Covid cert and public pool and gym

I am a fully payed member of my local public pool and gym, I am not vaccinated. Can I legally be refused from entering or does this fall under discrimination law as it is a public fasility I am a member of since before the new restrictions were imposed?

Ask them for a refund. If you are one of those people who demand their Rights but never live up to their Responsibilities I'd say they will be happy to pay you to **** off.

What has the gym done for the OP to be able to cancel their membership? The gym is still open it just can't let the OP in until they have a Covid passport, it's not the gyms fault that the OP doesn't have one. It'd be different if the gym was refusing entry for something which isn't a legal requirement.

A few posts in and the judgements are piling in. The OP asked a straightforward question, he don't have to justify to strangers why he is not vaccinated! I'm sure the "experts"will be along shortly with their science and graphs to explain why you should be vaccinated!

If you have only just renewed your membership, I'd look for a refund, if you only have a short time left on it, I'd leave it go.

But it's not a legal requirement for the OP to have a covid cert, I'm not even sure if the requirement to have a pass to enter a gym is an actual law but I'm sure someone will tell me otherwise. The covid cert was not a condition of membership when the OP joined. The terms of the gym membership have been changed so the OP should be able to cancel their membership as they haven't agreed to the new terms.

I know someone in this situation, happy to be vaccinated but it's not exactly that easy. The GPs won't do it, the chemists won't do it. The HSE vaccine centres are preoccupied now with booster regime. It's a bureaucratic system and when people fall through the cracks, the system doesn't handle it well.

It's actually very easy. Just register on the HSE site and they'll get an appointment for a centre. Chap in work registered 2 days ago, getting his today in a HSE vaccination centre.

And just where does this chap live? Person I refer to lives in rural Ireland where there is one HSE vaccine centre for the whole county. From what I've heard this is currently doing boosters for 60 yr olds only and health staff. Maybe in Dublin or Cork, there's options??

They aren't just doing boosters. They'll give dose 1 and 2 appointments so long as someone is registered. That goes for all centres.

I'm pretty sure the medical papers are in the emergency legislation and as such the gym itself couldn't be held liable for implementing policies that exclude individuals who are not wilfully vaccinated.

It'll be up to the gym, though. You should give them a call. If it were my business and I'd decided to comply with the legislation I'd probably let customers defer their remaining membership until the legislation is lifted to avoid losing them to another business, but everyone will be different in that regard.

OP if it was a standalone pool, they would have an option. But I'm guessing it's a complex, so they are legally required to discriminate.

The public bit is really irrelevant: the same restrictions apply no matter who owns the facility.

Personally I am not happy to provide personal medical information to gyms, pubs etc. So am choosing not patronise these businesses while certs are required, irrespective of vaccine status. Am hopeful that the gym part, anyway, will be relaxed in January. I've yet to hear of an outbreak of Covid stemming from a gym, and there are a lot of elite sportspeople who have very good reasons for avoiding this particular vaccination.

It's not the HSE's fault they delayed getting the vaccine, they need to register and like the rest of us did, make the effort to go. If they register they will get an appointment.

I live in Dublin the round trip to where I got vaccinated was about 40K, if it was 300K I'd have been there on time twice

I cannot see a scenario where the gym would be held liable for refusing entry based on a Government decree. At the same time, the customer cannot be expected to pay for a gym membership they are prevented from accessing through absolutely no fault of their own. If the gym has to refund or loses customers as a result of those decrees then the onus is on them to take it up with the Government and not their customers who are expected to pay for a gym membership they cannot use.

There are nine grounds for discrimination. They are gender, marital status, family status, age disability, sexual orientation, race, religion, and membership of the Traveller community.

So no, being refused entry for being non-vaccinated does not a fall under discrimination.

March? If OP got a shot next week they would have second shot and 7 day waiting period done before end of January if Pfizer received. Second dose is valid from 17 days but likely be closer to 21 days. You can add extra week if Moderna. Worst case its early February.

Put money on pass won't be gone next year (unfortunately)
