.

    Sexist, very bad taste, stupid and somewhat worrying, but not illegal I would have thought.

    They've probably had their (deserved) punishment not knowing how the inquiry would pan out and wondering if their jobs were safe.

    Is there a charge that can be brought against them for wasting police resources/time if it turns out that the tape was faked or whatever.?

    I presume not because they've been doing that for years with their blockade of the Shell site :confused:

    This was "faked" was it f**k, once again the Garda have come out of this and shown there is one law for joe soap and one law for them, i do not believe for one minute this tape was "faked" in my opinion they covered it up and brushed it under the carpet.:rolleyes:

    Id love to hear in what way they are claiming it was tampered with, as it sounds quite authentic to me, and I record and edit audio for a living.

    Hardly "brushed under the carpet" considering its been all over the papers and minister for justice just made a statement about it.

    The tampering suggests that the shell to sea crowd are trying to milk it for all its worth, rather than a big cover up by the Gardai.

    In fairness they were being called rapists by the woman prior to arresting them so the poor taste, sexist, stupid and somewhat worry comments really started there. Laughing off the comments in the manner they did is pretty different as a result. The fact the tape seems to have been altered makes what they said even less of an issue.

    They should not have any disciplinary action taken against them at all.

    Who said it was faked? The article says that it may have been tampered with. That could mean pretty much anything really. I doubt it's fake.. didn't the guys involved already apologise for what they said?

    Hardly "brushed under the carpet" considering its been all over the papers and minister for justice just made a statement about it.

    The tampering suggests that the shell to sea crowd are trying to milk it for all its worth, rather than a big cover up by the Gardai.

    They probably are trying to milk it but that doesn't take away the fact that an "officer of the law" threatened to rape a woman regardless if he was "having a laugh" or not,so they've come up with this nonsense that the tape was somehow faked, unreal.

    Well, considering they didn't actually threaten the women directly i don't see how your question is relevant.

    This was an attempt at a "gotcha" on the Gardai by time-wasting eco-nobbers who have a grudge.

    OK tampered with which i also doubt, they should have been suspended without pay for a number of months at the very least in my opinion.

    The Garda have gotten away with so much in this bleedin country it beggars belief, even if your the son of a Garda you won't go to jail even if you've been caught red handed with a cocaine factory in your home http://www.herald.ie/news/courts/gardas-son-freed-over-drugs-find-at-his-home-2807384.html

    if this was anyone else they would've been sentenced to 10+ years straight away regardless if was their first offence or not but if your father and grandfather were members of the Garda you don't.

    This was an attempt at a "gotcha" on the Gardai by time-wasting eco-nobbers who have a grudge.

    and that makes all the difference does it:rolleyes: if you heard a tape of someone talking and threatening to rape your mother,sister or partner what would your reaction be,would you just put it down to someone "having a laugh"

    I seriously cannot believe some peoples opinions relating to this.

    sorry its a scan so I can't paste it in. It does state that forensic analysis of the tape shows that files were deleted and overwritten hours before it was handed over to the ombudsman.

    The forensics was done by the PSNI, I presume so that it would be independent.

    From what i can tell the tape was edited to remove the girls bringing up rape in the first place so that when the guards commentated on it later it seemed out of the blue and sexist remark that the guards made when they where simply making a joke at the girls over reaction in making rape accusations in the first place.

    I refuse to believe it even more so because a police force like the PSNI (given their shameful human rights record since their inception) say so.

    Regardless it's too late now and once again these Garda parasites have gotten away,another injustice.:rolleyes:
