Even if you proved she was over 18, you could still face charges based on the fact that she is obviously being depicted as a child.

The laws are not set in stone as to why someone is and isn't charged.

There have been quite a few cases were a judge has commented on the fact that some pornography was a form of pseudo child porn and sentenced based on this.

Also, I wonder how many people have had images of Little Lupe and Kitty on their PCs and were charged with child porn.

A few years back I read about a professor at a college in the UK who was jailed for having child pornography where the girls were judged to be between the ages of 14 and 16.

At the time I remember laughing as the whole of Hustler's Barely Legal DVD series have girls who look that young.
