FE1 Exam Thread (Read 1st post!) No trading

Anyone know where to find information on commercial tenancies for Property? All the examiners complain that candidates can't answer the questions but I can't find enough information to prepare answers for them anywhere, I've checked manuals, prep course lectures, and Lyall on Land Law. Just have a feeling he'll ask another question on it this sitting because he asked 2 in October and complained about the responses.

Doing charitable and cy pres, trusteeship, DMC, Mareva and Quia Timet, Resulting Trusts (Just Joint Accounts and Quistclose), Estoppel, Undue Influence. Then might prep a few case notes if I have time on Satisfaction, non charitable purpose trusts, strong v bird and Hastings Bass.

Hoping I should have enough for 5 qs 🤔

I’ve heard she’s a hard marker but, I read the exam reports and it’s frequently noted that you lose marks for not addressing the question. Especially in problem questions where people just throw down an essay style instead of reverting back to the facts at hand. I’ve seen two scripts (unfortunately I don’t have them) and there was big difference between one which scored in the 60s and one that just passed and it was simply referring back to the q that got the higher marks. Idk if this helps? This is my first sitting and I’ve found the problem q’s impossible so far because of the online system so I know this won’t help me on the day lol

She seems very specific from the reports, like very sure of what she wants in the answer so the reports are actually quite valuable

Hey - I'm repeating constitutional (sadly) on the 28th, I didn't do a prep course this time round.

Does anyone have predictions from their courses as to what could be expected by the examiner? Can swap any notes/grids for all other FE1 subjects.

Panicking a bit about not covering enough for equity, can anyone tell me if I should cover Joint Deposit and Secret Trusts too?

Im doing:

1) 3 certainties

2) DMC

3) charitable/non/cy-pres

4) Trusteeship

5) Quia Timet

6) Prop Estopple

7) Note on satisfaction, strong and bird and re Hastings bass.

I think I can cover one more topic, maybe 2, if anyone has any predictions 😅

Main predictions I heard were

Trustees
Charitable/Purpose/CyPres

Quia Timet
3 certainties

Then other than that I have prepared:

Undue Influence
Rectification
Secret Trusts
Quistclose

Keep in mind I still haven't learned these all off I have a long way to go!! I am starting to feel the pressure now too

I'd recommend covering joint deposits and secret trusts as they can sometimes come up as a second half of a PQ. They're also quite straight forward with not many cases - I have 4 for joint deposit accounts

OPW Legislation

Hi,

I’ve been studying on my own and was not aware that we were allowed to bring in legislation for some exams. I urgently need legislation for contract and property. Does anyone know how long it will take to get it from the OPW? or if I can buy them second hand from anyone? Really need them in time for Tuesday and Wednesday!

Check out Done Deal and Adverts. There were some for sale when I looked last week - depending on where you are in the country you may get lucky and have a seller within collection distance from you.

Honestly of all the exams that permit legislation Contract and Property are the ones where they are least useful.

It it were EU or Company then I'd say you'd be at a bit of a disadvantage, but generally speaking you rarely use them and they are more there if you pull a blank on something specific. It really shouldn't hinder you passing not having them, I didn't even look at my legislation for property (have that one passed from my previous sitting), and I doubt I'll be using it much for Contract on Tuesday, best of luck!
