    The petitioner’s solicitor also swore an affidavit addressing service of the petition. In that affidavit he said that the 21-day letter was, as well as being served by hand at the Company’s registered office, sent by him by e-mail to Mr. Coyle’s email address. Mr. Coyle advised this court (in the appeal against the making of the winding up order) that he had configured his e-mails so that all e-mails from the petitioner’s solicitor would be treated as spam. The evidence of the summons server was that when he arrived at the premises of the Company’s registered office, the letterbox was screwed shut, but that he unscrewed it before leaving the 21-day notice there. Although affidavits were sworn by Mr. Coyle and each of his daughters following the delivery of the affidavit of the petitioner’s solicitor, none made any reference to the fact that the letterbox to the Company’s registered office (and the home of one of Mr. Coyle’s daughters) had been screwed shut and then unscrewed. In the course of his submissions to this court in the appeal against the winding up order, Mr. Coyle argued that if the demand had been delivered in the manner alleged by the petitioner the service was unlawful as it amounted to an interference with the property of the registered office of the Company which was also a private dwelling.

    A High Court judge has ruled that French film star Dany Boon is entitled to €4.87 million in damages against several entities found to have defrauded him.

    On Tuesday, Mr Justice Brian O’Moore said he was satisfied to make the award in favour Mr Boon in proceedings where the French celebrity had sought damages against French national Thierry Fialek-Birles, who is also known as Terry Birles and Thierry Waterford-Mandeville, and companies linked to him.

    Mr Justice O’Moore said the court was satisfied Mr Boon had been “defrauded” and “conned” out of a significant amount of money by Mr Birles and various corporate entities associated with him.

    Anti-vax conspiracy theorists, who claim the Covid-19 vaccine is a “bioweapon” inserting “nanochips” into recipients, are to be hit with a legal bill for tens of thousands of euro by a High Court judge to discourage them from continuing their “unmeritorious and scandalous” lawsuit against the State.

    Among the “baseless allegations” made in the lawsuit taken by Sharon Browne, David Egan and Emmanual Lavery are that the HSE was responsible for “mass killing” comparable to Nazi Germany and that the vaccine was “part of a plan by Bill Gates to depopulate the world”.

    Only right really, given what the likes of Gemma and Waters have been up to - doubt they'll ever pay a cent of the State's costs (IIRC they were not even asked to, in some of the cases anyway)

    Among the “unprecedented” orders sought by the litigants was one for the mass disinterment of the bodies of all vaccinated people under 80 who died suddenly in the past two and a half years, so they could be subject to a specific type of autopsy.

    I had the (mis)fortune to witness some of the many in hearings that saga and the ability of Paul Coyle to reject reality and substitute his own was quite staggering. Sometimes, he'd even contradict his own "facts" within minutes of uttering them.

    A right blast from the past today with Charlie Allen resurfacing 10 years on from the first mention of the Rodolphus Allen Private Trust.

    Ol' Colonel Mustard saw his proceedings against Bank of Ireland and others struck out as being frivolous, vexatious and bound to fail. As ever, he was a bit hazy on details when pressed by the court.

    When asked if he could produce a copy of this “Trust” to the court, he confirmed that he would not do so and that this was a private matter he did not have to disclose to the court. When questioned further by the court as to whether he had received any payment in respect of this Trust, Mr Allen said he would not answer that question as it was a private matter. The court notes that Mr Allen did not deny receiving payment for this “Trust”. He acknowledged that neither his nor the Trust’s interest in the Property was registered but said that as it extended only to “the equitable interest” in the Property, it did not need to be registered. 

    Roberts J. was not exactly impressed by the "expert" legal drafting on display...

    The pleadings in this case are entirely incoherent. Even taking into account the oral responses of Mr Allen to the court’s questions, it appears to me that there is no stateable cause of action disclosed in the pleadings against the BOI defendants. The plaintiffs’ overarching contention that parties relying on security over a property cannot do so where the owner later creates a “private irrevocable family trust of their equitable interest” in that property, is fundamentally misconceived. Even if I were to assume that such a trust exists (although no evidence of it whatsoever was provided to the court) there is simply no foundation in those facts for the claim made by the plaintiffs that such a trust would nullify the charges registered in favour of third parties or the Order for Possession. Indeed, Noonan J in the High Court appeal specifically referenced such a trust (albeit one alleged to have been created in 2016) and discounted its possible legal effect and severely criticised those parties seeking to persuade vulnerable litigants of its validity. Such an argument in my view does not and could not constitute a reasonable cause of action and has no legal foundation whatsoever. All the declarations regarding such alleged trust must fail. 

    Did we ever find a link on this thread with Carlow/Kilkenny's Charlie Allen and a person from that area who was more recently offering similar mortgage dodging services and is now part of a criminal investigation?

    The C&AG’s report said Nama had in 2021 sold loans related to two companies – which had a face value of €10.46 million – for €265,000 to a newly incorporated company that was funded by a family relative of the debtors involved in the case."

    Case was since dismissed. The courts are afraid of the Freemen and quietly drop the cases to save face. I will never have to pay for anything again.
