    Just checking if anyone here has sample answers they can share for Equity. I've got quite a lot of random documents/grids etc. (Some slightly out of date up to 2019) for most of the FE1s so happy to share what I have too.

    mine is almost the same! but im still on the fence with vicarious liability. It already came up three times in a row, if it comes up this sitting it'd be four times.. so im not sure

    Could anyone give me their opinion on this:

    "Laura lived out in the country in a large house with extensive mature gardens. On the western side of her property, she had a line of about twenty conifers that had grown to around 30 feet high. After the latest storm, Laura realised that they needed to be cut down. Although there was no danger of them falling onto the road or on any house or building, the way that they had swayed and bent during the storm was frightening her children. Unfortunately, Laura could not afford to pay for them to be removed, but her next door neighbour Tony offered to cut them for free provided that he could keep the timber. Laura was delighted. Tony got to work carefully and slowly, removing one tree at a time. Tony was about half way through and was now confident that he was an expert in this tree felling business. He began to fell the trees quicker and quicker, chopping them into firewood and hauling them away. As he was cutting the final conifer, the tree fell in an unexpected direction across some overhead electrical wires that he had not noticed. As the tree fell on the wires it pulled the electricity poles supporting it, causing them to swing downwards . Annette, who was driving along the road outside of Shane's house, saw the electric pole coming down on her and swerved to avoid it, crashing into the ditch and injuring herself quite badly. Advise Annette as to any potential action in tort against Laura in this situation"

    Would Laura be liable here under vicarious liability here? It could be said that the relationship between Laura and Tony was akin to employment as he was receiving payment in the form of timber. It's just the question after this on the paper also deals with vicarious liability and wouldn't think it would come up twice on the paper. If not, why would Laura be liable for Tony's actions?

    I actually don't think Vicarious Liability came up last year. It's on my exam grid (city colleges) for appearing as question 5 but my friend answered it last year as a Pure Economic Loss / Duty of Care question and got good marks for it. The Law School Course has it down on their exam grid as DOC and Pure Economic Loss as well so i think it just depends on the lecturer which isn't helpful 🙄

    I answered it on DOC, economic loss, causation and remoteness and got a decent score. Had zero VL case law!

    Tort -

    Is anyone leaving out Nuisance and just focusing on RVF? I was going to do both but Nuisance came up by itself as an essay in March, so i'm thinking of eliminating it. Would love some opinions?

    Advantages: Slp/ sue and be sued/ tax regime/ transferable interest/ continuity in existence/ financing the company


    Disadvantage: regulation and enforcement/ compliance work/ if company goes insolvent it’s directors may be subject to close scrutiny/ restriction etc

    I did the law school course and was advised to cover nuisance and only have an outline RVF as it came up in A20!

    I know but Public and Private Nuisance came up as whole essay question in March '21 so i'm conflicted. Surely R V F is due a run.

    Yeah, it is hard to call Nuisance but it has repeated a lot before so that's why I am going to cover it but with regards RvF the last time it came up twice in a row was 2015 and only came up 3 times since so I think I am gonna give it a miss! I just feel like its unlikely 😅 I really could be wrong though!

    Constitutional & EU:

    Hey guys, I hope the study is going well. Would anyone have notes on Constitutional and EU they don't mind sharing with me?

    I'm finding working and studying is beating me down and my notes are lacking.

    I've passed 5 exams (tort, equity, property, contract, criminal) so I have some scripts and notes to share if anyone needs.

    Are people covering illegal contracts for contract exam? My grid says it hasn’t been up since October 2016 so definitely due a run but it’s so long I’d love to avoid it

    Equity: As mareva came up last time, is anyone else feeling safe to leave it out?

    I would lean towards any injunction question being on Quia Timet or interlocutory and Mareva is usually an essay type Q so it probably will be okay to leave out.
