Skipping the country to avoid jail

My mate has got into a bit of bother. He hammered someone and broke his collarbone and his nose. The fella reported it to the cops and he is expecting to get arrested one of these days and after that get a summons. He was already in the cop shop talking to them about it and he admitted it though he didn't give a statement yet.

Hes thinking that if he goes to australia when he gets the summons and stays for a year, the summons will go out of date or whatever. He definitely wants to come back though. Theres no way he would go and stay away forever.

Will this work or will they get him when he comes back?
Also, will the DPP be taking him to court aswell as the fella he hammered?

That was nice of your mate. Sounds like a charmer. I really like giving advice to help out people like that....

    Not....

The fella did something very very wrong and my mate didn't mean to do that much damage.

Don't get me wrong. Im not condoning what he did, its just unfortunate the way it turned out.

What did your man do to deserve a hammering?

Would he not be extradited or something? (I don't know anything about law really)

It was to do with his family.

What gives him the right to put his hands on another person? He’s a scumbag for doing it regardless of what the other guy did and he deserves to be banged up for years!!

If it's his first offence, he prob won't go to jail for it if he shows serious remorse.

I think running away over an assault charge could cause more problems in the long run...

Gwan ya, send him to Australia. Cheaper than wasting money sending him through the rap on the wrists legal system.

    Indeed

Well it all depends on why he hammered your man if he gets locked up or not. If he stole a bag of sweets off your mate then, ya your mate deserves to be locked up for giving him such a beating.

By hammered, do you mean he beat him up with a hammer, or just gave him a kicking?

Nice to see there's still a steady flow of criminals from this area of the world into Australia.

Oh yeah, and what would the cops have done if he reported it? Nothing.
And then this would have carried on. The cops in this country is a joke, so is the justice system.

He just gave him a kicking.

more than likely the DPP will charge him and order him to pay compensation .. for those type of injuries .. probably to the tune of €4000. Then more than likely a civil action will follow (about 5 years down the line) and another lump of compo will have to be paid (could be 4 times the original)

Before I am accused of speculation, a friend of mine was in similar bother a few years ago and that was the outcome.

And so is your mate for wanting to run away. What a bloody coward, if he's man enough to kick someone's @ss then he should be man enough to face the bloody consequences - be it the boys in blue or yer man's mates.

If its such a joke your mate will have no problem now will he? Cowards run away!

what did this guy do to your mates family? if he interfered with the family or any member of it in any way, he probably deserved a kicking.

I dont condone it anyway and yes, cowards run away but thats whay he wants to do. Its not me. He just asked me to find out if its possible.

What the other fella did to my mate though was a terrible thing and the cops would have not done anything. Perhaps he got carried away. To be honest, I dont know because I wasn't there when it happened. It was to do with his sister.

If someone did or was saying something about your sister around the town and the cops wouldn't do anything, what would you do?

So it's not ok for roamers mate to give some guy a beating but it is ok for his mates to give him a beating back in revenge ?

Skipping the country won't do any good, unless he makes it permanent, if he avoids the summons a warrent will be issued for his arrest and he'll get lifted next time he arrives into the country. If it becomes known that he's gone to australia he'll either be extradited or deported.

It's not worth the hassle really, he should just face up to what he did and show remorse. Taking up gaelic football might help too, they seem to get away with assault all the time :)

It all depends doesn't it? I'd confront him about it and find out exactly what is going on and why. If there was any sort of physical abuse the proper thing to do would be to get her to press charges, but I would probably fly off the wall if he admitted hitting her when I was confronting him.

I've gone off in a tangent. None of us know the true story, and what is done is done. What he did may or may not be wrong depending on his motives, BUT running away is definately not the thing to do. If you really are a mate, then convince him to stay. If he runs away he's gona mess up his life. Show you're a true friend and get him to stay and support him through this.

I would say the only mistake he made was getting caught.

Did the thought of dark car, sack, baseball bat and country lane not spring to mind?

Why the hell would the cops do anything about that ? They've much more important things to be doing than shutting down the local rumour mill.

He could have given the lad a few slaps to warn him off but now he’s fecked up his life. He’s a muppet and I don’t feel one bit sorry for him! He should be made pay for what he did!!

I'm not saying that, I'm saying they could be the consequences.

why doesn't he just talk to a solicitor? find out where he stands.

  • Closed Accounts Posts: 5,240 ✭✭✭Endurance Man

Skip the country  , this isn't hollywood. Stay and take the wrap, he deserves everything he has coming to him, running away to another country would make the situation 5x worse.
Besides, i VERY much doubt the Australian government is going to allow a wanted criminal to just walk onto there shores...

Dont be such a spa, he just broke his collar bone and his nose. That could have been done in a dig and a push. You can well fly off the handle now and act high and mighty but if the roles were reversed and someone was spreading **** about you making your life hell you wouldnt feel one bit sorry for the guy if your brother or boyfriend went after him.
