Friend owes me money...

    I have a problem.

    A lent E1800 to a friend of mine over six years ago, when she was having problems paying college fees etc. She paid E500 back about two years ago, but I’m still waiting for the rest. She has since moved to Dublin and we don’t be in touch.
    She split from her husband and assures me he isn’t giving her any support, he got about 40K not long ago in redundancy and to be honest she has a new sob story every time I speak to her. She is currently waiting for her funding to come through for her PhD etc...
    I have brought up the subject several times and she assures me she hasn’t forgotten. But in truth I feel she takes me for granted – I’m meek and mild mannered - and I’m getting pissed off.

    Another issue I have with her is that she is totally homophobic and I have recently begun to acknowledge to myself that I am bisexual. Now this woman compared Senator David Norris to a paedophile to his face during a university debate in a room full of people. She is African where being anything but straight isn’t culturally acceptable to the great majority of people. Anyone seen the BBC3 Documentary “The world’s worst place to be gay”? The reason I’m bringing up the homophobia thing is that in reality this woman isn’t my friend at all and I’m not prepared to remain out of pocket for someone who has such ignorant views.
    To be honest if I get pissed off enough I would sell the debt to a debt collector as I know that legally I haven’t got a leg to stand on. I also know about a lot of shady things she has done, so perhaps its time I dropped a few subtle hints….
    I have plenty of friends who are cool with my sexuality, but I’ve decided there are some people it wouldn’t serve any purpose to come out to, this woman included.
    I know I’m being too soft, any ideas on how to get my money back without rocking the boat too much?

    She wasn't the only one, it was presumably due to extremely questionable comments made by Norris along the lines of the man-boy love theme once upon a time. Which Norris had to backtrack on and explain away. I guess you know about that little controversy though, and didn't just jump to assume she was homophobic, right?
    I know I’m being too soft, any ideas on how to get my money back without rocking the boat too much?

    Go and demand it back. If you don't want to be friends with her, don't be.

    Did you agree the repayment terms in writing prior to giving them the money? - you can't sell a debt to a collection agency unless you've some form of proof that the debt exists

    Tell her she can pay you in installments of €200. For every time she misses a payment you cut something off. Seems fair.

    You've tried on several occasions verbally but are fobbed off each time with a new story.
    So it's time to write her a letter stating that you are out of pocket yourself and expect that the debt will be settled in full in 3/6/9 months (whatever you decide).

    Tell her if not, the matter will be dealt with by your solicitor and you will ensure their fees are added to the debt. Make sure everything is typed out, especially the address on envelope (don't want her recognising your hand writing) and send this letter by registered mail to her or she'll state she never got it.

    It's a bit of a bluff call then after that as since presumably you have nothing in writing from her regarding a repayment agreement, technically a solicitor wouldn't be of much value.

    have you proof that you gave her a loan? A copy of a bank transfer? Did she sign a receipt? Did you write her a cheque? Did you transfer the amount to her bank account?
    Any one of these is proof that you loaned her the money.

    Ask her to pay you the money she owes you in instalments - if she doesn't agree to an instalment plan then tell her that you're going to sell the debt to a debt collector.

    Having to wait 6 years to be repaid is taking liberties at this stage.

    By the way, I wouldn't recommend After Hours as being the best subforum to post your question in.
    This place is frequented by trolls/malcontents/weirdos.

    She sounds like a cheeky mare taking 6 years to pay back a loan, I hope you have proof of lending, and also that you get your money back.

    :eek: I am shocked Sir, shocked to the very core of my being. Can a person, who's hobby it is to sew Barbie Doll heads on dead squirrells, not give sound fiscal and legal advice. You shall be hearing from my squirrell solicitor.

    OP do try to avoid the illegal routes in recovering your debt. Fingernails are no good to anybody else but the owner....... although.......
